Board Meeting Minutes 03/16/20151 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES March 16, 2015 The Board of County Commissioners (BOCC) for Lewis County, Washington, met in regular session on Monday, March 16, 2015, at 10:00 a.m. Commissioners Edna J. Fund, P.W. “Bill” Schulte, and Gary Stamper were in attendance. Chair Fund determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Stamper moved to approve the minutes from the 10:00 a.m. meeting held on Monday, March 9, 2015. Commissioner Schulte seconded the motion. Motion Carried 3-0 PUBLIC COMMENT Summer Chapman, from Salkum, WA wanted to know a time-line or plan on the Marijuana Moratorium. Chair Fund stated that the next step will come from Community Development NOTICE Commissioner Schulte made a motion to approve the Notice Agenda items one and two. Commissioner Stamper seconded the motion. 1. Notice of Hearing: Regarding the first 2015 Budget Amendment. Hearing will be held on or after 10:00 a.m. Monday, March 30, 2015. Resolution No. 15-087. Steve Walton, Budget Administrator, stated there is a Notice of Hearing on the first 2015 Budget Amendment. The hearing will be held on the 30th day of March 2015 on or after 10:00 a.m. to consider an amendment to various departments within the 2015 budget for Current Expense and various funds. This amendment Increases expenditures in the amount of $2,370,525, increases revenue in the amount of $299,302, and uses fund balance in the amount of $2,071,223. The Current Expense portion of this amendment is an expenditure increase of $62,704, a $45,611 increase in revenue resulting in a use of fund balance in the amount of $17,093. The Hearing will be noticed in the Chronicle on March 17th and 24th. Commissioner Schulte asked where majority of funds are being used. 2. Notice of Hearing: Regarding the adoption of Ordinance 1257 pertaining to unmarked vehicles in Lewis County. Hearing will be held on or after 10:00 a.m. on Monday, April 6, 2015. Resolution No. 15-088. 2 Glenn Carter, Chief Civil Prosecuting Attorney, stated a there will be a Notice of public hearing and proposed action to adopt a new section to Title 10 of Lewis County Code specifying exceptions to the requirement to mark county vehicles. State law, RCW 46.08.065, generally requires all vehicles owned or controlled by the county to be marked while used in public business or operated on the public highways. RCW 46.08.065 authorizes county boards of county commissioners to provide by rule or ordinance for exceptions to the marking requirements with respect to vehicles "used for law enforcement, confidential public health work, and public assistance fraud or support investigative purposes, [and] for vehicles leased or rented ... on a casual basis for a period of less than ninety days..." RCW 46.08.065(1), (3). The proposal to be heard adds a new section to the Lewis County Code (proposed LCC 1.36.020) prescribing exceptions to the marking requirements imposed by RCW 46.08.065. Glenn wants to make it clear that “unmarked cars” are not specifically for routine traffic control. The proposal would be heard by the BOCC at the public hearing to be held at or about 10:00 am on April 6, 2015 in the BOCC Hearing Room at 351 NW North St., Chehalis, WA 98532. Motion Carried 3-0. CONSENT Commissioner Schulte made a motion to approve the Consent Agenda items three through six. Commissioner Stamper seconded the motion. 3. Resolution No. 15-089 Approval of warrants for payment. Chair Fund stated this resolution approves 718132-718274, 718358-718549 (335 regular warrants) for a total payment against the County in the amount of $2,235,025.12. 4. Resolution No. 15-090 Appointing a member to East Lewis County Public Development Authority (ELCPDA). Commissioner Stamper stated this resolution appoints David Linder as a member to the ELCPDA. 5. Resolution No. 15-091 Cancellation of non-collectible accounts for civil process accounts in the Sheriff’s Office. Stacy Brown, Special Services Chief for the Sheriff’s Office, stated that the Sheriff's Office has non-collectable, delinquent accounts that are deemed expired by statute and retention laws within the State of Washington. The Civil Division of the Sheriff's Office has compiled a list of delinquent accounts receivable to collect service process fees. All 3 efforts toward collection of these delinquent accounts have been unsuccessful and a statute of limitations has been reached. The attached list shows those accounts that are considered to be non-collectable (more than six years old) totaling $1,674.90. It is in the best interest of the County to authorize the write-off and cancellation of these delinquent accounts in the Civil Division of the Sheriff's Office totaling $1,674.90 due to the RCW statute limitations. 6. Resolution No. 15-092 Approving a Local Agency Agreement and Federal Aid Project Prospectus with the WA State Department of Transportation (WSDOT) for the County Safety Program-Phase I, County Road Project (CRP) 2174A.. Tim Elsea, Director of Public Works, stated this is an approval of a resolution authorizing the Chair of the BOCC to sign a Local Agency Agreement and Federal Aid Project Prospectus with WSDOT for the County Safety Program – Phase I, CRP-2174A. The County Safety Program Project – Phase I, CRP-2174A is listed as priority number 8 in Lewis County’s 2015-2020 Six-year Transportation Improvement Program adopted via Resolution No. 14-306 on November 17, 2014. The project is funded through the Federal Highway Administration’s (FHWA) Highway Safety Improvement Program (HSIP) ($107,448), with a 10% ($1,164) local match requirement for the Preliminary Engineering phase, for a project total of $108,612. The conditions of receiving FHWA HSIP federal funding requires a Local Agency Agreement and Federal Aid Project Prospectus between Lewis County and WSDOT, signed by the Chair of the BOCC, prior to commencing the project. Budget Impact HSIP federal funds - $107,448 County road funds - $ 1,164 Motion Carried 3-0. There being no further business, the BOCC’s business meeting adjourned at 10:16 a.m. on March 16, 2015.
