IN THE MATTER OF: RESOLUTION NO. 21-051
ACCEPTING A BID ON TAX TITLE PROPERTY
LOCATED OFF NORTH 4TH STREET, TOLEDO
WHEREAS, the following described tax title property was conveyed to Lewis
County by the County Treasurer in 1936 following an unsuccessful attempt to sell
the property at public auction:
Parcel No. 007043000000, approximately 0.10 acre described as:
All of Block 18, Kellogg's Second Addition to the Town of Toledo, as recorded in
volume 2 of Plats, page 24, records of Lewis County, Washington.
Together with that portion of Hemlock Street vacated by City of Toledo Ordinance
No. 176, recorded under Auditor's File No. 410034 which attaches by operation of
law; and
WHEREAS, the County has received an offer to purchase the property for
$2,750.00, which is the amount of cost incurred by the Treasurer and the Public
Works Department to dispose of the property. Since the property is impractical to
build on due to shape, size and lack of access, RCW 36.35.150 allows for the
property to be disposed of by private negotiations, providing that the final sale
price is no less than the principal amount of unpaid taxes. However, due to the
length of time the County has owned the property, unpaid tax history is unknown.

NOW THEREFORE BE IT RESOLVED that the aforesaid offer in the amount of
$2,750.00 for property located off North 4th Street in Toledo, Wash., is accepted,
subject to the conditions of LCC 3.30.400. Also, that notice of the Board of County
Commissioners' intent to sell the property be given to the public as required by
LCC 3.30.400. The Public Works Department is hereby directed to proceed with
legal notification of the property for sale to the general public for the highest and
best offer, and it be stipulated that Lewis County reserves the right to reject any
and all offers if no offer is received that is determined to be the higher and better
offer.
Purchaser shall have five days from the date of award to pay for the property in
cash or by cashier's check. Upon payment to the County Treasurer in the
Courthouse, Chehalis, Washington, a Treasurer's Deed will be issued for the
property. The Treasurer's Office will record the deed in the Official Volumes of the
Lewis County Auditor. After recording, the original deed will be sent to the
purchaser.
Proceeds of the sale shall be distributed as follows: Treasurer ($250.00) and Public
Works Department ($2,500.00).
The County reserves the right to reject any and all offers.

NOTICE
NOTICE IS HEREBY GIVEN that the Board of County Commissioners (BOCC), Lewis County,
Washington, intends to sell tax parcel 007043 000 000, consisting of 0.10 acre of land located
off North 4'h Street, Toledo. The below described property was conveyed to Lewis County by the
County Treasurer in 1936 following an unsuccessful attempt to sell the property at public
auction. The County has received an offer to purchase the property for $2,750.00, the amount of
cost incurred by the Treasurer and the Public Works Department to dispose of the property.
RCW 36.35.150 allows for the disposal of the property by private negotiations providing that the
final sale price is no less than the principal amount of the unpaid taxes. However, due to the
length of time the County has owned the property, unpaid tax history is unknown. Notice of the
BOCC's intent to sell the property is hereby given to the public as required by LCC 3.30.400,
thereby providing an opportunity to compete for purchase by offer of more favorable price

of cost incurred by the Treasurer and the Public Works Department to dispose of the property. This
resolution would accept the offer subject to conditions of LCC 3.30.400 which requires that the
public be given two weeks notice by advertisement and an opportunity to compete for purchase by
offer of more favorable price on the terms negotiated.
