Bradley-Nobles' letter for this project, dated November 3, 2009, • was reviewed by PTI. In addition, PTI observed site conditions on February 1, 2019. Based on our site visit, it is apparent that the property has remained undisturbed since the original geotechnical assessment was completed except for minor changes in the City right-of-way. In addition, PTI did not observe new geological hazards, or other hazards as presented in the original assessment. In conclusion, it is our opinion that the original geotechnical assessment by Bradley- Noble is valid, additional conditions other than what are presented in their assessment are not required, and it appears that additional code changes with respect to geological hazards are not applicable to the development of this project. Mr. Fox asked me approximately one year ago for an easement concerning the above; I said "NO"; because I have been seeking a permit to develop our contiguous family property for over three years. Find the attached legal documents for our five acres; more or less. I have invested over$150,000.00 for engineering to bring in an 8 inch City water line, a 12 inch sewer line, electric, a new fire hydrant, repaired driveways on Spring Street and installed 150 feet of three inch compact blacktop on Spring street contiguous to our property. I do not feel it is fair to me and my family to grant a permit to my neighbor prior to receiving a permit to develop our property. It has not cost the applicant and neighbor's any money for the above said improvements to the end of Spring Street. I have been in business for over fifty years; building and selling Real Estate. I engineered the development of 100 acres {more or less} owned by the Alexander and Whitney families;known as Whitney View Ranch Estates. I built and sold several new homes in that development. See the Attached Exhibit. I recently completed upper-level non-smoking senior apartments in downtown Centralia with off street parking. In closing: I have just had a new Geotechnical report completed as requested by the City Planning department. The excellent report is approximately 50 pages. The property is approximately 13.89 acres. Applicant submitted a conditional use 10 application to construct a 30'x40' shop containing a 600-square-foot accessory dwelling unit on the 11 parcel. 12 The property is currently zoned R-UGA(Urban Growth Area Residential),subject to Chehalis 13 Municipal Code 17.79. The 19 same notice was mailed to property owners within 300 feet of the site and emailed to appropriate 20 21 agencies on May 9,2019. The Notice of Public Hearing was posted on the property on May 10,2019. 22 PUBLIC HEARING 23 The public hearing commenced at 6:00 pm on May 21, 2019, in the main City Council 24 Meeting Room of City Hall.The City of Chehalis Staff appeared through Hillary Hoke,Planning and 25 Building Department Manager. The Applicant, Virgil Fox, was present. A verbatim recording was 26 27 made of the public hearing and all testimony was taken under oath. 28 FINDINGS OF FACT,CONCLUSIONS CITY OF CHEHALIS HEARING EXAMINER OF LAW,AND DECISION APPROVING 345 N.W.Pacific Avenue/P.O.Box 867 CONDITIONAL USE-2 CHEHALIS,WASHINGTON 98532 PHONE:(360)748-9281/FAX(360)748-3184 1 In advance of the hearing, Ms. Hoke provided a staff report providing an overview of the 2 application along with staff recommendations. The staff report also attached Exhibits A through B. 3 Ms. Hoke provided an overview of the Staff Report and the recommendations contained therein. The 4 5 Staff Report,together with its exhibits,was admitted into evidence on the record. 6 I. Testimony Provided by City of Chehalis. 7 Ms. Hoke's testimony summarized the application and proposed project, the City's Staff 8 Report,the comments received from the public, and the input received from public agencies. 9 A. Recommendations of the City of Chehalis 10 11 City staff recommends approval of the conditional use application subject to a number of 12 conditions. 13 1. Work may not commence until such time as all required permits and approvals have been 14 obtained, including fire protection, if necessary. 15 2. Final approval and/or occupancy shall not be approved until all required right-of-way and 16 17 utility repair work is complete and approved by Lewis County Public Works. 18 3. A conditional use permit approved by the examiner and issued by the administrator shall 19 expire 90 days from the date of issuance if no substantial activity has occurred to 20 implement the approved proposal. 21 II. Testimony Provided by Applicant 22 The Applicant provided an overview of the proposed project. 23 24 III. Testimony Provided by Community Members 25 Charles Allen, mailing address P.O. Box 452, Chehalis, and residential address, 239 26 Alderwood, Chehalis, Washington, was concerned about the aesthetics of the project and a potential 27 for commercial use because the property is not subject to covenants for Alderwood Heights. City 28 FINDINGS OF FACT,CONCLUSIONS CITY OF CHEHALIS HEARING EXAMINER OF LAW,AND DECISION APPROVING 345N.W.Pacific Avenue/P.O.Box 867 CONDITIONAL USE-3 CHEHALIS,WASHINGTON 98532 PHONE.(360)748-9281/FAX.(360)748-3184 1 staff clarified that an accessory dwelling unit may be used only byfamily members or caretakers and 2 .; cannot be rented out. This is a covenant that affects the property it perpetuity that must be followed 3 by future owners. 4 5 Dr. Gregory Kirsch, mailing address 220 Alderwood, Chehalis, Washington, was concerned 6 about aesthetics and does not want interruption of the view from his home. He also was concerned 7 about utilities, particularly the impact on water within Alderwood Heights. Mr. Fox explained that 8 his water connection is through a line located along Spring Street that is separate from the line that 9 services the Alderwood Heights subdivision. He also explained that he has a gate at the access to his 10 11 property, the driveway has been paved with asphalt and that his intention is to build a home that 12 aesthetically will be of high quality. 13 Frank Dipola of 201 S. Tower, Centralia, Washington, objected to use of water and sewer 14 lines installed along Spring Street at his expense to provide services to the proposed development. 15 Mr. Fox responded that he made use of utility services available to the property in the manner 16 17 satisfactory to the City of Chehalis and that there was not a latecomer's agreement in place that would 18 allow for reimbursement to Mr.Dipola for any of his costs of installing utility services. 19 ANALYSIS 20 Conditional use applications are governed by Section 17.09.115 of the Chehalis Municipal 21 Code. Section 17.09.115 provides authority to the Hearings Examiner to grant a conditional use 22 permit when: 23 24 1. The use proposed in the application is not listed on the zoning use chart, CMC 17.78.020, or any special or environmental district use criteria(Divisions III and IV of this title)as a 25 prohibited use in the zone or district in which the proposed use would be located; and 26 2. The procedures set forth in CMC 17.09.130,notice,have been followed; and 27 3. The proposed use is not prohibited. 8 Granting of a conditional use permit will not allow the applicant a use that is not listed on the 9 zoning use chart or any special or environmental district use criteria as a prohibited use in the zone 10 or district in which the proposed use would be located. 11 12 2. Procedures. 13 The procedures set forth in CMC 17.09.130 have been followed. 14 3. The proposed use is compatible. 15 Ms. Hoke's testimony indicated that the proposed conditional use is consistent with the 16 comprehensive plan. The zoning for this property allows for an accessory dwelling unit as part of 17 18 residential development. The application meets the requirement of Chehalis Municipal Code 17.09.115(A)1-4. 20 Based on the evidence and testimony submitted by the City and the Applicant, the proposed 21 conditional use is not listed as prohibited,the procedures for notice have been followed,the proposed 22 use is consistent with the provisions of CMC Title 17 and the comprehensive plan and the proposed 23 24 use is compatible with the surrounding land uses and the general character of the district. 25 Based upon the foregoing Findings of Fact, the Hearing Examiner makes the following: 26 CONCLUSIONS OF LAW 27 1.
