BOARD MEETING MINUTES
November 30, 2015
The Board of County Commissioners (BOCC) for Lewis County, Washington, met in
regular session on Monday, November 30, 2015, at 10:00 a.m. Commissioners Edna
J. Fund, Gary Stamper, and P.W. “Bill” Schulte were in attendance. Chair Fund,
called the meeting to order, determined a quorum, and proceeded with the flag salute.
Commissioner Stamper moved to approve the minutes of the 10:00 a.m., Monday,
November 23, 2015 Business Meeting. Commissioner Schulte seconded the motion.
Motion carried 3-0.
Proclamation
Commissioner Schulte moved to approve Proclamation Agenda item one.
Commissioner Stamper seconded. Commissioner Stamper read the Proclamation
into the record.
1. Proclamation: Proclaiming the month of December as “Choose Local First”
month in Lewis County.
Annalee Tobey thanked the Commissioners on behalf of the Chehalis Community
Renaissance Team for supporting thier efforts to choice local first.
Motion carried 3-0.
Notice
Commissioner Schulte moved to approve Notice Agenda item one. Commissioner
Stamper seconded the motion.
2. Notice: Declaring certain vehicles as surplus county property. Public auction
will be held on December 17, 2015, starting at 8:00 a.m. at Ritchie Brothers
Auction, 104 Avery Road W., Chehalis, WA. Resolution No. 15-343
Erik Martin, Public Works, stated Lewis County Code 3.30 requires that the Board of
County Commissioners declare county property surplus to allow for its disposal, and
advertise notice of disposal of surplus property. The items listed on Exhibit “A” are no
longer useful to Lewis County. The attached list of vehicles have reached their useful
life and have been replaced or scheduled for replacement. With the exception of the
hulk vehicles, we recommend this surplus equipment be sold at auction on December
17, 2015.
Motion carried 3-0.

Consent
Commissioner Schulte moved to approve the Consent Agenda items three through
six. Commissioner Stamper seconded the motion.
3. Resolution No. 15-344 Approval or warrants and payroll for payment.
Suzette Smith, Auditors Office, stated this Resolution approves 272 regular warrants
for a total payment against the County in the amount of $758,938.08. This also
approves 239 payroll warrants dated November 20, 2015 for a total payment against the
County in the amount of $270,699.00.
4. Resolution No. 15-345 Approving medical rates to be paid by Lewis County for
non-union, non-WCIF covered employees.
Archie Smith, Human Resources, stated this Resolution covers non-represented
employees not covered by WCIF. The following contribution levels for health benefits
do not apply to union represented employees. Health and Welfare employer financial
contributions will be changed from $950 per employee per month to a maximum
$1,000.00 per employee per month, effective 11/01/2015.
5. Resolution No. 15-346 Approving a collective bargaining agreement with
AFSCME 1341.
Archie Smith, Human Resources, stated the successor AFSCME 1341 contract
representing the Community Service employees is being presented for approval by the
BOCC. The duration of the contract will be one (1) year dating from 01/01/2015 to
12/31/2015. Effective November 1, 2015, the Employer Health and Welfare contribution
increases from a maximum $950 per employee per month to a maximum employer
contribution $1000.00 per employee per month. A 1.2% wage adjustment to offset the
Public Employees' Retirement System (PERS) employee contribution will be effective
November 1, 2015. Step increases are provided. “Me too” clauses exist should the
medical contribution be increased and /or a COLA be offered to non-represented
employees or non-interest arbitration groups for the 2015 calendar year.
6. Resolution No. 15-347 Bid award for the purchase of a temporary modular
office structure.
Tim Fife, Public Works, stated this contract provides for the purchase of a used 24 ft.
by 60 ft. temporary modular office structure and other work in accordance with the
Contract Plans, Provisions, and the Standard Specifications. All bids received on
September 15, 2015 were rejected due to high cost. A second call for bids was made on
October 26, 2015 to purchase or lease a used modular structure. The project was
advertised for two consecutive weeks in The East County Journal and the Daily
Journals of Commerce (Seattle and Portland). The project was also listed on Lewis
County's website. Public Works received one responsive bid for this project on
November 10, 2015. Pacific Mobile Structures, Inc.(Chehalis, WA) provided the lowest

responsive bid of $121,880.59 for Lewis County to purchase a used temporary modular
office building. Public Works staff recommends acceptance of the low bid provided by
Pacific Mobile Structures, Inc.
Motion carried 3-0.
Hearing
Hearing: Countywide Planning Policies- Resolution No. 15-348
Chair Fund, called for staff report and went over the hearing process.
Lee Napier, Director of Community Development, introduced Fred Evander.
Fred Evander, Community Development, stated the Lewis County Planned Growth
Committee(PGC) met to discuss the existing Countywide Planning Policies. There were
no changes to the population forecast received from Office of Financial Management
and the PGC did not receive any requests by Lewis County cities to change their urban
growth area boundaries. Based on these factors and consideration of the policies during
a workshop on April 22, 2015 the PGC recommended that the Planning Commission
make no changes to the existing Countywide Planning Policies. The Planning
Commission reviewed the Countywide Planning Policies on July 14, 2015 and
concurred that no changes would be necessary for 2015 and recommends approval by
the BOCC.
Ron Averill asked if there are not changes then there will not be anything submitted to
the Grownth Management Board?
Fred Evander confirmed that nothing will be submitted forward.
Chair Fund, asked if there were any questions. She closed the question and answer
portion of the hearing and opened the formal hearing.
Fred Evander asked that his previous comments be adopted into the record.

was no one. She closed the hearing and asked for a motion.
Commissioner Schulte moved to approve Resoluton No. 15-348. Commissioner
Stamper seconded the motion.
Resolution No. 15-348 Approving the existing Lewis County Countywide Planning
Policies.
Motion carried 3-0.

Hearing: Renewing the moratorium upon establishments involved in the
production, processing an retail sale of marijuana and related projects.
Chair Fund, called for staff report and went over the hearing process.
Lee Napier stated the Board of County Commissioners (BOCC) set a hearing date
(November 30, 2015) to consider renewing the moratorium upon establishments
involved in the production, processing and retail sale of marijuana and related products.
The moratoria is adopted pursuant to the authority of RCW 36.70A.390. The County
staff continues to develop recommendations in the form of draft code amendments for
the BOCC to consider. Since we last discussed this issue Lewis County staff had met
with the Planning Commission and they had developed a list of recommendations that
were presented as text in Title 17. There direction to suggest code revision language
changes affected other departments. We are working with the Prosecutor Office as well
as representatives from the Sherriff’s Office, Public Works, and Environmental Health.
We have had experts in the field working on refining the regulation so when we bring a
package to the BOCC you can see the complete work product.
Commissioner Schulte stated this Ordinance was originally drafted on December 9,
2013. Why does it take so long to get an Ordinance passed through the process?
Lee Napier stated this is a new topic so the Planning Commission asked for a
considerable amount of information so they felt they were knowledgable about the topic
before they started to draft regulations. We as your local review team have also spent a
considerable amount of time because this is a new industry.
Chair Fund, asked if there was anyone who would like to speak for or against the
franchise. There was no one. She closed the hearing and asked for a motion.
Lee Napier asked that her previous comments be adopted into the record.
Richard Erickson, Burien, WA, stated this is a very big item. He made some
recommendations to the BOCC. He would never authorize a pot shops without
evidence that they will not bring social harm. He would not approve processor’s until
the county completes its study. He would immediately approve 10 or 12 producers but
only in rural areas.
Summer Chapman, Salkum, provided and read a letter from Barbara Mardock.
Summer stated they have been involved in the process since December of 2013. We
are disappointed in how slow the process has been.
Commissioner Schulte moved to approve Ordinance No. 1264. Commissioner
Stamper seconded the motion.

Ordinance No. 1264 An Ordinance of Lewis County, WA renewing a Moratorium
upon establishment or other development of facilities or other uses involved in
the production, processing and retail sale of marijuana and related products.
Motion carried 3-0.

on November 30, 2015. The next public meeting will be held Monday, December 7,
