BOARD MEETING MINUTES
November 2, 2015
The Board of County Commissioners (BOCC) for Lewis County, Washington, met in
regular session on Monday, November 2, 2015, at 10:00 a.m. Commissioners Edna J.
Fund, Gary Stamper, and P.W. “Bill” Schulte were in attendance. Chair Fund, called
the meeting to order, determined a quorum, and proceeded with the flag salute.
Commissioner Stamper moved to approve the minutes of the 10:00 a.m., Monday,
October 26, 2015 Business Meeting. Commissioner Schulte seconded the motion.
Motion carried 3-0.
Public Comment
John Kramer, Onalaska, WA discussed flooding in Lewis County and a prediction of a
record flood in October of 2018. He provided information for the Commissioners to
review.
EMPLOYEE
Commissioner Fund stated this was the weekly United Way campaign donation
employee drawing. The winner was Eric Eisenberg.
NOTICE
Commissioner Schulte moved to approve the Notice Agenda items one through four.
Commissioner Stamper seconded the motion.
1. Notice: Set a hearing date to consider renewing the moratorium upon
establishments involved in the production, processing and retail sale of
marijuana and related products. Resolution No. 15-300
Lee Napier, Director of Community Development, stated the BOCC set a hearing
date November 30, 2015 to consider renewing the moratorium upon establishments
involved in the production, processing and retail sale of marijuana and related products.
The moratorium is adopted pursuant to the authority of RCW 36.70A.390. This is the
method by which local governments may preserve the status quo, so that new plans
and regulations will not be rendered moot by intervening development. The County staff
continues to develop recommendations in the form of draft code amendments for the
BOCC to consider.
2. Notice of Hearing: For the proposed 2016 Annual Construction Program (ACP)
and Six Year Transportation Improvement Program (TIP) for the years 2016-

Tim Elsea, Director of Public Works, stated pursuant to RCW 36.81.121, all counties
are required to prepare, adopt, and submit a Six Year TIP for proposed road and bridge
construction prior to the County's budget adoption each year. Pursuant to WAC 136-16,
all counties are required to prepare, adopt, and submit an ACP for proposed road and
bridge construction prior to the County's budget adoption each year. The public hearing
will be held November 16, 2015, at the Commissioners Hearing Room on the 2nd floor
of the Historic Courthouse in Chehalis, Washington. The notice of public hearing will be
published in the East County Journal on November 4th and 11th, 2015.
3. Notice of Hearing: A franchise to Lewis County Public Utility District No. 1 to
construct, operate and maintain telecommunication facilities in Lewis County
Rights of Way. Resolution No. 15-302
Tim Elsea, Director of Public Works, stated the franchise being proposed is for a five-
year term. This resolution sets November 23, 2015, at or after 10:00 a.m., in the
Commissioners Hearing Room on the 2nd floor of the Historical Courthouse in Chehalis,
Washington, as the time and place for the hearing on said Franchise request. and
instructs the Clerk of the BOCC to proceed with all appropriate and necessary
notifications, posting and publication as required by RCW 36.55.040.
4. Notice of Hearing: A franchise to Public Utility District No. 1 of Thurston
County to construct, operate and maintain water system facilities in Lewis
County Rights of Way. Resolution No. 15-303
Tim Elsea, Director of Public Works, stated the rights of way being considered for use
are portions of Jackson Highway, Walsh Lane, Chehalis Valley Drive, Valley Meadows
Drive, Valley Meadows Loop, Romerman Road, Big Hanaford Road, Jack Fir Ct W,
Jack Fir Ct E, Hemlock Ln, Alderwood Dr, Cottonwood Ln and Cannon Rd. The
franchise being proposed is for a five-year term. This resolution sets November 23,
2015, at or after 10:00 a.m., in the Commissioners Hearing Room on the 2nd floor of the
Historic Courthouse in Chehalis, Washington, as the time and place for the hearing on
the franchise request and instructs the Clerk of the BOCC to proceed with all
appropriate and necessary notifications, postings and publications as required by RCW
36.55.040.
Motion carried 3-0.
CONSENT
Commissioner Schulte moved to approve the Consent Agenda items five through ten.
Commissioner Stamper seconded the motion.
5. Resolution No. 15-295 Approval of warrants and payroll for payment.
Suzette Smith, Auditor’s Office, stated this Resolution approves 384 regular warrants
for a total payment against the County in the amount of $1,683,979.82.

6. Resolution No. 15-305 Accepting a bid and awarding a contract on the
Packwood Airport Runway Improvement Project.
Lee Napier, Director of Communtiy Development, stated on September 9th, 2015,
sealed bids were received and opened for the Runway 01/19 Improvements. We are
recommending that the contract be awarded to Nutter Corporation.
7. Resolution No. 15-306 The proposed acquisition of additional right of way for
North Fork Road, Chehalis.
Tim Elsea, Director of Public Works, stated North Fork Road, east of Chehalis,
requires a culvert replacement. The project will require additional right of way from four
property owners. RCW 8.08.010 authorizes Counties to acquire property under the
threat of eminent domain when deemed necessary by the Board of County
Commissioners. Pursuant to the requirements of RCW 8.08, this resolution instructs the
County Engineer to acquire right of way from four property owners along North Fork
Road for the project. All such acquisition shall be in accordance with adopted
procedures per Resolution 14-160 and under its eminent domain authority per RCW
8.25 and WAC 458-61A-206(1C), and pursuant to authority and obligations of RCW title
8, notably 8.08, 8.25 and 8.26.
8. Resolution No. 15-307 Adopting a Greenhouse Gas Emissions Reduction
policy.
Tim Elsea, Director of Public Works, stated we were recently awarded a CDBG Grant
in the amount of $717,000 for construction of a new reservoir for the Vader Water
System. One of the requirement of that grant is that we adopt a Greenhouse Gas
Emmissions Policy. Public Works finds other County departments may benefit from this
policy as this may become a requirement for application and acceptance of future
funding. Lewis County finds that it is in the best and responsible public interest to
reduce greenhouse gas emissions.
9. Resolution No. 15-308 Approving a Personal Services Agreement between
Lewis County and Robert K. Weidner.
Tim Elsea, Director of Public Works, stated Public Works is requesting the Board of
County Commissioners (BOCC) to authorize a renewal agreement with Robert K.
Weidner to act on behalf of Lewis County in Washington D.C. for Public Land,
Environment & Natural Resources in conjunction with Secure Rural Schools funding.
This personal services agreement in the amount of $12,500.00 will authorize payment
to Weidner to monitor and provide information on matters affecting public lands within
member counties for 2016.

10. Resolution No. 15-309 Appointing Deborah Mizner to the Lewis-Mason-
Thurston Area Agency on Aging (LMTAAA) Advisory Council through
December 31, 2017.
April Kelley, Public Health and Social Services, stated this Resolution appoints
Deborah Mizner to the vacant position on the LMTAAA Council. Since the position she
is filling, ends on December 31, 2015, this appointment will be effective from the date
the resolution is signed through December 31, 2017.
Motion carried 3-0.
HEARING
Hearing: Proposed vacation of a portion of unmaintained Newaukum Station to
Newaukum Prairie Road, Chehalis. Order of Vacation No. 15-002.
Chair Fund, called for staff report and went over the hearing process.
Tim Elsea, Director of Public Works, stated on the July 13, 2015, in regular session,
the Board of County Commissioners (BOCC), duly passed Resolution 15-209 entered
upon their minutes declaring their intention to proceed to determine whether or not that
certain portion of road in Lewis County named and designated as unmaintained
Newaukum Station to Newaukum Prairie Road, Chehalis should be vacated and
abandoned, and ordered and directed the County Engineer to make an examination of
unmaintained Newaukum Station to Newaukum Prairie Road, Chehalis. On the October
5, 2015, the County Road Engineer filed his report in writing with the BOCC setting forth
all things required by law to be set forth in the engineer's report. The BOCC, by order
duly passed on October 5, 2015, fixed the November 2, 2015, at or after the hour of
10:00 a.m., in the Commissioners Hearing Room on the 2nd Floor of the Historic
Courthouse, Chehalis, Lewis County, Washington, as the time and place for the hearing
on the report of the County Engineer, and that the BOCC duly caused notice thereof to
be published and posted as required by law, and the BOCC now finds there to have
been compliance with all legal requirements.
Chair Fund, asked if there were any questions. There were none. She closed the
question and answer portion of the hearing and opened the formal hearing.
Tim Elsea asked that his previous comments be adopted into the record.
Chair Fund, asked if there was anyone who would like to speak. There was no one.
She closed the hearing.
Commissioner Schulte moved to approve Order of Vacation No. 15-002.
Commissioner Stamper seconded the motion.

Order of Vacation 15-002 The proposed vacation of a portion of unmaintained
Newaukum Station to Newaukum Prairie Road, Chehalis.
Motion Carried 3-0.
There being no further business, the BOCC’s business meeting adjourned at 10:38 a.m.
on November 2, 2015. The next public meeting will be held Monday, November 9, 2015.
