WHEREAS, RCW 36.87 allows for the vacation of a county road that is found useless to
the needs of the County pending a Report of the County Engineer; and
WHEREAS, Resolution 15-209, passed by the Board of County Commissioners (BOCC)
on July 13, 2015, directed the County Engineer to examine a portion of unmaintained Newaukum
Station to Newaukum Prairie Road, Chehalis, and report his opinion to the BOCC; and
WHEREAS, as required by RCW 36.87, on the 30th day of September, 2015, the Report of
the County Engineer on the matter of the proposed vacation of the following described portion of
unmaintained Newaukum Station to Newaukum Prairie Road, Chehalis was filed in the office of
the BOCC, to wit:
All that part of Newaukum Station to Newaukum Prairie Road beginning at a point where
the South line of Section 24, Township 13 North, Range 2 West, W.M., intersects the
West line of the Julian Bernier Donation Land Claim, thence Southeasterly along the West
line of said Donation Land Claim to the Northerly right of way line of the Forest Napavine
Road.
WHEREAS, the report and all related materials having been reviewed by the BOCC and
found appropriate for further proceedings,
NOW, THEREFORE, BE IT RESOLVED that the 2nd day of November, 2015 at or after the
hour of 10:00 a.m., in the BOCC Hearing Room on the 2nd floor of the Historic Courthouse in
Chehalis, Washington, has been fixed by the BOCC as the time and place for the hearing on the
Engineer's Report, when and where all persons may appear and be heard upon the report and
upon the matter of the vacation of the roads.
BE IT FURTHER RESOLVED that the Clerk of the Board is hereby instructed to proceed
with all necessary notifications, posting and publication.

TO THE BOARD OF COUNTY COMMISSIONERS:
I,the undersigned County Engineer of Lewis County, Washington,to whom was referred on the 13th
day of July, 2015 by Resolution 15-209, ordering me to examine all that part of Newaukum Station to
Newaukum Prairie Road beginning at a point where the South line of Section 24,Township 13 North,
Range 2 West, W.M., intersects the West line of the Julian Bernier Donation Land Claim,thence
Southeasterly along the West line of said Donation Land Claim to the Northerly right of way line of the
Forest Napavine Road,stating that the Board of County Commissioners(BOCC) intends to proceed to
determine whether said road should be vacated and abandoned for the reason that it is useless as a part of
the County road system and that the public will be benefited by its vacation and abandonment,herewith
submit my report thereon:
FIRST:Newaukum Station to Newaukum Prairie No.108 Road was petitioned for by residents of the
area on April 20, 1876,viewed on August 8, 1876 by three persons appointed by the BOCC to view and
locate the county road petitioned for,and was surveyed June 19, 1876. Although the road does not appear
to have been formally established, it was established through its use by the public in territorial times prior
to the petition being filed.
SECOND: A 1912 vacation of a portion of Newaukum Station to Newaukum Prairie Road adjoins this
proposed vacation on its north side and also reduced the right of way width of this proposed vacation area
from 60 feet to 40 feet.
THIRD: The right of way is adjoined by three property owners,Teitzel Family LLC, Teitzel-Selchert
LLC and Druckman Family LLC all who have requested the vacation.
FOURTH: Utility companies known to service the general area have been contacted and have acquired
all necessary easements for their utilities.
FIFTH: The portion of right of way does not abut a body of water,nor is the right of way necessary as
part of the county road system.
SIXTH: The $700.00 Administration fee for the vacation has been paid by the applicant. The applicant
has also deposited$200.00 for legal publication fees.No compensation is required for that portion of right
of way per LCC 12.15.040.
In my opinion,this portion of right of way is considered useless and should be vacated for the reason that
the public will be benefited by its vacation,returning the property to the tax rolls.
I include with this report a map showing the roa pr posed to be vacated.

Description
Resolution 15-209, passed by the Board of County Commissioners on July 13, 2015, declared its
intent to vacate a portion of unmaintained Newaukum Station to Newaukum Prairie Road, Chehalis,
and instructed the County Engineer to examine the road and report his opinion on the vacation, as
required by RCW 36.87.010.
The three property owners adjoining that portion of unmaintained Newaukum Station to Newaukum
Prairie Road have requested the vacation. Utility companies known to service the general area have
been notified and have acquired all the necessary easements for their utilities lying within the area to
be vacated. The County Engineer has prepared his report on the matter, which is hereby submitted.
Recommendation
Acceptance of the report and passing the attached resolution would set a November 2, 2015 hearing
date for consideration of the matter. RCW 36.87.050 requires publication at least once a week for two
consecutive weeks preceding the date fixed for the hearing in the county official newspaper and that a
copy of the notice be posted for at least twenty days preceding the date fixed for hearing at each
termini of the county road or portion thereof proposed to be vacated.
