2020-05-11 Business Meeting Minutes LEWIS COUNTY BOARD OF COUNTY COMMISSIONERS(BOCC) Business Meeting minutes May 11,2020 Present: Commissioner Stamper(remotely), Commissioner Fund (remotely),Commissioner Jackson Recorder: Rieva Lester Commissioner Jackson called the meeting to order at 3:01 p.m., determined a quorum and then proceeded with the flag salute. PUBLIC COMMENT Commissioner Jackson said Phyllis Wakefield wanted it on record that she supports Lewis County moving to Phase II as she feels it is time to move forward and support Lewis County. Commissioner Jackson read a proclamation recognizing May 10-16, 2020,as Law Enforcement Recognition Week. Chief Chris Sweet thanked the county for its support. Chief Bruce Kimsey,who serves as patrol commander, echoed Chief Sweet's appreciation for the support. Commissioner Jackson read a proclamation recognizing May 2020 as Drug Court Month. Drug Court Manager Stephanie Miller thanked the commissioners for their support.She introduced some of the individuals attending the meeting remotely. Judge Andrew Toynbee thanked the county and those involved in the Drug Court process. Commissioner Fund made a motion to add to the day's agenda the following two items: Resolution 20- 153,to list the bid(s) received and contractor selected for the 2020 Countywide Base Stabilization Project, and Resolution 20-156, a hearing to consider authorizing and accepting the Lewis County Water- Sewer District#5 Transfer Agreement. Commissioner Stamper seconded. Motion passed 3-0. NOTICE ITEM Commissioner Stamper made a motion to approve Resolution 20-150. Commissioner Fund seconded. 1 Resolution 20-150: Call for bids for the King Road Culvert Replacement Project, CMP 1509. Bids are due to the Clerk of the Board by 11 a.m.June 2, 2020. Public Works Director Josh Metcalf spoke to the resolution. He said late bids will not be accepted. Motion passed 3-0. CONSENT ITEMS Commissioner Fund made a motion to approve minutes from the May 4, 2020, meeting as well as Resolution 20-151. Commissioner Stamper seconded. Resolution 20-151:Approval of warrants/claims against the various county departments. Chief accountant Suzette Smith, representing the Auditor's Office, said warrants 828,380 through 828,492 and direct disbursements 1967, 1976, 1977, 2005, 2044, 2058 through 2061, 2063, 2064, 2066, 2067, 2069, 2071 through 2074, 2079, 2081 through 2083, 2085 through 2089 and 2110 were issued in May for payments against the county totaling$220,461.16.She noted a skip in sequence for warrants 828,371 through 828,379, which were issued on behalf of Special Purpose Districts. Motion passed 3-0. DELIBERATION ITEMS Commissioner Stamper made a motion to approve Resolutions 20-152 through 20-155. Commissioner Fund seconded. Resolution 20-152:Approve a Task Assignment pursuant to Interlocal Agreement No.05-200 between Lewis County and Tacoma Power regarding work by county crews and authorizing signatures thereon. Public Works Director Josh Metcalf spoke to the resolution. He said county crews will perform chipseal work for Tacoma Power over the summer. He said the agreement is for$37,990. Resolution 20-153: List the bids received and contractor selected for the 2020 Countywide Base Stabilization Project, CRP 2189A. Public Works Director Josh Metcalf spoke to the resolution. He said the county received two bids for the project. He said Ground Up Construction provided the lowest responsive bid at$70,300.23. He said the engineer's estimate was $84,580.21. 2 Resolution 20-154:Support a basin-wide solution to flooding and aquatic species restoration. County Manager Erik Martin spoke to the resolution. He said the commissioners support the integrated processes of the Chehalis River Basin Flood Authority,Office of Chehalis Basin,Chehalis Basin Board, Chehalis Basin Flood Control Zone District,and Chehalis Basin Strategy as the best way to deliver the most beneficial combination of flood protection and aquatic species enhancement that all Basin citizens, tribal partners,stakeholders, and "flood"and "fish" interests deserve.Commissioner Fund and Commissioner Stamper echoed the support. Resolution 20-155:Extend the local declaration of a state of emergency in response to the COVID-19 virus in Lewis County. Public Works Director Josh Metcalf spoke to the resolution. He said the resolution extends the declaration through May 31. Motion passed 3-0. HEARING Resolution 20-156:Proposed acceptance of the Lewis County Water-Sewer District#5 Transfer Agreement in accordance with RCW 36.94.330. Commissioner Jackson introduced the hearing. Lewis County Public Works Director Josh Metcalf and Deputy Prosecuting Attorney Amber Smith gave the staff report. Josh Metcalf said Lewis County has been working with Water-Sewer District 5 to transfer the district's assets to Lewis County, allowing Lewis County to take over ownership and operation of the Water-Sewer District 5. Amber said the county has agreed to pay$350,000 for the takeover. However,she said, the district doesn't own the buildings where the fixtures are housed.She said the$350,000 would cover everything, including the property the district doesn't own—meaning the payments to the private owner, Susan Dietri,would come out of that$350,000 total. Amber asked that if the commissioners approve of the transfer, that they also designate Erik Martin as the signatory. Commissioner Jackson asked if there were any questions. Commissioner Stamper asked if approval of the transfer agreement would lead to the lifting of a moratorium in the area.Amber said it's a possibility.She said the transfer agreement possibly could go before a judge as early as June 15 and that negotiations with WSD2 could begin as they await the court date. 3 Commissioner Jackson then closed the question-and-answer portion of the hearing. Amber said it would be beneficial to have the amounts set in stone but that delaying the transfer would be less than ideal because Water-Sewer District 5 is insolvent. Lewis County Treasurer Arny Davis said the general fund has loaned$25,000 to help prevent WSD5's insolvency. He asked if the transfer would make WSD5 a unit within Public Works. County Manager Erik Martin affirmed that it would.Arny asked if the repayment of the general fund loan would come out of the$350,000 being approved for the transfer. Erik Martin affirmed that it would. Amber and Josh asked that their previous comments be adopted into the record. Commissioner Jackson asked if anyone wanted to speak for or against the resolution. Larry McGee thanked the commissioners for their efforts. Greg Lund thanked the commissioners for their efforts. Commissioner Jackson closed the hearing. Commissioner Fund made a motion to approve Resolution 20-156. Commissioner Stamper seconded. Motion passed 3-0. The commissioners authorized Erik Martin to be the signatory for all of the related documents. The commissioners discussed their calendars.Commissioner Fund reminded the group that she would be attending the WSAC update later in the day. COVID-19 County Manager Erik Martin said Lewis County remains at 30 confirmed COVID-19 cases,with three fatalities. He said 16 patients have fully recovered. Josh Metcalf said the county has filled all tier 1-3 orders. Erik said the Board of Health will discuss the proposed variance application on May 14. Commissioner Stamper asked if the Board of Health would be able to approve the variance application on that date. He also asked if the county can provide zip codes for patients. Erik said the plan is for the BOH to approve the variance application on May 14. JP Anderson discussed the creation of a "heat map"to give an idea of where there are cases. He said identifying zip codes could pose the risk of identifying patients. Commissioner Fund said constituents want to know where the individuals are located to know if the disease is running rampant and whether it's safe to visit certain areas. 4 Amber Smith said release of information is governed by HIPPA and Washington's version of HIPPA. JP Anderson and Commissioner Fund discussed counties that have been approved for the variance but that at least one went back to Phase I because it had a new case. ANNOUNCEMENTS Commissioner Fund discussed the release of the so-called "snitch list,"which was made public the previous week.She said the list includes information about the business purportedly operating when it shouldn't as well as information about who lodged the complaint. PRESS CONFERENCE No questions from the press. Commissioner Stamper said he was contacted by an individual who indicated the Thousand Trails has asked 100 or so"residential" campers to leave.
