RE: COUNTY EMPLOYEE DIANNE DOREY
WHEREAS, The Board of County Commissioners previously established a process for
providing litigation defense and indemnification for County officers and employees in certain
circumstances; and
WHEREAS, a Lewis County elected official, Dianne Dorey, has been named as a
defendant in her official capacity in the matter of Riverside Fire Authority, vs. Lewis County;
Dianne Dorey, and the Washington Dept. of Revenue: Thurston County Superior Court Case No.
18-2-03465-34 for actions allegedly taken in the course and performance of her duties for Lewis
County; and
WHEREAS, Dianne Dorey has requested defense and indemnification pursuant to
Resolution 03-042 and 04-164, and
WHEREAS, it currently appears that defense and indemnification of Dianne Dorey is
appropriate in the circumstances of this case. NOW, THEREFORE,
BE IT RESOLVED, that the Board of County Commissioners approves Dianne Dorey
requests for defense and indemnification in the above-referenced lawsuit, with the exception of
and subject to review in the unlikely event of any award of punitive damages, based upon actions
taken during the course and performance of her duties as Lewis County Employee; and
BE IT FURTHER RESOLVED, that Eric Eisenberg is hereby requested and authorized
to provide legal defense for Dianne Dorey, in accordance herewith; and the Lewis County Risk
& Safety Administrator, pursuant to Resolution 10-151, is authorized to serve as adjuster for this
complaint.
