The necessary acquisition of additional right of way for Snyder Road, Packwood. BEFORE THE BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON IN THE MATTER OF: RESOLUTION NO. 20-063 THE NECESSARY ACQUISITION OF ADDITIONAL RIGHT OF WAY FOR SNYDER ROAD, PACKWOOD WHEREAS, on July 9, 2018, the Board of County Commissioners (BOCC) passed Resolution 18-220, instructing the County Road Engineer to acquire all necessary right of way for the Snyder Road culvert replacement project; and WHEREAS, RCW 8.08.010 empowers the County to condemn land for public use when deemed necessary for public purposes; and WHEREAS, negotiations have not been successful in acquiring right of way from owners of two properties; and WHEREAS, on January 27, 2020, the BOCC passed Resolution 20-027 instructing the Public Works Department to proceed with all necessary notifications and publications required by RCW 8.25.290; and WHEREAS, notice of planned final action has been given by publication once a week for two successive weeks; and WHEREAS, property owners of record have been sent notice of planned final action by certified mail. NOW THEREFORE BE IT RESOLVED that the Prosecuting Attorney is hereby directed to initiate condemnation proceedings to acquire and not to exceed said right of way described in attached Exhibit "A". Negotiations have not been successful in acquiring right of way from two property owners and will require condemnation. On January 27, 2020, the BOCC passed Resolution 20-027 instructing the Public Works Department to proceed with all necessary notifications and publications required by RCW 8.25.290. Since that date all notifications and publications required by law have been met. This resolution would direct the Prosecuting Attorney to initiate condemnation proceedings to acquire said right of way.
