2017-03-08 Meeting to discuss permit requestMeeting to discuss permit request March 8, 2017 1:25 p.m. Present: Commissioner Fund, Glenn Carter, Danette York (by phone), Lee Napier (by phone), Commissioner Stamper (by phone) Recorder: Rieva Lester Commissioner Fund attempted to call Commissioner Stamper and Commissioner Jackson. Glenn Carter said the BOCC wouldn’t have the authority to change the requirements for permitting because that authority lies with the Hearing Examiner, and the Hearing Examiner already has issued its decision regarding Ralph Hubbert and Dan Rich’s project. Danette said she had spoken to Scott Polluck, who will be the one who gives the state approval. She said Scott said there are significant issues that need to be addressed and that he has not had a chance to review all of Balmelli’s emails. Glenn said the Hearing Examiner last month or so said the state approvals would be needed before the building permit could move forward. The group discussed the fact that Ralph and Dan did not bring a copy of the Hearing Examiner’s ruling. Danette left the meeting at 1:37 p.m. Lee Napier joined the meeting by phone at 1:46 p.m. Glenn gave Lee an overview of his earlier comments regarding the Hearing Examiner. Commissioner Stamper joined the meeting at 1:50 p.m. Glenn gave an overview of his earlier comments regarding the Hearing Examiner’s decision. He said Balmelli and Hubbert asked at the time of their hearing to allow the building permit to be issued without the state’s letter regarding water approval. He said the Hearing Examiner made a judgment NOT to allow that to take place. Glenn said the county has no hand in the Group A water system approval. That is wholly the state’s responsibility, he said. He reiterated that the county is not being obstructive. The county is merely required to wait for the proper steps to be taken. The group discussed contacting Ralph after reviewing the Hearing Examiner’s ruling. Lee said the review has been completed. It merely hinges on the state approval for the Group A water system. Meeting ended at 2:17 p.m.
