the operation of wheeled all-terrain vehicles )
on designated County roads and rights of way )
WHEREAS, Lewis County is considering amending Lewis County Code regulating the
operation of wheeled all-terrain vehicles on designated County roads and rights of way; and
WHEREAS, Lewis County Code 1.05.020 requires that amendments to the Lewis County
Code be adopted by Ordinance prior to inclusion; and
WHEREAS, RCW 36.32.120(7) requires that no ordinance be adopted until a public
hearing is held by the County legislative authority of which at least 10 days' notice has been given;
and
WHEREAS, Lewis County is providing notice to inform residents of the new Chapter to the
Lewis County Code and inviting community members to comment on the proposed usage of
wheeled all-terrain vehicles on designated County roads and rights of way.
NOW, THEREFORE, BE IT RESOLVED that the 4th day of June 2018, at or after the hour
of 10:00 a.m., in the Commissioners Hearing Room on the 2nd floor of the Historic Courthouse in
Chehalis, Washington, has been fixed by the Board as the time and place for the hearing for the
purpose of receiving public testimony regarding passing an Ordinance regulating the operation of
wheeled all-terrain vehicles on designated County roads and rights of way; and
BE IT FURTHER RESOLVED that the Clerk of the Board is hereby instructed to proceed with
all appropriate and necessary notifications, posting and publication as required by RCW 65.16.160.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN that on the 4th day of June, 2018, the matter of adopting a new
chapter to Lewis County Code will be heard.
The code would regulate the operation of wheeled all-terrain vehicles on designated County roads
and rights of way.
This matter has been reviewed by the Lewis County Board of Commissioners and found
appropriate for further proceedings and that the 4th day of June, 2018 at or after the hour of 10:00
a.m.,in the Commissioners Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis,
Washington, has been fixed by the Board as the time and place for the hearing on said matter,
when and where all persons may appear and be heard.

Description
State of Washington during the 2013 2nd Special Session, amended the Revised Code of Washington(RCW)
46.09 "Ofd Road,Non-Highway, and Wheeled All-Terrain Vehicles,"allowing counties to regulate the
operation of wheeled all-terrain vehicles on designated streets,roads, or highways. Lewis County's Sheriff's
Office,the Public Works Department, and interested individuals met to discuss usage of wheeled all-terrain
vehicles on designated Lewis County roads. Lewis County recognizes the expanding popularity of wheeled all-
terrain vehicles and is intending to allow the use of such vehicles on certain open County roads in district 3.
June 4, 2018 at or after the hour of 10:00 a.m., has been fixed by the BOCC as the time and place for the
hearing to consider the adoption of a Chapter of the Lewis County Code regulating the operation of
wheeled all-terrain vehicles on designated County roads and rights of way.
