The proposed acquisition of additional right of way for Pleasant Valley Road Bridge Scour MP 2.46, Toledo
BEFORE THE BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON IN THE MATTER OF: RESOLUTION NO 19-394 THE PROPOSED ACQUISITION OF ADDITIONAL RIGHT OF WAY FOR PLEASANT VALLEY ROAD BRIDGE SCOUR MP 2 46, TOLEDO WHEREAS, it is necessary to do scour repair work on Pleasant Valley Road Bridge Milepost (MP) 2 46 at Stearns Creek, and WHEREAS, the scour repair project is necessary to protect the bridge and will benefit the public, and WHEREAS, the project will require additional road right of way from two adjacent property owners, and WHEREAS, RCW 8 08 010 authorizes counties to acquire property when deemed necessary by the Board of County Commissioners (BOCC), and WHEREAS, pursuant to the requirements of RCW 8 08, this resolution instructs the County Engineer to acquire right of way as shown on the attached Exhibit from two property owners along Pleasant Valley Road for the project. NOW THEREFORE BE IT RESOLVED that the BOCC hereby instructs the County Road Engineer to acquire all necessary right of way and authorizes the County Road Engineer to sign documents necessary for the scour repair project on Pleasant Valley Road in Section 32, Township 13 North, Range 2 West, W M , and NOW THEREFORE BE IT FURTHER RESOLVED that the BOCC directs that all such acquisitions be in accordance with adopted procedure as per Resolution 14-160 and under its eminent domain authority, as per RCW 8 25 and WAC 458-61A-206 (1c), and pursuant to authority and obligations of RCW Title 8, notably 8 08, 8.25 and 8 26 DONE IN OPEN SESSION this 30th day of December, 2019 APPROVED AS TO FORM BOARD OF COUNTY COMMISSIONERS Jonathan Meyer, Prosecuting Attorney LEWIS COUNTY, WASHINGTON Kevin McDowell Robert C.
