LEWIS COUNTY, WASHINGTON
IN THE MATTER OF: }
The necessary acquisition of additional }
right of way for North Fork Road }
Realignment Project } RESOLUTION NO. 18- ■
WHEREAS, the Lewis County Transportation Improvement Program includes the North Fork Road
Realignment Project; and
WHEREAS, RCW 8.08.010 empowers the County to condemn land for public use when deemed
necessary for public purposes; and
WHEREAS, on November 6, 2017, the Board of County Commissioners (BOCC) passed
Resolution 17-329, instructing the County Road Engineer to acquire all necessary right of way for the North
Fork Road project under its eminent domain authority; and
WHEREAS, negotiations have not been successful in acquiring right of way from one property
owner and will require condemnation; and
WHEREAS, on March 19, 2018, the Board of County Commissioners passed Resolution 18-100
instructing the Public Works Department to proceed with all necessary notifications and publications
required by RCW 8.25.290; and
WHEREAS, notice of planned final action has been given by publication once a week for two
successive weeks; and
WHEREAS, the property owner of record has been sent notice of planned final action by certified
mail.
NOW, THEREFORE, BE IT RESOLVED that the Prosecuting Attorney is hereby directed to initiate
condemnation proceedings to acquire and not to exceed said right of way described in attached Exhibit "A".

Description
The Lewis County Transportation Improvement Program includes the North Fork Road Realignment Project.
On November 6,2017,the Board of County Commissioners (BOCC)passed Resolution 17-329, instructing the
County Road Engineer to acquire all necessary right of way for the North Fork Road project under its eminent
domain authority. Negotiations have not been successful in acquiring right of way from one property owner and
will require condemnation. On March 19, 2018, the BOCC passed Resolution 18-100 instructing the Public
Works Department to proceed with all necessary notifications and publications required by RCW 8.25.290.
Since that date all notifications and publications required by law have been met. This resolution would direct the
Prosecuting Attorney to initiate condemnation proceedings to acquire said right of way.
