CODE )
WHEREAS, state law permits one to drive a wheeled all-terrain vehicle on public
roadways with a speed limit of thirty-five miles per hour or less if the vehicle complies with
state equipment standards and the driver properly registers it; and
WHEREAS, as a prerequisite to use of wheeled all-terrain vehicles on public
roadways within the unincorporated county, RCW 46.09.455 directs Lewis County to pass
an ordinance approving such use on specified public roads; and
WHEREAS, the approved roads must be listed publicly from the main page of the
county website, per RCW 46.09.455(1)(c)(iii); and
WHEREAS, the Washington Department of Transportation encourages counties to
employ the above procedure through grants for the erection of road signs indicating areas
in which wheeled all-terrain vehicles may be used; and
WHEREAS, the grant program requires a county to pass its ordinance authorizing the
use of wheeled all-terrain vehicles before any grant application may be accepted; and
WHEREAS, collecting all of the state equipment, registration, and declaration
requirements into one ordinance will afford better notice to the motoring public as to how
to lawfully use wheeled all-terrain vehicles; and
WHEREAS, Lewis County has undertaken a SEPA analysis before taking any action
on this ordinance; and
WHEREAS, the Board of County Commissioners believes that adopting the ordinance
herein is in the public interest;
NOW THEREFORE be it ordained by the Board of County Commissioners that:
Section 1 . A new chapter 10.40 of the Lewis County Code is created as follows:
Chapter 10.40
WHEELED ALL-TERRAIN VEHICLES
Sections:
10.40.010 Definitions.
10.40.020 Equipment and declaration requirements for on-road use.
10.40.030 When wheeled all-terrain vehicles may be driven on public roadway.
10.40.040 List, map, and signage of authorized roads.
10.40.050 Unauthorized use of wheeled all-terrain vehicle—Penalty.
10.30.010 Definitions.
The definitions set forth in this section apply throughout this chapter:
(1) "Nonhighway vehicle" means any motorized vehicle, including an off-road vehicle, primarily
designed for use for recreational purposes on nonhighway roads, trails, or a variety of other
natural terrain, excluding the following:
(a) Any vehicle designed primarily for travel on, over, or in the water;
(b) Snowmobiles or any military vehicles; or
(c) Any vehicle eligible for a motor vehicle fuel tax exemption or rebate under
Chapter 82.38 RCW while an exemption or rebate is claimed. This exemption includes but is not
limited to farm, construction, and logging vehicles.
(2) "Off-road vehicle" means a nonstreet registered vehicle generally used for recreational
purposes on nonhighway roads, trails, or a variety of other natural terrain. It includes, but is not
limited to, all-terrain vehicles, motorcycles, four-wheel drive vehicles, and dune buggies.
(3) "Wheeled all-terrain vehicle" means:
(a) any motorized nonhighway vehicle with handlebars that is fifty inches or less in width,
has a seat height of at least twenty inches, weighs less than one thousand five hundred pounds,
and has four tires having a diameter of thirty inches or less; or
(b) a utility-type vehicle designed for and capable of travel over designated roads that
travels on four or more low-pressure tires of twenty psi or less, has a maximum width less than
seventy-four inches, has a maximum weight less than two thousand pounds, has a wheelbase of
one hundred ten inches or less, and satisfies at least one of the following: (i) Has a minimum
width of fifty inches; (ii) has a minimum weight of at least nine hundred pounds; or (iii) has a
wheelbase of over sixty-one inches.
(4) "Wheeled all-terrain vehicle" does not include a four-wheeler, three-wheeler, golf cart, go cart,
off-road vehicle, or any other similar type of vehicle unless it fully complies with the definitions
herein and the requirements of LCC 10.40.020.
10.40.020 Equipment and declaration requirements for on-road use.
To the extent required in RCW 46.09.457, now or as hereafter amended:
(1) A person who operates a wheeled all-terrain vehicle on a public roadway must comply with
the following equipment requirements:
(a) Headlights meeting the requirements of RCW 46.37.030 and 46.37.040 and used at
all times when the vehicle is in motion upon a highway;
(b) One tail lamp meeting the requirements of RCW 46.37.525 and used at all times when
the vehicle is in motion upon a highway; however, a utility-type vehicle, as described under RCW
46.09.310, must have two tail lamps meeting the requirements of RCW 46.37.070(1) and to be
used at all times when the vehicle is in motion upon a highway;
(c) A stop lamp meeting the requirements of RCW 46.37.200;
(d) Reflectors meeting the requirements of RCW 46.37.060;
(e) During hours of darkness, as defined in RCW 46.04.200, turn signals meeting the
requirements of RCW 46.37.200. Outside of hours of darkness, the operator must comply with
RCW 46.37.200 or 46.61.310;
(f)A mirror attached to either the right or left handlebar, which must be located to give the
operator a complete view of the highway for a distance of at least two hundred feet to the rear of
the vehicle; however, a utility-type vehicle, as described under RCW 46.09.310(19), must have
two mirrors meeting the requirements of RCW 46.37.400;
(g)A windshield meeting the requirements of RCW 46.37.430, unless the operator wears
glasses, goggles, or a face shield while operating the vehicle, of a type conforming to rules
adopted by the Washington state patrol;
(h) A horn or warning device meeting the requirements of RCW 46.37.380;
(i) Brakes in working order;
(j)A spark arrester and muffling device meeting the requirements of RCW 46.09.470; and
(k) For utility-type vehicles, as described under RCW 46.09.310(19), seat belts meeting
the requirements of RCW 46.37.510.
(2)A person who operates a wheeled all-terrain vehicle upon a public roadway must first provide
the declaration required in RCW 46.09.457(1)(b) to the Washington Department of Licensing.
(3)This section LCC 10.40.020 does not apply to emergency services vehicles, vehicles used for
emergency management purposes, or vehicles used in the production of agricultural and timber
products on and across lands owned, leased, or managed by the owner or operator of the wheeled
all-terrain vehicle or the operator's employer.

10.40.030 When wheeled all-terrain vehicles may be driven on public roadway.
A person may drive a wheeled-all terrain vehicle on the roads within unincorporated Lewis County
designated in LCC 10.40.040 if all of the following conditions are true:
(1) The driver has and possesses a current Washington driver's license, or current out-of-state
driver's license if the driver resides out of state, and the driver's privilege to drive is not suspended
in this or his or her home state;
(2) The wheeled all-terrain vehicle has a current metal tag and on-road registration from the
Department of Licensing; or is exempt from such tag and registration under RCW 46.09.442(6)(a),
now or as hereafter amended, due to registration in another state with equivalently stringent
standards;
(3) The wheeled all-terrain vehicle and driver have satisfied the equipment and declaration
requirements of LCC 10.40.020, or are exempt under LCC 10.40.020(3).
10.40.040 List, map, and funds for signage of authorized roads.
(1) The attached Exhibit A is the list of roads or portions of roads within unincorporated Lewis
County, by name and milepost, that are approved for use by wheeled all-terrain vehicles. This
list may from time to time be amended by resolution of the Board of County Commissioners.
(2) The Public Works Department shall create and maintain a map depicting the roads and
portions of roads listed in Exhibit A, now as or hereafter amended. The list and map shall be
publicly available from the main page of the Lewis County web site.
(3) By July 1, 2018, the Public Works Department shall apply for a grant to obtain funds for a
reasonable number of signs or traffic control devices indicating areas in which wheeled all-terrain
vehicles may be lawfully driven on the public roadway.
10.40.050 Unauthorized use of wheeled all-terrain vehicle—Penalty.
It is a civil infraction under LCC 1.20.040 to:
(1) Operate a wheeled all-terrain vehicle on a public roadway in violation of any of the terms
of this chapter; or
(2) Operate a four-wheeler, three-wheeler, golf cart, go cart, off-road vehicle, or any other
type of vehicle that is similar to a wheeled all-terrain vehicle, but which does not meet the
requirements of a wheeled all-terrain vehicle under this chapter, on a public roadway.
Section 2. This enactment is in the public interest and shall take effect upon
passage.
Section 3. If any portion of this Ordinance is found to be illegal, unconstitutional,
unenforceable, or without effect in any manner, the remainder of this Ordinance shall
remain in full force and effect.

Description
Pursuant to RCW 46.09,by Ordinance,local authorities are authorized to allow the use of wheeled all-terrain
vehicles on designated County roads and rights of way.
Adoption of this Ordinance will establish a new Chapter 10.40 of the Lewis County Code, and allow the use of
wheeled all-terrain vehicles on designated County roads and rights of way. The roads approved for use by
wheeled all-terrain vehicles will be listed publicly and made accessible from the main page of the Lewis
County website.
A Public Hearing was held providing an opportunity for any person to appear and be heard, either for or against
the adoption of the Ordinance allowing the use of wheeled all-terrain vehicles on designated County roads and
rights of way. The public hearing was held June 4, 2018 pursuant to notice published in The Chronicle on May
15th and May 22nd of 2018.

THE LAST TIME THE ATV ORDINANCE WAS PROPOSED THE COUNTY HEARD FROM A
GROUP OF RESIDENTS WHO FACED SOME OF THE GREATEST IMPACT FROM AN
INFLUX OF ATV RIDERS. RESIDENTS WERE CONCERNED WITH A LACK OF PLANNING
FOR AN INFRASTRUCTURE TO SUPPORT INCREASED NEED FOR:
POLICE
EMERGENCY RESPONSE
BATHROOMS
GARBAGE RECEPTICLES
PARKING FOR TRUCK AND TRAILERS
THESE ARE NOT FEARS BASED ON A NOT IN MY BACKYARD MENTALITY.THIS NEED
FOR PLANNING IS BASED ON WHAT TAKES PLACE IN THAT RESIDENTIAL AREA
ALREADY.
WHEN RESIDENTS SHARED THESE CONCERNS WITH GARY STAMPER AND THE
COUNTY WE WERE TOLD ANY FURTHER PLANNING WOULD INCLUDE THE
COMMUNITY. THAT DID NOT HAPPEN.
THIS WAS A GOLDEN OPPORTUNITY FOR THE COUNTY TO PLAN, YOU WERE
OFFERED A BLUEPRINT OF HOW TO PROCEED WITH INCLUSIVITY. YOU DID NOT USE
IT.
WE ARE TOLD ATVS WILL BE A BOON TO THE ECONOMY. BASED ON WHAT? HOW
MANY RIDERS WILL IT TAKE FOR A MEASURABLE BENEFIT TO OUR ECONOMY. 1000,
2000?WHERE IS THE COST/BENEFIT ANALYSIS TO SHOW WHETHER IT IS EVEN A
FEASIBLE PROPOSITION?
HOW WILL LEWIS COUNTY JUSTIFY THE INCREASED NEED FOR POLICE AND
EMERGENCY SERVICES THAT IS TAX PAYER SUBSIDIZED?
THE CURRENT PLAN CALLS FOR ABOUT 126 AN SIGNS TO BE PLACED AROUND
APPROVED ROADS AT THE COST OF ABOUT$300 EACH. THIS IS ALMOST$38,000. IN A
TIME WHEN THE COUNTY IS TIGHTENING ITS BELT AND DOESN'T HAVE ENOUGH
MONEY FOR SENIOR CENTERS WE ARE SPENDING MONEY FOR AN IDEA WITH
APPARENTLY NO CONCRETE STUDY TO DETERMINE HOW, WHEN OR IF WE COULD
RECEIVE ANY FINANCIAL BENEFIT THAT WOULD OUTWEIGH THE COSTS?
LEWIS COUNTY ALSO HAS CREATED AT LEAST 30 CHOKE POINTS WHERE RIDERS
WILL BE FACED WITH CROSSING A HIGH SPEED HIGHWAY OR ROAD ILLEGALLY TO
REACH A NEW ROAD OR TURN AROUND AND TAKE A LONGER ROUTE. WHAT WILL
PEOPLE DO?
PAGE 8, SEPA QUESTION 7-A-4 SAYS, "DESCRIBE SPECIAL EMERGENCY SERVICES
THAT MIGHT BE REQUIRED" AND THE ANSWER IS, "THERE ARE NO SPECIAL OR
ADDITIONAL EMERGENCY SERVICES AS A RESULT OF THIS PROPOSAL."
IT HAS ALREADY BEEN ESTABLISHED IT WILL TAKE AT LEAST 20 MINUTES FOR
VOLUNTEER EMERGENCY SERVICES TO REACH THE END OF KOONS ROAD.THERE IS
A GOLDEN HOUR TO REACH AN INJURED PERSON WHICH IS DIFFICULT DEEP IN THE
WOODS WITH A VOLUNTEER FIRE DEPARTMENT. ADD HUNDREDS OR A THOUSAND
RIDERS AND IT IS LUDICROUS TO THINK THAT NO ADDITIONAL EMERGENCY
SERVICES WILL BE NEEDED

THERE WILL BE NO ADDITIONAL NOISE BECAUSE OF STATE MANDATED NOISE
SUPPRESSION. STATE LAW RCW 46.09.470 ONLY REQUIRES A MUFFLER SYSTEM
REDUCING NOISE DOWN TO 86 DB.
NORMAL TRAFFIC IS 70 DB.
EXTENDED EXPOSURE TO ANYTHING OVER 85 DB CAN LEAD TO HEARING LOSS.
EXPECTING NO INCREASE IN AN UNHEALTHY NOISE LEVEL IS A PHYSICAL
IMPOSSIBILITY.

THE COUNTY ACKNOWLEDGED THAT THERE WILL BE AN INCREASE IN EMISSIONS
BUT IT IS DIFFICULT TO ESTIMATE SO IT WILL PROBABLY BE MINOR.
CURRENT MODELS OF ATVS ARE SOLD WITH A FORM OF EMISSION CONTROL BUT
THESE IN NO WAY COME CLOSE TO WHAT IS MANDATED FOR FULL SIZE VEHICLES .
OLDER ATVS WHICH ARE STILL WIDELY USED DID NOT HAVE EMISSION CONTROLS.
POSITING THAT ANY EMISSIONS WILL BE MINOR IS A GUESS.
IF THE COUNTY TRULY BELIEVES THAT ATV RIDERS COULD IMPACT THE ECONOMY
THEN THE NUMBERS NEEDED TO PRODUCE THAT IMPACT WOULD POSE AN
INCREASED HEALTH RISKS TO PEOPLE LIVING IN THE AREA WHO WILL BE EXPOSED
TO INCREASE IN CARBON MONOXIDE, NITROGEN OXIDE AND OTHER VOCS.
RESIDENTS WILL ALSO BE EXPOSED TO FAR GREATER NOISE THAN IS HEALTHY.
LEWIS COUNTY CANNOT SAY THAT THIS IDEA IS GOING TO BE A BOON TO THE
ECONOMY WITH NO IMPACTS ON HUMAN LIFE OR NEED FOR ADDITIONAL SERVICES.
THAT IS NOT GOING TO BE POSSIBLE WITH THE NUMBERS OF RIDERS WHO WILL BE
NEEDED TO MAKE THAT KIND OF MEASURABLE IMPACT.
GARY STAMPER SAW FIRST HAND WHAT HAPPENS WHEN YOU ENCOUNTER A LOG
TRUCK COMING DOWN THE HILL ON THE GRAVEL PORTION OF SALMON CREEK
ROAD. AT THAT TIME GARY CALLED THAT ROAD NOT APPROPRIATE FOR AN
TRAFFIC. NOTHING HAS CHANGED INCLUDING THE COUNTY'S DELIBERATE
INDIFFERENCE TO ALL OF THE PLANNING, SAFETY AND ENVIRONMENTAL ISSUES
THAT WERE BROUGHT UP.
IN THIS COUNTY YOU CAN'T BUILD A HOUSE FIRST AND SUBMIT THE PLANS LATER.
WHY DOES THIS SAME PRINCIPAL NOT APPLY HERE?
AGAIN, THE PEOPLE WHO ARE AFFECTED MOST HAVE BEEN IGNORED IN THIS
PROCESS UNLESS THEY COMPLETELY AGREE WITH THE PROPOSAL.
THE BASIS FOR ANY DECISION MAKING OR PROBLEM SOLVING SHOULD BE
COLLABORATION. COMMISSIONER STAMPER WAS A TEACHER, A COACH AND AN
ADMINISTRATOR AND IT SHOULD NOT NECESSARY FOR ME TO REMIND HIM AND
THE REST OF THE COMMISSION OF THIS FACT.
IT IS THE JOB OF EVERY PUBLIC EMPLOYEE WHO WAS CONSULTED IN THIS PROCESS
TO INFORM THE COMMISSIONERS OF POSSIBLE SAFETY AND ENVIRONMENTAL
ISSUES NOT TO JUST GREEN LIGHT A PROJECT BECAUSE IT SOUNDS LIKE A GOOD
IDEA. AS EVIDENCED BY MANUFACTURER STICKERS PLACED ON EVERY AN
DISCOURAGING ON ROAD USE THE AN INDUSTRY DOES NOT SUPPORT THIS
PROPOSAL.
JUST BECAUSE THE STATE OF WASHINGTON PROPOSED THIS DOES NOT MAKE IT
SAFE OR SOUND. THE COUNTY TOOK THIS EXACT TACT WITH THE MARIJUANA
LEGALIZATION.
IF THIS IS APPROVED ALL LEWIS COUNTY PERSONS INVOLVED IN THE BLIND
APPROVAL OF THIS PROCESS WILL BE RESPONSIBLE WHEN THE FIRST PERSON,
HOPEFULLY NOT A CHILD, IS MAIMED OR KILLED AS A RESULT OF THIS PROPOSAL.

Please find enclosed the statement I read on behalf of my husband at the meeting today.
Next you will find an email originally sent to the commissioners in April 2016. You will find a couple of
statements plus six easy, concise, logical questions that even after two years no one has addressed. I
would greatly appreciate some answers.
PLEASE consider these words before voting to change the entire personality of our community.
We STILL have concerns about garbage clean up, lack of parking, lack of sanitation, lack of police
enforcement, lack of emergency services, and lack of cell phone service. Can you PLEASE explain to us
why such an easily demonstrated really bad idea is now a great idea ?
Nothing has changed for us. What changed for you?

Thank you taking the time to address my concerns.
I apologize for not being there but I am out of town in meetings with two counties in Iowa on
development issues.
First, I would like to address the fact that whether knowingly or unwittingly, by passing the ordinance
including Salmon Creek Rd and Koons Rd,you are creating a Recreation Area. By definition an ATV is a
recreational vehicle. You are not commuting to your job. You are not transporting goods. You are
intending to use these vehicles for recreation and recreation only in this area. Passing this ordinance
including these roads will create a Recreation Area and that is not allowed under current zoning use.
There are no stores or parks. The resort is on Winston Creek Rd and is not connected as this road is 50
mph. You are not connecting one place to another. After reading county documents, this activity is not
even listed in your"Rural Land Use Summary".You have not shown this as an additional recreation area
in your"Long Term Planning". It has not even been identified in your"Great Outdoors Concept". You
have not created a way to collect fees to fund, resource, and procure additional law enforcement,
sanitation, parking, signage, etc. This activity was never even considered when license fees were set.
There have been no workshops regarding this addition. This is completely contrary to Lewis County's
processes, planning, regulations, and principles. You are putting our lives,the trucker's lives, the ATV
rider's lives at stake. I would ask the Commissioners remove this area from the ordinance until such
time the following criteria are met: logging operations cease permanently;the county acknowledges
the Recreation Area and holds planning workshops to identify the need for county resources; surveys
and community outreach are done; environmental impact study is completed and found to be non-
detrimental;the resources required are funded and procured. This ordinance should not be passed until
there is an in depth fact finding mission to ensure it meets all the county requirements in all areas
impacted. The intent of electing a board of commissioners is to have a means of checks and balances so
one commissioner does not sweep aside the aforementioned by passing an ordinance for his political
gain.
Second, I would like to refer to the last time Salmon Creek and Koons Rd were thought to be an ideal
place to try a new ordinance. You were met by a majority of the community opposing this ordinance in
this area. We explained the safety issues and the lack of planning. The commissioners reviewed and
sided with the community that this is a bad idea in this location and said it would not be pursued
without our involvement. One meeting where Mr. Stamper lied to us does not constitute community
involvement. What changed? The roads are still narrow and winding with steep drop offs to Salmon
Creek. The cell phone service for emergencies is non-existent. The logging operations have increased
with gravel trucks and oversized loads moving equipment from operation to operation. What changed
was apparently one commissioner concerned with buddying up to the maximum number of voters and
seems to have gone blind to reality. I hope the rest of the commissioners, especially those that were
here for the previous discussion, do not let that happen.
In closing, I would like to point out that passing this ordinance including Salmon Creek and Koons Rd,
seems to be the sole ambition of one commissioner whose ability to make clear decisions seems to
become clouded at election time. He does not feel the need or responsibility to abide by existing rules.
The commissioner met with the community and heard the objections and lied to every one of them
about keeping them informed of any further consideration. The commissioner went for a ride that night
up Salmon Creek Rd and had to back down to a full logging truck, yet he STILL made the reckless and
irresponsible decision to initiate an ordinance that includes Salmon Creek and Koons Rd. This is a case
where the benefits do not out weight the harm. You are not providing water to a dry community; you
are not bringing in power or communication. You are bringing in congestion to unsafe area. You are
bringing in trash that you have no plan of cleaning up. You are bringing in pollution and waste and
noise. We do not know what you feel the benefits are but it can in no way offset the impact to our
safety and our way of life in this quiet, peaceful community. The community has rights, too. We have
the right to move away from the noise and the traffic and have a peaceful existence where we
purchased property and built homes in a place we could not have anticipated the disturbance of ATV
clubs who wish to impose their way of life on our small community. This is not a public park. This is not
a town. This is our front yards. This is a rural area and is so zoned. This is not a well thought out
ordinance to benefit the community; it is just someone's current whim to garner the maximum number
of votes in an election season.

I am writing in response to the article that appeared in the paper in late March regarding the use of the Lake Mayfield area for
ATV/ORVs. First and foremost, we take great issue with the idea of using the roads and surrounding areas for ATV/ORV use
and you have been greatly misinformed that the area is the"least resistant to the idea".
I would like to point out that almost two years ago the County promised us we would be informed of any movement in this
direction. I am now extremely disappointed that we were never made aware this was actively being pursued. It is my
understanding that Mr. Stamper has been quoted as saying he has been"working on this for three months". That is more than
enough time to provide notification to all those who will be impacted by this decision.
Let me point out I live on Salmon Creek Road which appears to be one of your target areas and ,therefore,) have several
concerns which need to be addressed.
1. In your newly created recreational area, where has the county designated parking for the vehicles/trailers required for this
activity? Is it currently in the county budget for for the signage and maintenance that would be required?Are any SWPP or
environmental impact studies been completed in regard to the new county designated parking area?
2. The simple fact that whether you like it or not, human presence results in garbage. Will there be designated dumpster, trash
cans, porta-potties? What about a water supply? Lewis County is opening a recreation area to anyone and everyone from
anywhere and the bottom line is humans require facilities. Have these facilities been provided for within the budget?
3. Since this a very rural area, these type of facilities also draw in unwelcome wildlife. I would like to know who is going to
maintain and monitor this aspect of the recreational area. Again, is it currently in the county budget for the installation and
maintenance?
4. Since this new recreation area is designed to invite people to visit and use it, what does the County intend to do about crime,
no matter how minor the infraction? Is it currently in the budget to provide for increased law enforcement presence?
5. What is your plan for increased risk to safety? As you should be aware, cell service is limited at best and non-exist ant at
most. Has the county entered into some agreement for cell towers to be installed ?
6. Have you considered the noise pollution? I can hear a chain saw at a half mile. Will there be specific days or hours for
operation? If so,who in the county will be monitoring those hours? Do you have a designation for patrols and monitoring in the
budget?
Finally, and most importantly,the Lewis County Community Development documents speak to to"maintaining rural quality of
life", "what would be expected in a rural lifestyle", and "protecting rural character". I am hard pressed to see how your new
recreational area is complaint within those principles. Perhaps you can clarify how turning our front yards into your recreational
area will NOT affect the rural quality of life? Of course it will. The simple facts outlined above, the increased traffic(both foot
and vehicle), human waste, garbage, potential illegal activities and the NOISE level will greatly impact residents in the area.
