2019-08-26 Business Meeting Minutes . LEWIS COUNTY BOARD OF COUNTY COMMISSIONERS(BOCC) Business Meeting minutes August 26, 2019 Present Commissioner Jackson, Commissioner Stamper, Commissioner Fund Recorder Rieva Lester Commissioner Jackson called the meeting to order at 10 a.m , determined a quorum and then proceeded with the flag salute PUBLIC COMMENT None PRESENTATION Commissioner Stamper made a motion to approve a proclamation recognizing September 2019 as National Recovery Month Commissioner Fund seconded. JP Anderson, Interim Director of Public Health and Social Services, introduced Glenn Steinorst, who read the proclamation into the record Mindy Greenwood, Director of Substance Use at Cascade Mental Health, invited the audience to a Sept 6 event at Yard Birds Motion passed 3-0. NOTICE ITEMS Commissioner Fund made a motion to approve Resolutions 19-239 through 19-241 Commissioner Stamper seconded Resolution 19-239 Notice of hearing regarding a franchise request from Astound Broadband LLC, which plans to construct,operate, and maintain telecommunications facilities in Lewis County rights of way.The hearing will begin at or after 10 a m Sept 16, 2019, in the Commissioners' Hearing Room Martin Roy, Real Estate Services Manager, spoke to the resolution He said Lewis County Code and RCW require that all rights of way be authorized by a franchise He noted that it will be a five-year contract 1 Resolution 19-240• Notice regarding the extended closure of Logan Hill Road to all through traffic Martin Roy, Real Estate Services Manager, spoke to the resolution. He said a portion of Logan Hill Road was closed for a slide repair and that unforeseen construction issues creates the need to extend the closure Resolution 19-241 Notice regarding the temporary closure of a portion of Silverbrook Road to all through traffic. Martin Roy, Real Estate Services Manager, spoke to the resolution He said a portion of Silverbrook Road will be closed to all through traffic from Sept 9 to Nov 1, 2019 Martin said Silverbrook is being shored up so it can be used as a detour for Highway 12 if needed Motion passed 3-0. CONSENT ITEMS Commissioner Stamper made a motion to approve minutes from the August 19,2019, meeting as well as Resolution 19-242 Commissioner Fund seconded. Resolution 19-242 Approval of warrants/claims against the various county departments Chief accountant Suzette Smith, representing the Auditor's Office, said warrants numbered 818,256- 818,434 and direct disbursement numbered 1126 were approved for payments against the county totaling$324,670 10 She noted a skip in sequence for warrants 817,159-817,255, which were issued on behalf of Special Purpose Districts. Motion passed 3-0 DELIBERATION ITEMS Commissioner Fund made a motion to approve Resolutions 19-243 through 19-245. Commissioner Stamper seconded Resolution 19-243.Approve a Local Solid Waste Financial Assistance agreement with the Washington State Department of Ecology for moderate-risk waste and recycling programs Steve Skinner, Solid Waste Services Manager, spoke to the resolution He said the two-year agreement is renewed every other year Steve said the grant is for$135,416.50 with a county match of$45,138.83, 2 r for a $180,555 33 total Steve said a bulk of the funding will be used to replace the Hazo Hut skin Steve said the county's free disposal voucher program is reaching record levels Resolution 19-244 Appoint Leland Rakoz to the Lewis County Water Conservancy Board Commissioner Fund spoke to the resolution She noted that the Water Conservancy Board has an additional vacancy to fill Resolution 19-245 Approve a crossing agreement between Lewis County and the Skookumchuck Wind Energy Project LLC Josh Metcalf, Director of Public Works,spoke to the resolution He said overhead lines will cross county roads in two locations Motion passed 3-0. HEARING Resolution 19-246. Public hearing to ratify Ordinance 1306,which imposed a moratorium upon certain permits within the rural and resource lands of Lewis County and directing the setting of a public hearing. Commissioner Jackson introduced the hearing Chief Civil Deputy Prosecuting Attorney Eric Eisenberg gave the staff report Eric noted that the board already passed Ordinance 1306 Eric said • Lewis County allows resource uses on rural lands, such as stand alone and small businesses, accessories to farms and timber use • 10 months ago,the county approved a new rural use table • Lewis County Water Alliance the Planning Commission to re-examine the language, noting that the new verbiage would allow for large-scale water bottling plants in rural areas • Moratorium covers facilities for stand alone food and beverage manufacturing facilities as well as extraction of water for sale • Exceptions include o Using water extraction to aid in study of water for sale o A use, such as rock extraction, through which the water is then replaced Eric said Boistforst Valley Water had expressed concerns with Ordinance 1306 but that it ended up not being something that would require a change Eric noted that the six-month moratorium could be lifted before the six months are up 3 Commissioner Jackson asked if there were any questions Ron Averill of Centralia asked if the moratorium covers unincorporated areas within the entire county Eric said it does indeed cover the entire county Ron asked if extra provisions that were required under the Growth Management Act for the Cardinal Glass and Ritchie Brothers projects still exist Commissioner Jackson then closed the question-and answer portion of the hearing Eric Eisenberg asked that his previous comments be adopted into the record Commissioner Jackson asked if anyone wanted to speak for or against the resolution Ron Averill of Centralia said he supports the idea of the moratorium to give the county a chance to further explore the topic He discussed the county's watersheds and the need to study the impact Crystal Geyser could have Ron discussed the need to balance business growth He stressed the need to study potential impacts Craig Jasmer noted that Cardinal Glass does not have a water rights permit and therefore pays for its supply Commissioner Jackson closed the hearing Commissioner Stamper made a motion to approve Resolution 19-246 Commissioner Fund seconded. Motion passed 3-0.
