WHEREAS, the Board of County Commissioners (BOCC) has reviewed an Agreement between
Lewis County, Washington and Ron T and Beverly Lakey regarding a proposed administrative settlement
of negotiations for acquisition of 0 11 acre of land for the North Fork Road Realignment Project near
Chehalis Washington, at an agreed amount of$11,000 00, and
WHEREAS, it appears to be in the best public interest to authorize said Agreement for Lewis
County,
NOW, THEREFORE, BE IT RESOLVED that to resolve the matter and conclude negotiations
the Agreement between Ron T and Beverly Lakey and Lewis County is hereby approved and the BOCC is
authorized to sign the same

ROAD CONSTRUCTION AGREEMENT

IN THE MATTER OF An administrative settlement of negotiations between the parties hereto
pertaining to right of way acquisition for the North Fork Road Project;
THIS AGREEMENT, by and between RON T LAKEY AND BEVERLY LAKEY, husband and wife,
herein referred to as "Property Owner," and LEWIS COUNTY, a political subdivision of the State of
Washington, herein referred to as "County"
WITNESSETH,
(1) WHEREAS, the County made an offer to the Property Owner dated November 26, 2018,
agreeing to pay $900.00 for 0.08 acre of land $300 00 for a perpetual easement over 0.03 acres,
$100 00 for a temporary easement over 0 07 acres, $3,700.00 for 550 linear feet of fencing, 55
linear feet of which is located in the temporary easement area, for a total of $5,000 00, all for the
North Fork Road Project, and
WHEREAS, the Property Owner has expressed some additional concerns regarding the proposed
cost associated with reconstruction of their fence and is requesting an additional $7 000 00, and
WHEREAS, the County has reviewed the Property Owners fencing estimate and has examined the
existing fence and reviewed the cost associated with said reconstruction and relocation, and
WHEREAS, based on the type of fencing and the associated costs and specialized knowledge to
construct and replace this type of fence the County is now willing to add an additional $6,000 00 to its original
offer; and
NOW THEREFORE, to resolve this matter, and conclude negotiations the parties hereto each in
consideration of the covenants herein contained and in performance thereof on the part of the other, do
hereby agree to the following terms and conditions

(1) Property Owner hereby agrees to sell, convey and warrant to County, free and clear of all
encumbrances not shown on the attached deed furnished by County title in and to a parcel of land
lying Northwesterly of North Fork Road in the East Half of the West Half of the East Half of the
Northeast Quarter (E112 W112 E112 NE1/4) of Section 16, Township 13 North, Range 1 West,
W M , being more particularly described in said deed
(2) County agrees to pay $900 00 for the above referenced 0 08 acre of land for road right of way
lying along and outside the present County Road right of way
TOTAL - $900.00
(3) Property Owner hereby agrees to grant and convey to the County, a perpetual easement over,
on and across a parcel of land lying Northwesterly of North Fork Road in the East Half of the West
Half of the East Half of the Northeast Quarter (E1/2 W112 E1/2 NE1/4) of Section 16, Township 13
North, Range 1 West, W M , being more particularly described in said easement
(4) County agrees to pay $300.00 for the above referenced 0.03 acre of perpetual easement for
road right of way lying along and outside the present County Road right of way
TOTAL - $300.00
) Property Owner agrees to convey to County a temporary easement over land Northwesterly of
North Fork Road in the in the East Half of the West Half of the East Half of the Northeast Quarter
(E1/2 W1/2 E112 NE1/4) of Section 16, Township 13 North, Range 1 West W M , being more
particularly described in said easement
(6) The County agrees to pay $100.00 for a temporary easement over 0 07 acre
TOTAL - $100.00
(7) Property Owner hereby agrees to the payment of $9,700.00 for 550 linear feet of fencing 55
linear feet of which is located in the temporary easement area and the associated reconstruction of
adjacent fencings and appurtenances for said fencing which need to be altered as a part of the
fence relocation
TOTAL- $9,700.00
(8) County will pay all reasonable filing, recording and processing fees, if any, incurred by Property
Owner incidental to above said grant to County upon presentation of invoice, bills, or paid receipts
GRAND TOTAL— S11.000.00

Description
Resolution 17-329, passed by the Board of County Commissioners (BOCC) on November 6, 2017, instructed
the County Engineer to acquire right of way for the North Fork Road Realignment Project The County made an
offer to property owners, Ron T and Beverly Lakey(Property Owner), dated November 27, 2018, agreeing to
pay $5,000 00 for 0 11 acre of land and fencing for the project During negotiations the Property Owner
expressed concerns regarding the costs associated with reconstruction and relocation of their fencing and
requested an additional $7,000 00 The County reviewed the costs and is now willing to add an additional
$6,000 00 to its original offer for a total of$11,000 00 The Property Owner has signed the agreement which is
acceptable to the Public Works Department Approval and execution by the BOCC will conclude this
acquisition
