BOARD MEETING MINUTES
July 20, 2015
The Board of County Commissioners (BOCC) for Lewis County, Washington, met in
regular session on Monday, July 20, 2015, at 10:00 a.m. Commissioners Edna J.
Fund, Gary Stamper, and P.W. “Bill” Schulte were in attendance. Chair Fund, called
the meeting to order, determined a quorum, and proceeded with the flag salute.
Commissioner Stamper moved to approve the minutes of the 10:00 a.m., Monday,
July 13, 2015 Business Meeting. Commissioner Schulte seconded the motion.
Motion Carried 3-0.
PUBLIC COMMENT
Bob Guenther, Chehalis, discussed the Newaukum Valley dump site. Department of
Ecology (DOE) did shut them down. In the spring the owners cut the grass off of the
property. That ground is so wet they tracked biosolids along Highway 508. He took
samples of this and sent it to Bill Teitzel who then sent it to DOE. The DOE said it was
not biosolids. It was biosolids on the road and evidently DOE doesn’t know the
difference between biosolids and clay soil Mr. Guenther reported. He also said there is
a problem with ground water in this county, the aquifer on the Newaukum Praire and
Burnt Ridge.

The BOCC recognized Mel Coon, Facilities and Dean Durant, Juvenile, for being
nominated as the Employee of the Quarter. The BOCC then announced that Dean
Durant had been selected as the 2nd Quarter Employee of the Quarter.

Commissioner Schulte moved to approve the Notice Agenda item one.
Commissioner Stamper seconded the motion.
1. Call for Bids: Regarding the Davis Creek Road Turnaround and Highway 12
Intersection Improvement Projects. Bids are due to the Clerk of the Board on
or before 11:00 am on Tuesday, August 11, 2015. Resolution No. 15-210
Tim Elsea, Director of Public Works, stated this resolution will give notice that a Call
for Bids has been issued for the Davis Creek Rd. Turnarounds & US 12 Intersection
Improvements Project - FEMA PW 260, CRP 2125. This contract provides for the
improvement of Davis Creek Road intersections with US Highway 12 and construction
of new turnarounds by clearing and grubbing, excavation, asphalt concrete pavement,
placing riprap, installation of a culvert, permanent seeding and other work in accordance
with the Contract Plans, Provisions, and the Standard Specifications.
Motion Carried 3-0.
CONSENT
Commissioner Schulte added item seven Resolution No. 15-217.
Commissioner Schulte moved to approve the Consent Agenda items two through
seven. Commissioner Stamper seconded the motion.
2. Resolution No. 15-211 Approval of warrants and payroll for payment.
Suzette Smith, Auditor’s Office, Bid stated this Resolution approves 241 regular
warrants for a total payment against the County in the amount of $929,933.00. This also
approves 242 payroll warrants dated July 20, 2015 for a total payment against the
County in the amount of $275,417.00.
3. Resolution No. 15-212 Approving an administrative agreement for additional
right of way for Davis Creek Road.
Tim Elsea, Director of Public Works, stated this resolution would approve an
administrative settlement of negotiations between the County and Albert Justice for
additional right of way for Davis Creek Road. Resolution 15-059, passed by the Board
of County Commissioners on February 28, 2015, instructed the County Engineer to
acquire right of way for Davis Creek Road. The County made an offer to property
owner, Albert G. Justice, dated March 26, 2015, agreeing to pay $7,300.00 for 2.42
acres of land to be used for a wetland mitigation site in conjunction with the Davis Creek
Road construction project. The property owner’s entire 2.92 acre property has been
listed for sale for nearly three years and is currently offered at $25,000. Negotiations
with the property owner and his agent have not resulted in acceptance of the County’s
offer. The property owner has now agreed to sell the 2.92 acre parcel for $15,000.00.
4. Resolution No. 15-213 Bid award for the Ceres Hill Long Term Bank
Stabilization and Habitat Mitigation Project.

Tim Elsea, Director of Public Works, stated a Call for Bids was made on June 15,
2015. The project was advertised for three consecutive weeks in The Chronicle and the
Daily Journals of Commerce (Seattle and Portland). The project was also listed on
Lewis County's website. Public Works received 6 responsive bids for this project on July
7, 2015. Henderson LLC provided the lowest responsive bid of $368,367.25. The
Engineer's Estimate for this project was $597,380.00. The lowest responsive bid is
below the Engineer's Estimate. Public Works staff recommends acceptance of the low
bid provided by Henderson LLC, after considerable review.
5. Resolution No. 15-214 Approving a contract with the Housing Resource Center
for the Transitional Housing Program.
John Abplanalp, Health and Social Services, stated this Resolution approves a
contract between Lewis County and the Housing Resource Center for the Transitional
Housing Program in the amount of $134,129.00. HUD contracts with Lewis County to
subcontract with Lewis County Shelter Program to provide a transitional housing
program for the homeless. This program will now rapidly rehouse homeless families in
Lewis County. This contract extends the current McKinney program for the fiscal year
May 1, 2015 to April 30, 2016.
6. Resolution No. 15-215 Approving a professional services contract with the
Community Action Council (CAC) of Lewis, Mason and Thurston Counties.
John Abplanalp, Health and Social Services, Approve Professional Services
Contract between Lewis County and Community Action Council (CAC) of Lewis, Mason
& Thurston Counties from July 1, 2015 through June 30, 2016. Lewis County is
contracting with CAC to accomplish the Scope of Work and objectives of the local
CDBG project. Lewis County has been requested to serve as the recipient of the 2015
CDBG Public Services Grant. The Washington State Department of Commerce is
authorized by the Federal Department of Housing and Urban Development to provide
funds to units of local government selected to undertake and carry out certain activities
and projects under the WA State CDBG Program. Funding is provided from the State
Department of Commerce. The CDBG Public Services Grant was received for fiscal
year 2015-2016 in the amount of $100,874. Of that, $97,374 will be subcontracted to
CAC of Thurston, Mason & Lewis Counties and $3,500 will be retained by Lewis County
to cover administrative costs.
Contract is from July 1, 2015 - June 30, 2016.
7. Resolution No. 15-217 Rescinding Resolution 14-344 granting Distressed
Counties Funding to the Tacoma Rail Working Group and re-directing that
funding to match funds applied for and received by Lewis County from the
U.S. Department of Commerce (DOC) for the same purpose of conducting the
"Tacoma Rail Feasibility Study".

Commissioner Schulte stated this Resolution rescinds Resolution 14-344 and re-
directs the funding to match funds from the DOC.
Suzette Smith, Auditor’s Office, stated the original Resolution was awarding funds to
the group that formed to oversee the study. However they are not a legal entity and they
cannot receive those funds. The change is that Lewis County will administer those
funds themselves.
Motion Carried 3-0.
HEARING
Hearing: 2015 Budget Amendment for the Criminal Drug Investigation Fund and
the Drug Control Fund Resolution No. 15-216
Commissioner Fund announced the hearing and asked for a staff report.
Steve Walton, Budget, stated copies of the detailed budget amendment are at the front
of the room. Notice of this Public Hearing was published in the East County Journal on
July 8th and 15th. This amendment has zero impact to the general fund or current
expense. It only pertains to two special revenue funds, the Criminal Drug Investigation
Fund No. 160 and the Drug Control Fund No. 109. While sufficient fund balance exists
in both funds it is necessary to amend the budget to ensure adequate funds are
appropriated which further grants spending authority to cover recent expenditures for
Sheriff’s Office equipment. This total budget amendment reflects an increase in
expenditures in the amount of $77,000, increasing revenues in the amount of $12,000,
and a use of fund balance in the amount of $65,000.
Chair Fund asked if there were any questions. There were none. She closed the
question and answer portion of the hearing and opened the formal hearing.
Steve Walton asked that his previous comments be adopted into the record.
Chair Fund asked if anyone else would like to testify, and no one responded. She
closed the hearing and asked for a motion.
Commissioner Schulte moved to approve Resolution No. 15-216. Commissioner
Stamper seconded.
Resolution No. 15-216 Lewis County 2015 Budget, Emergency and Supplemental
Appropriations for Criminal Drug Investigation Fund No. 160 and Drug Control Fund No.
109.
Motion carried 3-0.
There being no further business, the BOCC’s business meeting adjourned at 11:09 a.m.
on July 20, 2015. The next public meeting will be held Monday, July 27, 2015.
