2022-05-17 PA UpdatePA Update May 17, 2022 2 p.m. Present: Commissioner Pollock, Commissioner Grose, Amber Smith, Kevin McDowell, Chris Panush, Austin Majors, Becky Butler, Dianne Dorey Guest(s): None Recorder: Rieva Lester Lewis County Law and Justice Council: Amber Smith said the county has a Law and Justice Council as per state law. She said county code requires quarterly meetings. Amber said she is looking into the history of the group, including the committee’s last known president and vice president. Amber said state law changed around 2016, setting the group’s role as advisory rather than making it a decision-making body. Cemetery District No. 2 de-annexation: Amber said Cemetery 2 wants to decrease in size. She said the district submitted an incomplete packet a couple years ago. She said the district has indicated it plans to resubmit a complete packet soon. After receiving a complete packet, Amber said the county would issue a notice of hearing (and have it printed two consecutive weeks) and then hold a hearing. She said the surrounding voters could then approve de-annexation by ballot or by signature. Amber said Kevin McDowell will work with the Boundary Review Board. Executive session discussion: At 2:08 p.m., Commissioner Pollock announced that the Board would be going into executive session under RCW 42.30.110(1)(i) for 10 minutes to discuss the following: • MacDonald v. Lewis County • Lewis County Lollipop Guild v. Lewis County, et al. • Hardel Mutual Plywood Corp. v. Lewis County • Opioid Multi-District Litigation Executive session started at 2:09 p.m. At 2:19 p.m., the Board extended executive session for 5 minutes. Executive session ended at 2:24 p.m. Commissioner Pollock noted that no decisions had been made. Commissioner Grose made a motion to authorize Kevin McDowell to communicate with outside counsel in the MacDonald case as discussed in executive session. Commissioner Pollock seconded. Motion passed 2-0. Meeting adjourned at 2:26 p.m.
