Erik Martin reviewed the right of way required for the North Fork realignment project. Josh Metcalf said
right of way is still being negotiated with the various landowners.
Tim Fife joined at 4:43 p.m.
Josh said eight properties may require eminent domain procedures. He said negotiation discussions
have been taking place since October. Josh said there are two properties for which the owners are going
through divorce proceedings. Josh said one property owner who owns three parcels has been
unresponsive. He said another property owner who owns two parcels also has been unresponsive. Josh
said the final property owner countered for several thousand more than the county’s offer for 1.2 acres
and that the property may have to be removed from its special property tax classification.
Josh suggested including all eight parcels on the agenda for the condemnation resolution.
The project has been in the works for six years, Tim said. The group said the county could be at risk at
having to repay what’s already been spent if the project doesn’t move forward.
Josh said changes in steel prices has increased the costs of many of the fence-replacement projects.
Martin said one-third of the owners, who own 30 percent to 40 percent of the properties, have
cooperated.
Commissioner Stamper, Commissioner Jackson and Commissioner Fund agreed to have the eminent
domain notice of hearing added to the Nov. 26 BOCC meeting.
