BEFORE THE BOARD OF COUNTY COMMISSIONERS
LEWIS COUNTY, WASHINGTON
IN THE MATTER OF: RESOLUTION NO. 20-264
APPROVE AN ADDENDUM TO .09 (DISTRESSED
COUNTIES) FUNDING AWARDED TO WINLOCK
UNDER RESOLUTIONS 19-099 AND 11-254
WHEREAS, Lewis County awarded Winlock .09 ("Distressed Counties") funds for two
public facilities: a water main under Resolution 19-099, which was passed by the Board
of County Commissioners (BOCC) on April 8, 2019, and a sewer line under Resolution
11-254, which was passed by the BOCC on Aug. 8, 2011; and
WHEREAS, both projects were to serve the Winlock Industrial Park for economic
development purposes; and
WHEREAS, both projects are listed on the Comprehensive Economic Development
Strategy (CEDS), which is a list of projects maintained by the Lewis County Economic
Development Council (EDC) as per RCW 82.14.370; and
WHEREAS, Winlock wishes to use the remaining, unused funds from the water grant
totaling $12,738.45 to fund the sewer grant, which has greater present need; and
WHEREAS, the BOCC may approve reducing the water grant by the unused amount of
$12,738.45 and increasing the sewer grant by the same amount, leaving all other
terms and conditions of the grants the same.
NOW THEREFORE BE IT RESOLVED BOCC approves reducing the water grant
(Resolution 19-099) by the unused amount of $12,738.45 and increasing the sewer
grant (Resolution 11-254) by the same amount, leaving all other terms and conditions
of the grants the same; and
NOW THEREFORE BE IT FURTHER RESOLVED the Chair of the BOCC is authorized to
sign an addendum to both agreements on behalf of Lewis County indicating that the
water grant agreement (Resolution 19-099) will be reduced by the unused amount of
$12,738.45 and the sewer grant agreement (Resolution 11-254) will be increased by
the same amount, leaving all other terms and conditions of the grants the same.

ADDENDUM TO
TWO GRANT AGREEMENTS
BETWEEN LEWIS COUNTY AND
THE CITY OF WINLOCK
This Addendum amends two Grant Agreements made and entered into by Lewis County (County)
and the City of Winlock (City) as to the conditions for acceptance of monies by the City from the
"Distressed Counties Fund" pursuant to RCW 82.14.3 70.
I. PURPOSE
RCW 82.14.370 authorizes a sales and use tax to finance public facilities serving economic
development purposes in rural counties. Funds from this tax are called ".09 Funds." The City
previously received two relevant .09-Fund grants; money remains in one of the grants, which the
City would like to use for the qualifying project in the other grant. The purpose of this addendum
to the two prior grant agreements is to shift the available, unused funds from one grant to the
other, otherwise leaving all of the terms and conditions of the grants the same.
II. AGREED FACTS
The parties adopt the following agreed statement of facts. The County awarded the City .09
funds for two public facilities: a water main under Resolution 19-099, which was passed by the
Board of County Commissioners (BOCC) on April 8, 2019, and a sewer line under Resolution 11-
254, which was passed by the BOCC on Aug. 8, 2011. Both projects serve the Winlock Industrial
Park for economic development purposes. Both projects are listed on the Comprehensive
Economic Development Strategy (CEDS), which is a list of projects maintained by the Lewis
County Economic Development Council (EDC) as per RCW 82.14.370. The City wishes to use the
remaining, unused funds from the water grant totaling $12,738.45 to fund the sewer grant.
III. MODIFICATION TO PRIOR GRANT AGREEMENTS
Each party agrees that the unused,available funds of$12,738.45 from the water grant agreement
(Res. 19-099) are reduced from the total amount of available funds in that contract.
Correspondingly, the available fund amount for the sewer grant (Res. 11-254) is increased by
$12,738.45. All other terms and conditions of both grants remain the same.
Signatures appear on the following page. This addendum may be signed in duplicate
counterparts by authorized representatives of the City and County.
