2021-07-06 PA UpdatePA Update July 6, 2021 3:01 p.m. Present: Commissioner Stamper, Commissioner Pollock, Commissioner Swope, County Manager Erik Martin, Eric Eisenberg, Andrew Logerwell, Kevin McDowell, Becky Butler, Chris Panush, Natalie Dunlap Guests: Nic Scott, Bill Serrahn, an online participant identified as “Public” Recorder: Rieva Lester Eric Eisenberg discussed the commissioners’ proposed “Citizens’ Rights” proclamation. He said neither version of the proclamation would be legally problematic and that the PA’s Office had suggested changes that were merely stylistic. Eric said Jonathan Meyer is reviewing staffing to potentially create a position that works on diversion, data processing and bench probations. Eric said Jonathan has approved using Kent Caputo as outside counsel regarding TransAlta. Andrew Logerwell said the county was served with a lawsuit July 2. He said the Attorney General’s Office has indicated it will provide indemnification and defense for the Lewis County judge and the two PA staff members named in the lawsuit. Eric discussed a .09 contract with the EDC regarding Vader. He suggested providing funding to the EDC to update Vader’s urban design standards, rather than provide funding to Vader directly. He suggested including language in the agreement that the EDC would have to have an agreement with Vader in place. At 3:16 p.m., Commissioner Stamper announced that the Board was going into Executive Session under RCW 42.30.110(1)(i) for 10 minutes to discuss the following: • Hardell Mutual Plywood v. Lewis County et al. • Opioid litigation. • Insurance coverage re: pollution. • Northern spotted owl. Executive session started at 3:18 p.m. At 3:28 p.m., the Board extended Executive Session for 5 minutes. At 3:33 p.m., the Board extended Executive Session for 2 minutes. Executive Session ended at 3:35 p.m. Commissioner Stamper noted that no decisions had been made. Meeting adjourned at 3:36 p.m.
