Board Meeting Minutes 09/14/20151 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES September 14, 2015 The Board of County Commissioners (BOCC) for Lewis County, Washington, met in regular session on Monday, September 14, 2015, at 10:00 a.m. Commissioners Edna J. Fund, Gary Stamper, and P.W. “Bill” Schulte were in attendance. Chair Fund, called the meeting to order, determined a quorum, and proceeded with the flag salute. Commissioner Stamper moved to approve the minutes of the 10:00 a.m., Monday, August 31, 2015 Business Meeting. Commissioner Schulte seconded the motion. Motion carried 3-0. RECOGNITION The BOCC recognized Auditor Larry Grove for earning the Professional Finance Office Award for the State of Washington from the Washington Finance Officers Association. NOTICE Commissioner Schulte moved to approve the Notice Agenda items one and two. Commissioner Stamper seconded the motion. 1. Notice: Temporary closure of Ingalls Road to all through traffic from September 21, 2015 to October 16, 2015. Resolution No. 15-259 Tim Elsea, Director of Public Works, stated this Resolution would close Ingalls Road between the Lincoln Creek Road and the Bunker Creek Road to all through traffic from September 21, 2015 to October 16, 2015 to facilitate a bridge repair project at MP 2.11. We do have a public meeting schedule for tomorrow September 15, 2015 to notify the citizens about the closure. 2. Notice of Hearing: Regarding the 3rd 2015 Budget Amendment. Hearing will be held on or after 10:00 a.m., on September 28, 2015. Resolution No. 15-260 Steve Walton, Budget Manager, stated the 3rd 2015 Budget Amendment, will be published in The East County Journal on September 16th and 23rd. The hearing will be held on the 28th day of September 2015 on or after 10:00 a.m. to consider an amendment to various departments within the 2015 budget for Current Expense and various funds. This amendment increases expenditures for all funds in the amount of $737,540, increases revenue in the amount of $6,552, and uses fund balance in the amount of $730,988. The current expense portion of this amendment is an expenditure increase of $158,440, a $33,859 increase in revenue resulting in a use of fund balance in the amount of $124,581. Motion carried 3-0. 2 CONSENT Commissioner Schulte moved to approve the Consent Agenda items three through nine. Commissioner Stamper seconded the motion. 3. Resolution No. 15-261 Approval of warrants and payroll for payment. Suzette Smith, Auditors Office, stated this Resolution approves 454 regular warrants for a total payment against the County in the amount of $2,751,455.21. This also approves 256 payroll warrants and 473 automatic deposits dated September 4, 2015 for a total payment against the County in the amount of $3,416,325.25. 4. Resolution No. 15-262 Approving an interagency agreement (K1742) with the Washington State Department of Agriculture for the management of invasive knotweed species. Bill Wamsley, Weed, stated this Resolution approves an Interagency Agreement (K1742) between the WSDA, will allow for funding and agreement for noxious weed control between for noxious weed management associated with the Cowlitz and Chehalis Rivers within Lewis County. An award of $20,000.00 was authorized by WSDA. The Interagency agreement period is from July 1, 2015 through June 30, 2017. 5. Resolution No. 15-263 Approving a modification to Participating Agreement NFS-12-PA1106030-017 with the USDA Forest Service, Pacific Northwest Region, Gifford Pinchot National Forest for noxious weed control treatments. Bill Wamsley, Weed, stated the project extends the cooperation, agreement and funding for noxious weed management that is taking place on the Gifford Pinchot National Forest, Cowlitz Valley Ranger District. Treatment of weeds will occur in approved KV areas after timber harvest. The $40,079.00 was authorized by the Gifford Pinchot National Forest and Cowlitz Valley Ranger District for work specific to forest harvest units, KV Areas. 6. Resolution No. 15-264 Approving a contract between Washington State Military Department and Lewis County for 911 professional development funding. Michael Strozyk, Director of Central Services, stated this approves a contract between the Washington State Military Department and Lewis County for E911 Professional Development funding assistance in the amount of $42,400.00 for the contract period time of July 1, 2015 through August 15, 2016. As part of the State E911 funding assistance program, certain County expenses associated with the daily operations of the E911 Communications Center are eligible for reimbursement. 7. Resolution No. 15-265 Transfer a franchise from Elmer P. Loose IV to James J. Ladd to erect, install, construct, repair, replace, reconstruct, maintain, and retain an existing water line on Chilvers Road. 3 Tim Elsea, Director of Public Works, stated this is a Transfer of a franchise from Elmer P. Loose IV to James J. Ladd to erect, install, construct, repair, replace, reconstruct, maintain, and retain an existing water line on Chilvers Road near Adna. Lewis County Code 12.20 and RCW 36.55 require that all utility installations on county road rights of way be authorized by a franchise from the County. On September 16, 1989, Lewis County issued a 49 year franchise to Elmer P. Loose IV. Mr. Loose subsequently sold his property to Ronald and Sharron Ford who then sold the property to James J. and Linda J. Ladd. The franchise issued to Mr. Loose has a provision for transfer and Mr. Ladd has submitted an application for transfer of the Loose franchise and has signed an agreement binding him to all terms of the franchise. This resolution approves the transfer of the Loose franchise with all existing terms and conditions on Chilvers Road right of way. 8. Resolution No. 15-266 Approving Prevention Agreement with the Department of Social and Health Services (DSHS), Division of Behavioral Health and Recovery (DBHR). Danette York, Director of Health and Social Services, stated this Resolution approves a Prevention Agreement between the Department of Social and Health Services (DSHS), Division of Behavioral Health and Recovery (DBHR) and Lewis County. The agreement covers prevention services and provides guidelines under the Community Prevention and Wellness Initiative. DBHR contracts with county governments to coordinate, subcontract, and monitor prevention programs at the local level. Contract is from July 1, 2015 through June 30, 2017. Total amount is $142,007. 9. Resolution No. 15-267 Modify Restriction on Outdoor Burning to allow recreational fires throughout unincorporated Lewis County. Lee Napier, Director of Community Development, stated this requests the BOCC consider modifying the restriction on outdoor burning to allow recreational fires throughout unincorporated Lewis County. This request is made by the Lewis County Director of Community Development, acting as the Fire Marshal, based on improved weather conditions, along with extended forecast, throughout unincorporated Lewis County thereby reducing the potential of substantial fire danger. The recommendation is to modify the current restriction to allow recreational fires. This modification commenced at 10.00 a.m. on September 14, 2015. Once conditions indicate that restrictions are no longer appropriate, the Fire Marshal will recommend to the BOCC that the restriction be lifted. At that time the BOCC would ratify their decision by resolution. The Community Development Department will make every effort necessary to keep the public, county fire control agencies and the Southwest Clean Air Agency apprised of the local outdoor burning status. Motion carried 3-0. 4 There being no further business, the BOCC’s business meeting adjourned at 10:24 a.m. on September 14, 2015. The next public meeting will be held Monday, September 21, 2015.
