Request for final plat approval of Ron Brown Estates, Centralia UGA
BEFORE THE BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON IN THE MATTER OF: RESOLUTION NO. 20-077 IN THE MATTER OF THE REQUEST FOR FINAL PLAT APPROVAL OF RON BROWN ESTATES, A SUBDIVISION LOCATED WITH THE CENTRALIA URBAN GROWTH AREA TOGETHER WITH THE EXTENSION OF PRILL ROAD AND DEDICATION OF COUNTY ROAD RIGHT OF WAY AND AUTHORIZATION FOR THE BOARD OF COUNTY COMMISSION CHAIR TO SIGN THE SAME ON BEHALF OF LEWIS COUNTY WHEREAS, the Ron Brown Estates, City of Centralia File No. SD2008-3, was granted preliminary plat approval by the Planning Commission on October 22, 2009 subject to ten conditions of approval; and WHEREAS, the final plat approval, which must be by the Lewis County Board of County Commissioners (BoCC), is in the nature of a ministerial, non-discretionary process; that is, if the submittal meets the terms of preliminary plat approval and conforms with state law and local codes, the final approval must be granted per RCW 58.17.170; and WHEREAS, the draft final plat map was submitted for review to the applicable city departments; and WHEREAS, the reviewing city departments found all preliminary approval items had been completed on the final plat map and requested the final plat map be submitted for signature and recording; and WHEREAS, with completion of all Preliminary Plat Conditions of Approval, the final plat map and supporting documentation are found to be consistent with RCW 58.17 and Centralia City Code, which were in effect at the time of preliminary plat approval; and WHEREAS, the signed final plat map was submitted on February 25, 2020 for final department signatures and consent agenda of the BoCC prior to recording; and WHEREAS, the final department signature was obtained and the final plat of the Ron Brown Estates was transmitted to the BoCC for board action under Centralia City Code 19.12; and WHEREAS, the final plat of the Ron Brown Estates includes an extension of Prill Road together with county road right of way dedication that was constructed to meet county road standards; and WHEREAS, the City Engineer reviewed road construction documents and thereby approved the civil plan asbuilts on September 19, 2019; and WHEREAS, the BoCC has reviewed the final plat map and incorporated this resolution as findings of fact and conclusions to support the decision to accept both the plat and the extension of Prill Road, along with additional county road right of way, as a county road. NOW THEREFORE BE IT RESOLVED that the BoCC of Lewis County, Washington, accepts the extension of Prill Road, along with additional county road right of way, as a county road that was constructed to meet county road standards as shown on the Ron Brown Estate Final Plat, City of Centralia File No. SD2008-3 ; and NOW THEREFORE BE IT FURTHER RESOLVED that the BoCC of Lewis County, Washington, approves the Ron Brown Estate Final Plat, City of Centralia File No. SD2008-3 and authorization for the BoCC Chair to sign the same on behalf of Lewis County. This is a straight-up subdivision-not a PUD- 219 that meets the old R-1 code. in today's standards he would have been required to do a PUD. 220 221 Trevor Westlund addressed the commission-7:43 p.m. 222 223 Trevor Westlund, developing Ron Brown Estates. The property is currently owned by Mr. Westlund and Tracy 224 Milsap. There are 17 building lots. They started with 20 initially. The new road is now an individual parcel, the 225 storm pond is designated. Currently this property is not in the 100 year flood plain.There was some water over 226 about 1/3 of the property in the past.Any finished floors will be two-feet above the 100 year flood plain.They will 227 not be bringing in fill, and will excavate a minimum amount. 228 229 Jared Stewart added to the record that he and Trevor Westlund are friends;he is also friends with a current 230 resident on Prill Road. 231 232 Rodney Thurman asked if he was considering building on the lots, or just selling the lots individually. Mr. Westlund 233 said that depending on the economy, he doesn't know whether they will build or sell anything. 234 235 Mr. Bower asked if dual access were required for emergency vehicles. Mr. Westlund said he had met with Rick 236 Mack, and with the cul-de-sac, it was apparently not an issue. Mr. Pierson added that it is a 60'right-of-way. Mr. 237 Westlund added that there is a fire hydrant at the end of Field Crest that would serve some of the lots. Fieldcrest 238 will be left as a dead end street. 239 240 Mr. Thurman asked about water and sanitary sewer.Applicant is extending water and sewer from Eshom Rd. 241 They are bringing sewer to the existing lot lines and repaving the street. The current residents will not be forced to 242 hook up to the sanitary sewer. They may consider a Limited Improvement District of help them offset the cost of 243 extending the water and sanitary sewer to the property-this would be addressed later. 244 245 Mr.Thurman asked about the requirement to hook up to sewer-Mr.Westlund had stated that he was bringing 246 sewer to the development-won't the owners of the proposed lots have to hook up?Mr. Westlund clarified his 247 remarks to say that lots inside the development would be required to hook up. He does not have the authority to 248 compel the current residents of Prill Rd. to connect to City Sewer-but the City may have the authority to do that. 249 The existing residents on Prill will be not be required to pay for the installation of the sewer lines or damage to the 250 street. The residents may choose to hook up and negotiate with him to help defray expenses. 251 252 Will there be fencing around the perimeter? Typically we always fence the storm area for safety. if he builds the 253 houses he provides fencing. There is a fence along the south boundary portion of it. They have discussed fencing 254 the entire south side. 255 256 Would the individual developers install the landscape and street trees,or would the applicant? it is his 257 understanding that he has to plant the landscape or provide a bond to ensure that the landscape and street trees 258 get planted. 259 260 7:56 -Chris Franklin has some questions about flooding. Several of the letters that came in from the surrounding 261 area were all concerned about the flooding. Mr. Westlund replied that during period of flood, there was some water 262 that flowed across the property-but the property is not listed on the FEMA 100 year flood plain. He acknowledges 263 that that situation may change in the future. 264 265 Rosie O'Connor-will emergency vehicles have room to drive around the cul-de-sac? Yes. The addition of 17 homes will provide 272 some additional traffic. If there were 278 trees that could potentially be retained and safe like say on lot#14, instead of clearing the entire lot, would he 279 consider saving some of the natural trees?Most of the trees remaining are the perimeter trees. There have been several floods along the way-he would have to disagree 291 with the applicant on the water level He never had any water on his property until the 1970's.The last four floods, 292 the water came within an inch of coming into the house.The heat ducts were filled and he lost the furnace. FEMA 293 came through and paid for the clean-up. The water that came through there came down Borst and there was a 294 river. thigh-deep, on Prill Rd.That a great ceal of flood came right down that road and right down the back side of 295 Mayberry. He is concerned that this development will force the water to be even deeper than it was last time and 296 he will have water in his house.The other concern is about the traffic-we're talking about 34 more cars coming in 297 and out of there. That road is not that wide It is a very peaceful place now.
