September 14, 2021

Commissioner Pollock called the meeting to order at 10:01 a.m., determined a quorum and then
proceeded with the flag salute.
PUBLIC COMMENT
Mitchell Merrill asked that the commissioners to rescind its Pride Month proclamation, indicating that
he feels it goes against section 12 of the state Constitution.
Commissioner Pollock said she would reach out the Prosecuting Attorney's Office to ensure the county
has not run afoul of the state Constitution.
Mark Merrill echoed Mitchell Merrill's request to have the county rescind its Pride Month proclamation.
Bob Guenther discussed the Department of Ecology's permit for biosolids applications in Lewis County.
He praised Lewis County's efforts to provide oversight of a Burnt Ridge site on which all of Vader's
biosolids sludge recently was applied. Bob also discussed the removal of biosolids materials from area
lagoons.
PRESENTATION
Commissioner Swope made a motion to approve a proclamation recognizing September as National
Preparedness Month in Lewis County. Commissioner Pollock seconded.
Emergency Management Planner Erika Katt read the proclamation into the record.
Motion passed 2-0.
NOTICE ITEMS
Commissioner Swope made a motion to approve Resolutions 21-333 and 21-334. Commissioner
Pollock seconded.

Resolution 21-333:Call for Bids for the Community Development Tenant Improvement Project,
Project#31-2102. Bids are due to the Clerk of the Board by 2 p.m. Oct. 13, 2021.
Capital Projects Manager Doug Carey discussed the resolution. Doug said the project will renovate a
building on campus to house Community Development and Environmental Health.
Resolution 21-334:Approve a call for bids for one or more 10/12 yard dump trucks for the Public
Works Road Maintenance Division. Bids are due to the Clerk of the Board by 12:30 p.m. Oct. 5,2021.
Fleet Services Manager Tim Murphy discussed the resolution.Tim said Fleet is looking to purchase two
dump trucks.Tim said Fleet has two aging trucks with more than 16,000 use-hours.Tim said FEMA
funding will be used for the purchase.
Motion passed 2-0.
CONSENT ITEMS
Commissioner Swope made a motion to approve minutes from the August 27 and 31,2021, Business
Meetings as well as Resolution 21-335. Commissioner Pollock seconded.
Resolution 21-335:Approval of warrants/claims against the various county departments.
Chief accountant Grace Jimenez, representing the Auditor's Office, said warrants numbered 845,885
through 845,892, 845,926 through 846,065 and 846,086 through 846,350, as well as direct
disbursements 3864 through 3866, 3698, 3705, 3749, 3766, 3771, 3782 through 3793, 3785, 3802, 3803,
3833, 3835, 3840 through 3843, 3845, 3846, 3853, 3860, 3861, 3867, and 3870 through 3873 were
issued in August and September for payments against the county totaling$5,237,322.46. Grace noted a
skip in sequence for warrants 845,893 through 845,925 and 846,066 through 846,085,which were
issued on behalf of Special Purpose Districts.
Motion passed 2-0.
DELIBERATION ITEMS
Commissioner Swope made a motion to approve Resolutions 21-336 through 21-344. Commissioner
Pollock seconded.
Resolution 21-336:Approve an interlocal agreement for use of Juvenile facilities between Lewis
County Juvenile Court and Cowlitz County Juvenile Court.

Juvenile Court Administrator Shad Hail discussed the resolution. He said the agreement will allow
Cowlitz County to house Lewis County's juvenile inmates beginning Oct. 1 as the county remodels its
Lewis County site.The commissioners praised Shad and his team for their efforts.
Resolution 21-337: Establish the rate of pay for a non-union extra help Civil Service secretary.
HR Director Chris Panush discussed the resolution. He said the rate of pay would be $20 per hour.
Resolution 21-338:Approve Amendment C between Lewis County and Bird's Eye to correct a
scrivener's error and add services.
Public Health and Social Services Director JP Anderson discussed the resolution. He said the
amendment corrects a scrivener's error and adds services for a strike team.
Resolution 21-339:Accept an agreement between Lewis County and Washington State Military
Department for the Department of Homeland Security(DHS)- Federal Emergency Management
Agency(FEMA) Pre-Disaster Mitigation Grant and authorizing signature thereon.
Emergency Management Planner Erika Katt discussed the resolution. Erika said the agreement provides
funding for pre-disaster mitigation planning. She said the money will be used to update the multi-
jurisdiction Hazard Mitigation Plan.
Resolution 21-340:Approve a memorandum of understanding between Lewis County Division of
Emergency Management and Twin Transit.
Emergency Management Planner Erika Katt discussed the resolution. Erika said the agreement will
allow Twin Transit to assist with transportation resources and activities.
Resolution 21-341:Approve an amended road use permit to Lewis County from ORM Timber
Operating Company IL, LLC for access to a radio repeater site on Hopkins Hill and authorize signatures
thereon.
Real Estate Services Manager Martin Roy discussed the resolution. Martin said the county wants to
extend and amend a road use agreement. He said the county will extend the agreement for five years,
through 2026, so the county can access a radio repeater site.
Resolution 21-342:Approving a contract increase of more than$200,000 for a Public Works project.
County Engineer Tim Fife discussed the resolution. He said an existing project scope is being amended
to include an additional 1.5 miles of paving.

Resolution 21-343:The proposed establishment of a new county road off Baker Drive, Mossyrock.
Real Estate Services Manager Martin Roy discussed the resolution. Martin said there was a subdivision
that required access. He said the developer has agreed to pay all costs associated with the road if the
county acquires the needed right of way.
Resolution 21-344:Approve County Road Easement No. 50-092552 between Lewis County and DNR
and authorizing signatures thereon.
Real Estate Services Manager Martin Roy discussed the resolution. Martin said the resolution begins
the needed process to acquire the right of way for the road discussed in Resolution 21-343.
Motion passed 2-0.

Resolution 21-330:Approve a franchise to Middle Fork Water&Sewer to install,construct,operate
and maintain water and sewer facilities in Lewis County road rights of way. (Continuation of Aug. 31,
2021, hearing.)
Commissioner Pollock introduced the hearing.
Real Estate Services Manager Martin Roy gave the staff report. Martin said the resolution would create a
non-exclusive franchise for the Middle Fork Water&Sewer, which serves the Birchfield area,to use
county rights of way.
Commissioner Pollock asked if there were any questions.There were no questions.
Commissioner Pollock then closed the question-and-answer portion of the hearing.
Martin asked that his previous comments be adopted into the record.
Commissioner Pollock asked if anyone wanted to speak for or against the resolution.

and maintain water facilities in Lewis County road rights of way. (Continuation of Aug. 31,2021,
hearing.)
Commissioner Pollock introduced the hearing.
Real Estate Services Manager Martin Roy gave the staff report. Martin said the resolution would create a
new non-exclusive franchise for the Vader Water system,which serves the Enchanted Valley and
portions of Vader,to use county rights of way.
Commissioner Pollock asked if there were any questions.There were none.

Ordinance 1327: Public hearing to consider Ordinance 1327 and to amend Lewis County Code 17.38,
Critical Areas.
Commissioner Pollock introduced the hearing.
Community Development Director Lee Napier gave the staff report. She said the ordinance provides
minor changes to Sections 17.38.020 and 17.38.930 of Lewis County Code to clarify administrative
procedures.
Lee noted a scrivener's error on Section 4 of the ordinance. She said the document inadvertently had
both "five" and "six" as strikethroughs.She said only"five" should have been listed as a strikethrough.
Commissioner Pollock asked if there were any questions.
Bob Guenther asked if staff knows that the Big Hanaford and Newaukum dump sites are in wetlands.
Lee noted that the ordinance covers new development not listed under prior codes.

Ordinance 1328: Public hearing to consider Ordinance 1328 and to amend Lewis County Code
15.35.150,Shoreline Permits or Exemptions.
Commissioner Pollock introduced the hearing.
Community Development Director Lee Napier gave the staff report. She said the ordinance corrects a
clerical error by replacing language in the county code.
Commissioner Pollock asked if there were any questions.There were no questions.

COVID-19
JP Anderson said the county continues to see a high rate of COVID-19 transmission. He noted that the
number of cases is putting a strain on area providers as well as area schools.

PRESS CONFERENCE
Claudia Yaw asked for information regarding a contingency plan in the event two or more
commissioners are incapacitated. Commissioner Pollock noted that no one from the Prosecuting
Attorney's Office was available to discuss the question.
