North Street, Chehalis, Washington, at or after 10 a.m. on August 13, 2018; and WHEREAS, the purpose of the public hearing is to take public testimony or written comment concerning Ordinance #1289, which would amend Chapter 6.05 and Section 2.25.130 of the Lewis County Code pertaining dangerous animal proceedings and appeals; NOW THEREFORE BE IT RESOLVED that at or after 10 a.m., August 13, 2018, in the Commissioners' Hearing Room on the second floor of the Historic Courthouse in Chehalis, Washington, has been fixed by the BOCC as the time and place for the hearing for Ordinance #1289. BE IT FURTHER RESOLVED that the Clerk of the BOCC is hereby instructed to proceed with all appropriate and necessary notifications, postings, and publications as required by law. North Street, Chehalis. It may then be enacted immediately at the conclusion thereof. The Ordinance, if adopted, will amend Ch. 6.05 LCC and LCC 2.25.130 to make procedural and substantive changes to dangerous animal proceedings and appeals. The full text of the proposed Ordinance will be mailed to any person, upon request directed to the Clerk of the Board of County Commissioners, tel. 360-740-1120. The changes include the creation of a citizens' panel to hear dangerous animal cases, as well as technical, procedural, and substantive changes to make the citizens' panel hearing and subsequent appeal occur efficiently and fairly. Separately, a speedy court process not dependent on any civil or criminal prosecution is created to address situations in which a dangerous animal's owner fails to meet the legal requirements for keeping a dangerous animal. Finally, a provision is added to make a fifth or subsequent civil animal violation within a 10-year period a misdemeanor instead of an infraction. Anyone desiring to voice an opinion for or against the proposed ordinance should appear and be heard. Written comments may be submitted to the BOCC by August 10, 2018. The BOCC Hearing Room is handicap accessible.
