The proposed vacation of a portion of 1st and Pine Streets and adjacent alleys in Dryad.
BEFORE THE BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON IN THE MATTER OF: RESOLUTION NO. 21-433 THE PROPOSED VACATION OF A PORTION OF 1ST AND PINE STREETS AND ADJACENT ALLEYS IN DRYAD WHEREAS, RCW 36.87 allows for the vacation of a county road that is found useless to the needs of the County pending a Report of the County Road Engineer; and WHEREAS, Resolution 21-408, passed by the Board of County Commissioners (BOCC) on November 23, 2021, directed the County Road Engineer to examine a portion of 1st and Pine Streets and adjacent alleys right of way and to report his findings to the BOCC; and WHEREAS, as required by RCW 36.87, December 7, 2021, the report of the County Road Engineer on the matter of the proposed vacation of the following described portion of 1st and Pine Streets and adjacent alleys right of way, was filed in the office of the BOCC, to wit: All of 1st and Pine Streets and adjacent alleys lying within Blocks 5, 6, 7, and 8 of the Plat of Dyrad in Section 1, Township 13 North, Range 5 West, W.M.; and WHEREAS, the report and all related materials having been reviewed by the BOCC and found appropriate for further proceedings. NOW THEREFORE BE IT RESOLVED that January 11, 2022, at or after the hour of 10:00 a.m. in the Commissioners' Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis, Washington, has been fixed as the time and place for the hearing on the County Road Engineer's Report, when and where all persons may appear and be heard upon report and upon the matter of the vacation of that road described above. Interested parties are encouraged to check the Commissioners' hearing schedule online at https://lewiscountywa.gov/offices/commissioners/ agendas-calendar/ as the hearing date approaches for updated details; and NOW THEREFORE BE IT FURTHER RESOLVED that the Clerk of the Board is hereby instructed to proceed with all that necessary notifications, posting and publication. SECOND:The portion of right of way proposed for vacation includes approximately 952 feet of streets and an additional 806 feet of alleyways and are unmaintained by the County. THIRD:The right of way is adjoined by property owned by Greg Elliott who has requested this vacation. FOURTH:This portion of right of way does not abut a body of water,nor is the right of way necessary as part of the county road system and is useless for County road purposes. FIFTH: The Property Owner has paid all administrative fees and publication costs associated with this vacation. SIXTH: Utility companies known to service the general area have been contacted and are not opposed to the vacation In my opinion,this portion of right of way should be vacated for the reason that the public will be benefited by its vacation,returning the property to the tax rolls.
