Amending the Rural Arterial Program (RAP) Project Agreement BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF LEWIS COUNTY, WASHINGTON
IN THE MATTER OF:
Amending the Rural Arterial Program (RAP) Project }
Agreement for Construction Proposal for County Road } RESOLUTION NO. 16-
Project (CRP) 2084, Centralia Alpha Road Improvements }
WHEREAS, pursuant to WAC 136-167-030, a county may withdraw an uncompleted RAP project
and request a reduced Rural Arterial Trust Account (RATA) payback amount after RATA reimbursement
has been made by the County Road Administration Board (CRAB)to the county; and
WHEREAS, the CRABoard granted Lewis County the withdrawal of CRP-2084, Centralia Alpha
Road Improvements (RAP project number 2110-01) and a reduced payback of the $152,283.80 of RATA
funding received by the county to date at their April 14, 2016 quarterly meeting; and
WHEREAS, Amendment No. 4 will add the following new language as Section 10 to the existing
Project Agreement: Per the waiver of payback granted by the CRABoard on April 14, 2016, $123,640.22
funding provides for eligible design costs incurred prior to that date; and
WHEREAS, the Public Works Director/County Engineer has reviewed Amendment No. 4 to the
Centralia Alpha Road Improvements - CRP 2084 and repayment of $28,643.58 of RATA funding to
CRAB, and recommends the Board of County Commissioners (BOCC) approve this resolution that
authorizes the Chair of the BOCC to sign Amendment No. 4 and the reduced repayment of RATA funds
received.
NOW THEREFORE BE IT RESOLVED that the BOCC has determined that Amendment No. 4 to
the Centralia Alpha Road Improvements-CRP 2084 and the reduced repayment of RATA funding received
from CRAB is in the best public interest and the BOCC hereby authorizes the Chair to sign Amendment
No. 4 on behalf of the BOCC, and the repayment of$28,643.58 of RATA funds that have been paid to the
project within sixty (60) days of a letter from CRAB dated April 18, 2016.

Enclosed are three original unsigned contract amendments offered to your county allowing for
waiver of payback of$123,640.22 in RATA funds for eligible design costs incurred and as
approved by the CRABoard on April 14, 2016. Repayment of the remaining $28,643.58 is
expected within 60 days of the date of this letter.
Pursuant to WAC 136-170-030 (1)(a)these contracts must be signed by your County
Commissioner/County Executive and received in our office no later than June 2,2016 to be valid.
Please request your Commissioner/County Executive sign all three originals.

This is Amendment No.4 to the above described Project Agreement, between the County of Lewis, hereinafter the"County"and
the State of Washington County Road Administration Board, hereinafter the"CRABoard."
WHEREAS, the COUNTY and CRABoard desire to amend the original Project Agreement to allow waiver of payback of expended
RATA funds under the conditions described in WAC 136-167-030.
NOW, THEREFORE, pursuant to chapter 36.79 RCW and in consideration of the terms, conditions, covenants, and performance
contained herein, or attached and incorporated and made a part hereof,
IT IS MUTUALLY AGREED AS FOLLOWS:
1. The following new language is added as section 10 to the Project Agreement:
Per the waiver of payback granted by the CRABoard on April 14, 2016, $123,640.22 funding provides for eligible design costs
incurred prior to that date.
2. All other terms and conditions of the original Project Agreement shall remain in full force and effect except as modified by
this Amendment No.4.

Centralia Alpha Road Improvements(Res. 10-112)between Lewis County and County Road Administration
