David Fine discussed indigent defense. He said the statute indicates certain funding will be made
available. He also discussed a statute that gives counties the right to sue to provide adequate funding.
Eric Eisenberg said most of the cases brought by the Prosecutor’s Office are brought in the name of the
state (ie. State of Washington vs. so-and-so). He said the same would not necessarily be true for
municipal courts.
Paulette Young joined by phone at 2:09 p.m.
David gave an overview of the history of the mandate. Jonathan Meyer said he and a group of others
created standards for an indigent defense program years ago. Eric Eisenberg discussed the benefits of
having WSAC weigh in.
Glenn Carter discussed the McCleary decision.
Jonathan said a group from Olympia toured the potential Family Support Move. He said it appears the
move would be fine. Jonathan said it’s possible they will hire an additional office assistant instead of
replacing the second attorney.
David discussed a contract with Butler Amusement. He said he is concerned about insurance coverage.
He said he would like language requiring inspection at the county fairgrounds. Paulette Young said the
rides are inspected annually in Thurston County before the rides arrive in Lewis County. David urged the
BOCC not to approve a contract unless it includes language requiring the inspections.
David said privatizing the fair or having a not-for-profit entity take the fair over would make it so the
county is not liable.
At 2:34 p.m., Commissioner Stamper announced that the Board was going into Executive Session under
RCW 42.30.110(1)(i) for 20 minutes to discuss pending litigation.
At 2:54 p.m., the Board extended Executive Session for 5 minutes.
Executive Session ended at 2:59 p.m.
