2018-06-11 Business Meeting Minutes LEWIS COUNTY BOARD OF COUNTY COMMISSIONERS(BOCC) Business Meeting minutes June 11,2018 Present: Commissioner Fund, Commissioner Jackson, Commissioner Stamper Recorder: Rieva Lester Commissioner Fund called the meeting to order at 10:05 a.m., determined a quorum and then proceeded with the flag salute. PUBLIC COMMENT Sean Bell of Portland-based RES Americas gave an update on the Skookumchuck wind project. He said the SEPA comment period is closed and that RES is awaiting word back from the county so RES can complete the EIS. He said RES had concerns about building permit fees. NOTICE ITEM Commissioner Stamper made a motion to approve Resolutions 18-186. Commissioner Jackson seconded. Resolution 18-186: Call for bids for the Prairie Creek Culvert Replacement Project (Bunker Creek Road MP 5.678),CMP 1604. Bids are due to the Clerk of the Board by 11 a.m. Tuesday,June 26, 2018. Erik Martin, Director of Public Works, spoke to the resolution. He said the culvert will be replaced for wildlife and fish passage and that the project will include stream bed and road restoration. He said the concrete culvert boxes last longer than the metal ones. He said the life expectancy of the concrete boxes is at least 20 years but that they can last substantially longer. Motion passed 3-0. CONSENT ITEMS Commissioner Jackson made a motion to approve minutes from the June 4,2018, meeting as well as Resolution 18-187. Commissioner Stamper seconded. Resolution 18-187: Approval of warrants/claims against the various county departments. 1 Chief accountant Suzette Smith, representing the Auditor's Office, said warrants 800,051-800,084 (totaling$54,041.29) were issued the week of June 1 and that payroll/ benefit warrants numbered 791,543-791,618 and automatic deposits 1-598 (totaling$3,621,221.29) were issued June 5. Suzette noted a skip in sequence for warrants 800,000-800,050, which were issued on behalf of Special Purpose Districts. Motion passed 3-0. DELIBERATION ITEMS Commissioner Stamper made a motion to approve Resolutions 18-188 through 18-191. Commissioner Jackson seconded. Resolution 18-188: Designations and related appointments with the Washington Counties Risk Pool. Wayne Whiton, Risk and Safety Administrator, spoke to the resolution. He said the resolution updates the appointments for the Washington Counties Risk Pool. Resolution 18-189: Declaration of certain vehicles as surplus county property and notice of intent to sell.The two auctions will take place June 29, 2018:one at Ritchie Brothers Auction in Chehalis and the other online at www.govdeals.com. Tim Murphy, Fleet Services Manager, spoke to the resolution. He said several vehicles are no longer useful to the county and are being declared surplus. Resolution 18-190:Approve an interlocal agreement between Lewis County and City of Centralia regarding work by county crews and authorizing signatures thereon. Erik Martin, Director of Public Works, spoke to the resolution. He said the county is performing chip- seal and fog-seal work totaling $52,167.22, plus administrative fees of$2,608.36, for a total of $54,775.58. Resolution 18-191: List the bids received and contractor(s)selected for the 2018 Countywide Hot Mix Asphalt(HMA) project, CRP 2179C. Erik Martin, Director of Public Works, spoke to the resolution. He said the contract provides for pavement repair, cleaning, sweeping, applying tack coat, surface grinding, placing geogrid reinforcement, paving, approach transitions, shoulder finishing and traffic control and that Lakeside Industries submitted the low, winning bid of$626,469.60. 2 Motion passed 3-0. HEARING Ordinance 1284: Hearing for Ordinance No. 1284,which would update the county's critical areas standards. Commissioner Fund introduced the hearing. Lee Napier, Director of Community Development, and Fred Evander,Senior Long Range Planner, gave the staff report. Fred said the Critical Areas Standards are supposed to be updated every 10 years or so. He said the county's periodic review of the ordinances was due June 30, 2017. He said work began in February 2017. Fred said changes include the following: a reorganization in the administration, changes in the areas regulated, changes in buffers, added buffer reduction options and improved critical areas mapping. Fred said the Departments of Ecology and Health as well as state agencies helped provide information. Fred said he would like to propose two changes to the ordinance. Eric Eisenberg,Chief Civil Deputy Prosecuting Attorney for the Lewis County Prosecuting Attorney's Office, said the two proposed changes were scrivener's errors.The first was the effective date on the last page, which was left blank and should have said ... "shall be effective on July 1, 2018." He said the second change was in Appendix 6-A on page 90. He said the change would be to add three types of soil that had been omitted. Eric said the effective date would be considered a substantive change and requires a longer comment period. He said the board could table the hearing and resume it June 25, 2018, on which it could then be passed. Eric said the Growth Management Act requires the county to pass an Ordinance to safeguard critical areas using the best available science. He stressed that much of the ordinance is required by state law. He said technology has improved, making it easier to navigate. Commissioner Fund asked if there were any questions. Commissioner Stamper asked if potential developers could review the information early in their process. Fred said efforts are being made to make the information accessible and easier to navigate. Fred said wetlands and geological hazards can make development in some areas difficult. He said critical areas are regulated because you don't want slopes falling on homes or rivers running through homes, etc. He said that the benefits outweigh the burdens. 3 Commissioner Stamper asked if there are opposing views about the "best science available." Fred said he spoke to a hydrologist about how to determine the best available science, which helped reduce and target the county's efforts. Eric noted that the Department of Health voiced concerns but withdrew its State Environmental Policy Act (SEPA) comments after reviewing its concerns with Fred. Ron Averill of Centralia said a VSP plan based on identifying farms that touch critical areas has been submitted. He asked what will happen since it was submitted using the old data. Lee Napier said the VSP plan will be submitted in late June. Fred said the county has two ordinances: 1735 (agriculture land) and 1735-A. He said Voluntary Stewardship would replace Ordinance 1735. Commissioner Fund then closed the question-and-answer portion of the hearing. Lee, Fred and Eric asked that their previous comments be adopted into the record. Commissioner Fund asked if anyone wanted to speak for or against the resolution. No one spoke. Commissioner Jackson made a motion to amend proposed Ordinance 1284 to reflect two changes:the insertion of three soil types and the insertion of an effective date of July 1, 2018. Commissioner Stamper seconded. Motion passed 3-0. Commissioner Jackson made a motion to table the public hearing for Ordinance 1284 until June 25, 2018. Commissioner Stamper seconded. Commissioner Fund clarified that public comment would be continued through June 25. Motion passed 3-0. GOOD OF THE ORDER Commissioner Fund congratulated participants of the EDC's weekend shark-tank type event. Commissioner Stamper congratulated the EDC on the success of the event. 4 Peter Lahmann, president of the Lewis County Historical Society, invited the audience to the pie festival at the Borst Home. He also discussed an upcoming exhibit of historic medical items for the Southwest Washington Fair. Ron Averill of Centralia said China Creek work has gone to bid and should begin soon. CJ Neer of Destination Packwood invited the audience to the group's Fireside Events as well as an upcoming farm-to-table dinner. She also asked for volunteers to help promote Lewis County during the Puyallup Fair. PRESS CONFERENCE No questions. Commissioner Fund invited the group to the Community Economic Revitalization Board (CERB) workshop on rural broadband planned for June 21.
