Approving a MOU with the Association of Lewis County Deputy Prosecuting Attorneys BEFORE THE BOARD OF COUNTY COMMISSIONERS OF LEWIS COUNTY, WASHINGTON RE: RESOLUTION TO APPROVE A MEMORANDUM ) OF UNDERSTANDING BETWEEN LEWIS ) COUNTY AND THE ASSOCIATION OF LEWIS ) COUNTY DEPUTY PROSECUTING ATTORNEYS ) RESOLUTION NO. 15- , � FOR CALENDAR YEAR 2015 ) WHEREAS, the Board of County Commissioners, Lewis County, Washington, has reviewed a Memorandum of Understanding between Lewis County and The Association of Lewis County Deputy Prosecuting Attorneys; and WHEREAS, it appears to be in the best public interest to authorize the execution of the said Memorandum of Understanding for Lewis County; NOW, THEREFORE BE IT RESOLVED that the aforesaid Memorandum of Understanding between Lewis County and the Association is hereby approved and the Board of County Commissioners is authorized to sign the same. r3. Memorandum of Understanding This Memorandum of Understanding is made on the last of the dates inscribed at the foot hereof between: Association of Lewis County Deputy Prosecuting Attorneys; — and — Lewis County, by and through its Board of County Commissioners and Jonathan Meyer its Prosecuting Attorney. 1. The parties hereto hereby amend their Collective Bargaining Agreement for the term of February 1, 2014 through December 31, 2015 as follows: a. The base pay set out in Appendix A and referred to in section 13.1 of the CBA shall be increased by 1.20% effective November 1, 2015. b. The maximum employer contribution of $950 per month toward the premiums for defined medical, dental, and vision insurance provided for in section 9.3 of the CBA shall be increased to $1,000 per month, effective November 1, 2015. c. Section 8.4.2 of the CBA shall be deleted and replaced with the following, effective upon ratification of this MOU by the Association and by the County: "8.4.2 Subject to the following, the Prosecuting Attorney has adopted the County's Travel Policy: "8.4.2.1 A County motor pool vehicle normally will be made available when a Deputy is required to undertake business travel. In any instance in which the Office Manager has established that a pool car is not available, a Deputy will be reimbursed for use of his or her personally owned vehicle ("POV") at the then-current IRS Standard Mileage Rate for Business Travel. "8.4.2.2 Deputies normally shall travel together, rather than in multiple cars, when traveling to a common destination. "8.4.2.3 Should a Deputy elect to use a POV in preference to a pool car, he or she will be reimbursed at the Memorandum of Agreement. Nov.2015. LC Ass'n of DPAs and Lewis County. Page 2 of 3. then-current Business Travel Rate. However, such reimbursement will not be allowed in situations addressed in §8.4.2.2 above. "8.4.2.4 Mileage reimbursement is inclusive of all costs (including insurance). In the event of a collision or other incident occurring during business use of a POV, the Deputy will not be reimbursed for any insurance deductible, nor for any loss of any kind whatsoever arising out of or related to such collision or incident. Accordingly, Deputies contemplating use of a POV are cautioned to verify that their own insurance policies offer coverage which they deem to be sufficient during business travel. "8.4.2.5 During calendar year 2015, the IRS has set the Business Travel rate at 57'/2¢ per mile. This is subject to change." 2. This Memorandum of Understanding shall be subject to ratification by the membership of the Association, and by the Board of County Commissioners and the Prosecuting Attorney of Lewis County.
