BEFORE THE BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON IN THE MATTER OF: RESOLUTION NO. 21-409 THE PROPOSED ACQUISITION OF ADDITIONAL RIGHT OF WAY FOR SHOREY ROAD, CHEHALIS WHEREAS, it was necessary to do bank stabilization work on Shorey Road at Mile Post (MP) 0.598; and WHEREAS, the bank stabilization project was necessary to protect the county road and benefits the public; and WHEREAS, the Board of County Commissioners (BOCC) on August 10, 2021, signed Resolution 21-297 declaring a state of emergency to include the bank stabilization project on Shorey Road; and WHEREAS, the project required additional right of way from one adjacent property owner; and WHEREAS, Public Works used an emergency permit and right of entry to complete the project with the stipulation that the needed property rights be acquired within 12 months after the execution of said emergency permit; and WHEREAS, RCW 8.08.010 authorizes counties to acquire property when deemed necessary by the BOCC; and WHEREAS, pursuant to the requirements of RCW 8.08, this resolution instructs the County Engineer to acquire right of way as shown on the attached exhibit from one property owner along Shorey Road for the project. NOW THEREFORE BE IT RESOLVED that the County Road Engineer is instructed to acquire all necessary right of way and is authorized to sign documents necessary for the bank stabilization project on Shorey Road in Section 31, Township 14 North, Range 2 West and Section 6, Township 13 North, Range 2 West , W.M. XX-XXX THE PROPOSED VACATION OF PORTIONS OF 1ST AND PINE STREETS AND ADJACENT ALLEYS IN DRYAD WHEREAS, RCW 36.87 authorizes the Board of County Commissioners (BOCC) to vacate useless county roads or portions thereof; and WHEREAS, the BOCC has received information indicating that the portions of 1st and Pine Streets and adjacent alleys may be useless as a part of the county road system and that the public may be benefited by its vacation, and the BOCC intends to proceed to determine whether the road should be vacated and abandoned; and WHEREAS, when considering vacation of a county road, the BOCC may by resolution declare its intention to vacate the road and direct the County Road Engineer to report on such vacation. NOW THEREFORE BE IT RESOLVED that the County Road Engineer is instructed to examine all that part of the following described portions of 1st and Pine Streets and adjacent alleys as required by RCW 36.87.010 and LCC 12.15 and report his recommendations to the BOCC: All of 1st and Pine Streets and adjacent alleys lying within Blocks 5,6,7and 8 of the Plat of Dyrad in Section 1, Township 13 North, Range 5 West, W.M. Due to a series of high water events occurring during winter 2020/2021 it was necessary to do bank stabilization work along Shorey Road, at MP 0.598. The Board of County Commissioners on August 10, 2021 signed Resolution 21-297 declaring a state of emergency to include the bank stabilization project of Shorey Road. Following the declaration Public Works used an emergency permit and right of entry to complete the project. The permit allows completion of the project without fully acquiring property rights with the stipulation that the needed rights be acquired within 12 months after the execution of said emergency permit. The project required additional road right of way from one property owner. RCW Chapter 8 authorizes Counties to acquire property when deemed necessary by the Board of County Commissioners. All such acquisitions shall be in accordance with adopted procedures as per Resolution 20-149.
