Board Meeting Minutes 03/09/20151 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES March 9, 2015 The Board of County Commissioners (BOCC) for Lewis County, Washington, met in regular session on Monday, March 9, 2015, at 10:00 a.m. Commissioners Edna J. Fund, P.W. “Bill” Schulte, and Gary Stamper were in attendance. Chair Fund determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Stamper moved to approve the minutes from the 10:00 a.m. meeting held on Monday, March 2, 2015. Commissioner Schulte seconded the motion. Motion Carried 3-0 PUBLIC COMMENT Robin Roy asked about an article that she read regarding a loan in the amount of $800,000 to a private business that went out of business. She wanted to know what we are doing to get our money back. Chair Fund stated this is a complex issue but the amount is not correct. There are other things going on and we are not losing the money. Chair Fund recommended Ms. Roy arrange an appointment convenient to her be arranged with the commissioners. EMPLOYEE RECOGNITION Recognized Coroner Warren McCloud for receiving a certificate from the Lewis County Traffic Safety Council for outstanding dedication to public safety education, with an ongoing commitment to the youth of our community. NOTICE Commissioner Schulte made a motion to approve the Notice Agenda items one and two. Commissioner Stamper seconded the motion. 1. Notice: Accepting a bid on tax title property located off Boyd Road, Randle WA. Resolution No. 15-076 Tim Elsea, Public Works Director, stated tax parcel 031622016002 is a 0.14 acre parcel located off Boyd Road, Randle with a 1967 Skyline Buddy Manufactured Home. The property was offered for sale at auction by the Treasurer due to tax delinquencies. The property did not sell at the tax sale and was subsequently deeded by the Treasurer to Lewis County. RCW 36.35.150 allows for the property to be disposed of by private negotiations providing that the final sale price is no less than the principal amount of unpaid taxes which are $2,717.10. An adjacent property owner has now offered to purchase the property for $3,007.10, the amount of the tax delinquency and miscellaneous Treasurer's fees. This resolution would accept the bid subject to 2 conditions of LCC 3.30.390 which requires that the proposed sale be noticed in a legal newspaper of general circulation at least once a week for two consecutive weeks. 2. Notice of Hearing: Regarding a non-exclusive license to AT&T Corporation to construct, operate, and maintain telecommunication facilities on Highway 603 Right of Way in Winlock WA. Hearing will be held on or after 10:00 am, on Monday, April 6, 2015. Resolution No. 15-077 Tim Elsea, Public Works Director, stated a non-exclusive license to AT&T Corp. to construct, operate and maintain telecommunication facilities on Highway 603 Right of Way in Lewis County, Washington. This resolution sets a hearing date of April 6, 2015 for consideration of granting a license to AT&T Corp for the construction, maintenance and operation of telecommunications facilities on Highway 603. Lewis County Code 12.20 and RCW 36.55 require that all utility installations on county road right of way be authorized by a franchise/license from Lewis County. An application for a license has been received from AT & T Corp. to construct, operate and maintain telecommunication facilities within Highway 603 Right of Way. This license would replace a previous license that recently expired. This resolution sets April 6, 2015, as the date for hearing on the License request and calls for necessary notifications, postings and publications. Motion Carried 3-0 CONSENT Commissioner Schulte made a motion to approve the Consent Agenda items three through eleven. Commissioner Stamper seconded the motion. 3. Resolution No. 15-078 Approval of warrants and payroll for payment. Chair Fund stated this Resolution approves 95 regular warrants and invoices paid VIA Treasurer’s check #50408, for a total payment against the County in the amount of $204,958.98. This also approves 187 payroll warrants and 457 automatic deposits dated March 5, 2015 is approved for a total payment against the County in the amount of $3,233,814.67. 4. Resolution No. 15-080 Cancellation of delinquent accounts receivable invoices from Information Services Fund 540. Doug Carey, Facilities Manager, stated Information Services Fund 540 attempted to collect for the expense of Air Cards that are billed by Sprint to the city or jurisdiction they are going to be used in. The attached list (Exhibit A) is a detail of one delinquent invoice issued from 2008 totaling $478.48, which has been sent to the City of Pe Ell on numerous occasions. All attempts to collect have been unsuccessful. It is recommended that the Board of County Commissioners approve the write off and cancellation of this account receivable as this invoice has been deemed uncollectible. 3 5. Resolution No. 15-081 Approving a memo of understanding (MOU) between Lewis County Department of Emergency Management (LCDEM) and the Lewis Mason Thurston Area Agency on Aging. Steve Mansfield, Emergency Management, stated the purpose of this Memo of Understanding (MOU) is to promote a partnership between LMTAAA and LCDEM that helps facilitates the coordination and assistance efforts for LMTAAA clients during an emergency or disaster in Lewis County. In the event of an emergency or disaster it may be necessary to contact our most vulnerable citizens to determine if they are safe and receiving essential support. LMTAAA has determined that it is necessary to develop and keep updated prioritized client lists in the event that they or LCDEM needs to contact these people to determine their safety and immediate needs. 6. Resolution No. 15-082 Authorizing Lewis County Department of Emergency Management (LCDEM) Manager to sign Contract No. E15-075 on behalf of Lewis County. Steve Mansfield, Emergency Management, stated due to the reorganization of the LCDEM, it is necessary to amend Resolution 14-283 to accurately reflect the proper signing authority for the 2014-15 EMPG, contract #E15-075.Approval of amendment to Resolution 14-283; an amendment relating to signature authority for the 2014-15 Emergency Management Performance Grant (EMPG). Proposed modification to Resolution 14-283 as follows: Lewis County Sheriff Steve Mansfield needs to be changed to: "Lewis County Department of Emergency Management Manager". 7. Resolution No. 15-083 Approving a Title VI Non-Discrimination Agreement with Washington State Department of Transportation. Tim Elsea, Public Works Director, stated this Resolution would approve a Title VI Non-Discrimination Agreement with WSDOT which is required by the Code of Federal Regulation (49 CFR Part 21 and 23 CFR 200) for all local agencies in receipt of federal transportation funds. The federal government requires each local agency that receives federal funds to establish a Title VI Non-Discrimination Program (49 CFR Part 21 and 23 CFR 200). Lewis County established this program with the Washington State Department of Transportation under Resolution No. 06-061 on February 13, 2006. WSDOT requires a new agreement signed when there are changes to our signatories, such as the change of the Chair of the Board of County Commissioners. 8. Resolution No. 15-084 Ratifying consultant contracts and supplements over $40,000 for active 2014 Public Works projects. Tim Elsea, Public Works Director stated Pursuant to Resolution 11-437, Directors of each of the County Departments, under authority of the Board of County Commissioners, possess authority to execute and bind Lewis County to consulting services, contracts, projects, agreements, grant applications, contract amendments, and 4 change orders involving the actual expenditure or receipt of less than $150,000.00 per year provided that, by resolution, acceptance of such funding has been authorized and approved by the Board. Further, the Board will ratify by resolution, after-the-fact, such contracts, projects, agreements, grant applications, contract amendments, and change orders in excess of $40,000 but less than $150,000.00. During 2014, Public Works executed individual consultant contracts and supplements in excess of $40,000.00. Therefore, post contract ratification is requested for the following individual and cumulative expenditures for the following projects: Lincoln Creek Bridge No. 31 Replacement Consultant: BergerABAM, Inc. Agreement: $74,279.00 On Call Cultural Resources Consultant: AINW, Inc. Agreement: $150,000.00 On Call Geotechnical Engineering Consultant: PBS Engineering Agreement: $100,000.00 Davis Creek Turnarounds Consultant: HDJ Agreement: $80,098.29 Supplement #1 $ 2,196.00 Supplement #2 $33,565.31 9. Resolution No. 15-085 Approving and agreement regarding the proposed purchase of property located at 158 Kennicott Road, Chehalis, WA. Tim Elsea, Public Works Director, stated Kennicott Road south of Chehalis has experienced a slide near Mile Post 0.32 which became evident in early 2014. This dead end road provides the only access to approximately 37 homes located past the slide, therefore retaining the road in a safe passable condition is critically important. In April, 2014, the County requested that the Washington State Department of Transportation (WSDOT) conduct a geotechnical investigation of the slide area and develop conceptual-level design alternatives for stabilizing the road. WSDOT has conducted its investigation and recommends a single option for construction of a soldier-pile tieback wall on the south side of the road for stabilizing the slide within the right of way, at an estimated cost of $875,000. The property located adjacent to the slide area on its south side has also been damaged and the owner Nancy Keller has offered to sell the property to the County for its current $139,600 assessed value. Purchase of this 2.44 acre parcel of land will allow the County to consider the maximum number of options for repairing the road thereby reducing costs. This resolution would approve the purchase and ratify the signature of the County Engineer on an agreement between the County and Nancy Keller for the $139,600 purchase. 10. Resolution No. 15-086 Appointing a member to the Lewis County Planning Commission. 5 Lee Napier, Director of Community Development stated an appointment of Jeff Millman is recommended to the Lewis County Planning Commission to fill the unexpired term of Clint Brown term beginning March 09, 2015 and ending December 31, 2015. Motion Carried 3-0 There being no further business, the BOCC’s’ business meeting adjourned at 10:17 a.m. on March 9, 2015. The next public meeting will be held Monday, March 16, 2015.
