2018-01-29 Business Meeting Minutes LEWIS COUNTY BOARD OF COUNTY COMMISSIONERS(BOCC) Business Meeting minutes January 29, 2018 Present: Commissioner Fund, Commissioner Jackson, Commissioner Stamper Recorder: Rieva Lester Commissioner Fund called the meeting to order at 10:03 a.m., determined a quorum and then proceeded with the flag salute. PUBLIC COMMENT Carol Brock of Onalaska, representing the Lewis County Seniors Board, requested donations and said the seniors are opening a thrift store soon. Portland resident Sean Bell of RES America discussed RES America's 157-megawatt wind farm with 38 wind turbines. He said an application was submitted the previous week and that RES is working on cost- reimbursement for the county. Sean said the Audubon Society is concerned about the marbled murrelet. He said a Habitat Conservation Permit will soon be filed for review. EMPLOYEE RECOGNITION The commissioners recognized the following county employees and presented those in attendance with certificates or plaques: Employment milestones Five years: Lee Napier, Community Development. 10 years: Kama Marx of the Auditor's Office,Cheryl Hendricks and Judge James Lawler of Superior Court, and Wayne Chase and Todd Weaver of Public Works. 15 years: Marc Hamilton of Public Works. 25 years: Mike Hamling of Public Health and Social Services. 30 years: Ronald Anderson of the Sheriff's Office and David Escober of Public Works. 35 years: Kenneth Cheeseman of the Sheriff's Office. 1 I "Above and Beyond" recipients Gabe Anzelini, Chris Brewer and Amanda Price of Information Technology/Discover Lewis County. Grace Jimenez, Gladis Mendez and Renee Shepherd of the Auditor's Office. Katie Strozyk of Public Health &Social Services. Cheryl Millman of the Department of Emergency Services. Brad Clark, Mollie Hurt,Tara Snelson and Alene Stewart of Community Development. Heather Boyer and Kalessa Markham of the Auditor's Office. NOTICE ITEMS Commissioner Stamper made a motion to approve Resolutions 18-038 through 18-040. Commissioner Jackson seconded. Resolution 18-038: Call for bids for the 2018 Rock Proposal. Bids are due to the Clerk of the Board by 11 a.m.Tuesday, Feb. 13, 2018. Erik Martin, Director of Public Works, spoke to the resolution. He said Public Works places the call for the bids annually. He said it's for crushed screenings and crushed surfacing top course. Erik said snow sand will not be needed this year. Resolution 18-039: Notice of the publication of the county's On-Call Consultant Roster. Erik Martin, Director of Public Works, spoke to the resolution. He said the annual publication advertises for architectural, engineering and /or professional services. He said the roster can be added to at any time during the year. Resolution 18-040; Notice of the publication of the county's Small Works Roster. Erik Martin, Director of Public Works, spoke to the resolution. He said the county uses the small works contractors for projects less than $300,000. Motion passed 3-0. 2 CONSENT ITEMS Commissioner Jackson made a motion to approve minutes from the January 22,2018, meeting as well as Resolution 18-041. Commissioner Stamper seconded. Resolution 18-041:Approval of warrants/claims against the various county departments. Chief accountant Suzette Smith, representing the Auditor's Office, said warrants numbered 784325- 784495, 784560-784593 and 784603-784717 were issued the week of Jan. 19 for a total payment against the county in the amount of$1,506,355.48. She said draw/benefit warrants numbered 784033- 784271 totaling$268,722 also were approved. Suzette noted a skip in sequence for warrants 784272-784324, 784496-784559, 784594-784602 and 784718-784806, which were issued on behalf of Special Purpose Districts. Motion passed 3-0. DELIBERATION ITEMS Commissioner Stamper made a motion to approve Resolutions 18-042 through 18-053. Commissioner Jackson seconded. Commissioner Jackson left at 10:33 a.m. Resolution 18-042: Approve J. David Fine to represent county employees Jonathan Meyer and Jeremy Almond and former county employee Luke Stanton in a litigation case in which all three are named as defendants. Commissioner Fund introduced the resolution. Resolution 18-043: Approve Law, Lyman, Daniel, Kamerrer& Bogdanovich, P.S.,to represent county employees Jamey McGinty and Ramona Romine in a litigation case in which both are named as defendants. Commissioner Fund introduced the resolution. Resolution 18-044: Approve a Personal Services Agreement between Lewis County and Butler Amusements Inc.to provide carnival activities, including games, rides, and food concessions,to the Southwest Washington Fair. Steve Walton, Director of Central Services, spoke to the resolution. Steve said it's a five-year agreement and includes language about inspections. He noted that the previous year was a record year at the fair. 3 Resolution 18-045: Approve infrastructure access and support agreements between Lewis County Information Technology Services Department and the emergency response services of Centralia PD, Chehalis PD, Morton PD, Napavine PD,Toledo PD, Pe Ell PD, Fire Districts 1, 2, 3, 5, 6, 8, 13, 14, 15, 20 and 48, and the Riverside Fire Authority. Steve Wohld, Director of Information Technology services, spoke to the resolution. Commissioner Jackson returned at 10:36 a.m. Steve listed the various entities signing the access and support agreements. Resolution 18-046: Approve an interagency agreement between Lewis County and Washington State University for the delivery of outreach education programming for the citizenry of Lewis County. Sheila Gray,WSU Director, spoke to the resolution. She said the agreement is signed annually. She said WSU already has 49 programs planned for 2018. Resolution 18-047: Initiate a county road construction project and assign a County Road Project(CRP) number. Erik Martin, Director of Public Works, spoke to the resolution. He said the resolution is for the Townsend Road Bridge project. He said the road is off of Cinebar Road. Resolution 18-048: Accept an offer to purchase surplus property located on Roundtree Road, Boistfort, subject to conditions of LCC 3.30.400. Erik Martin, Director of Public Works, spoke to the resolution. Erik said the Roads Department purchased the property during a project to realign Roundtree Road. He said a gentleman has offered $51,000 for the property. Resolution 18-049: Approve and accept Quit Claim Deeds from Reliable Enterprises and Reliable Project LLP to Lewis County for additional right of way for Harrison Avenue in Centralia. Erik Martin, Director of Public Works, spoke to the resolution. He said Reliable Enterprises has been working on a project in an Urban Growth Area and needed to dedicate property for utilities. Resolution 18-050: Authorize Supplement No. 1 with SCJ Alliance for the Lewis County Borst Avenue Improvement project. Erik Martin, Director of Public Works, spoke to the resolution. He said the county contracted with SCJ Alliance in 2017 and that the county has since received grant funding for the project. He said the county is agreeing to a $567,734 contract with SCJ Alliance for final design, bidding support and construction engineering. 4 Resolution 18-051: Approve the purchase of one new excavator for the Solid Waste Division of the Lewis County Public Works Department. Steve Skinner, Solid Waste Services Manager, spoke to the resolution. He said an excavator is near its end of life. He said the county is using the National Joint Powers Alliance to purchase the excavator from Pape Machinery. He said the excavator will be paid for out of a crane reserve. Resolution 18-052: Approve an annual contract with Forensic Pathologists for autopsy services. Warren McLeod, Lewis County Coroner,spoke to the resolution. He said the annual contract is for autopsy services. He said the set rate is$88,000 for 2018. Resolution 18-053: Approve an annual contract with mortuaries for decedent removals. Warren McLeod, Lewis County Coroner,spoke to the resolution. He said the annual contract is for the removal of decedents. He said the agreement is for$270 per removal, of which the county averages 12 per month. Motion passed 3-0. HEARINGS Resolution 18-054: Adopt the amended 2018 Annual Construction Program (ACP) and Six-Year Transportation Improvement Program (TIP)for the years 2018-23. Commissioner Fund introduced the hearing. Erik Martin, Director of Public Works,gave the staff report. He said RCW 36.81.121 requires the adoption of a TIP and ACP. He said Lewis County had done so and must amend it because the county has received federal funding for three projects: Pleasant Valley Bridge Scour, Stowell Bridge Scour and the Townsend Bridge replacement. He said the total for the three projects is$2,267,520. Commissioner Fund asked if there were any questions. Ron Averill of Centralia asked if it was the Pleasant Valley off of Highway 603. Erik said it was. Commissioner Fund then closed the question-and-answer portion of the hearing, Erik asked that his previous comments be adopted into the record. Commissioner Fund asked if anyone wanted to speak for or against the resolution. No one spoke. Commissioner Fund closed the hearing. 5 Commissioner Jackson made a motion to approve Resolution 18-054. Commissioner Stamper seconded. Motion passed 3-0. Resolution 18-055: Rescind Lewis County Policies 08-208 &08-209 and establish an updated Public Records Request Policy. Commissioner Fund introduced the hearing. Public Disclosure Manager Casey Mauermann, Public Records Attorney Ross Petersen and Risk and Safety Administrator Paulette Young(by phone) gave the staff report. Casey said the policy and fee schedule are being changed. Ross said the policy had been in effect since 2008. He said the county needs to reconfigure how it operates. He said the new policy gives guidelines and procedures for the public and will help the county fill the requests in a more timely manner and to create a system for processing the requests sequentially based on the order in which they were received. Commissioner Fund asked if there were any questions. Commissioner Stamper thanked Casey, Ross and Paulette for their efforts. Commissioner Fund asked what would happen if someone submitted 100 requests. Casey said the policy address multi-request queue and how those requests would be responded to. Commissioner Fund asked if there were any questions from the public. There were none. Commissioner Fund then closed the question-and-answer portion of the hearing. Casey and Ross asked that their previous comments be adopted into the record. Commissioner Fund asked if anyone wanted to speak for or against the resolution. Paulette thanked Casey, Ross and Paulette for their efforts. Commissioner Fund closed the hearing. Commissioner Stamper made a motion to approve Resolution 18-055. Commissioner Jackson seconded. Motion passed 3-0. GOOD OF THE ORDER Commissioner Stamper thanked Chronicle reporter Justyna Tomtas for her efforts and wished her well in her future endeavors. Commissioner Fund discussed the previous week's Homeless Connect event. 6 Commissioner Jackson discussed the cold weather homeless shelter. He said it has served 1,000 individuals. PRESS CONFERENCE No questions from the media. Ron Averill of Centralia wished Justyna Tomtas well. He then discussed the capital budget and funding now available for the Flood Authority. Lee Napier, Director of Community Development, discussed the Legislature's recent Hirst response. She said information is available online at lewiscountywa.gov/community-development/hirst-response. Lee discussed Water Resource Inventory Areas (WRIA). Lee said more information will be added to Community Development's web page as it becomes available.
