Board Meeting Minutes 12/21/20151 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES December 21, 2015 The Board of County Commissioners (BOCC) for Lewis County, Washington, met in regular session on Monday, December 21, 2015, at 10:00 a.m. Commissioners Edna J. Fund, Gary Stamper, and P.W. “Bill” Schulte were in attendance. Chair Fund, called the meeting to order, determined a quorum, and proceeded with the flag salute. Commissioner Stamper moved to approve the minutes of the 10:00 a.m., Monday, December 14, 2015 Business Meeting. Commissioner Schulte seconded the motion. Motion carried 3-0. Public Comment Steve Mansfield, Emergency Management, provided updates from the recent flooding events. . Notice Commissioner Schulte moved to approve Notice Agenda items one and two. Commissioner Stamper seconded the motion. 1. Notice: Pertaining to competitive bidding, dispensing with advertisement and formal sealed bidding with respect to purchases and leases under $25,000. Resolution No. 15-371 Amanda Migliaccio, Auditors Office, stated RCW 39.04.190 indicates the policy requirements for the County to use telephonic or written quotes in lieu of advertisement and formal sealed bidding. The County policy incorporating these requirements was established by Resolution No.12-196, and it enables telephonic or written quotes to be used for purchases between $5,000 and $25,000 under certain circumstances. One of those circumstances is that, twice a year, the County must give notice of the County’s Vendor List and solicit the names of vendors for addition to the list. This resolution is to satisfy that requirement. 2. Notice of Hearing: Approving the proposed Development Agreement with Benaroya Capital Company LLC. Hearing will be held on or after 10:00 a.m., on Monday January 11, 2016. Resolution No. 15-372 Tim Elsea, Director of Public Works, stated the Benaroya Capital Company, LLC plans to develop a large commercial project consisting primarily of proposed large cube warehouses within the Winlock Urban Growth Area. The City of Winlock - which is responsible for the development of the urban growth area under an interlocal agreement with the County, has approved a Binding Site Plan governing development of most aspects of the proposed project. However, under the interlocal agreement, the County 2 retains responsibility for addressing impacts of this large project on existing and proposed County roads adjacent to and within the project, including North Military Road and Mickelsen Parkway. The proposed development agreement requires certain improvements to North Military Road and construction of Mickelsen Parkway as well as restrictions on the use of North Military Road to protect neighbors of the project, including the Winlock School District. Motion carried 3-0. Consent Commissioner Schulte moved to approve the Consent Agenda items three through ten. Commissioner Stamper seconded the motion. 3. Resolution No. 15-373 Approval of warrants and payroll for payment. Amanda Migliaccio, Auditors Office, stated this resolution approves 294 regular warrants for a total payment against the County in the amount of $517,763.56. This also approves 239 payroll warrants dated December 18, 2015 for a total payment against the County in the amount of $270,545.00. 4. Resolution No. 15-374 Cancellation of warrants. Amanda Migliaccio, Auditors Office, stated Warrant No. 737188 was issued for an invoice that was certified and submitted for payment in error. Prior to being deemed void in finance system, the warrant needs to be cancelled by the BOCC. 5. Resolution No. 15-375 Renewing prisoner housing agreements between the Lewis County Sheriff’s Office and the Thurston County Sheriff’s Office and Olympia City Jail. Kevin Hanson, Sheriff’s Office, stated Thurston County interlocal agreement is a non- expiring agreement with annual renewal by amendment. This amendment will extend the existing contract by modifying Section 22; Duration, and will renew the contract for an additional year, ending December 31, 2016. This renewal also includes an increase of 15% to the daily bed rate bringing the new rate to sixty dollars and eighty eight cents ($60.88). This Olympia City contract is non expiring with an annual renewal by amendment. This amendment will extend the existing contract by modifying Section 21; Duration, and will renew the contract for an additional year, ending December 31, 2016. This renewal has also been modified to increase the daily bed rate 15%, which is sixty dollars and eighty eight cents ($60.88) and, at Olympia's request, a reduction of 730 annual bed days.Both contracts include new language relating to compliance with the Prison Rape Elimination Act. 6. Resolution No. 15-376 Approving a master interlocal agreement between Lewis County and other governmental agencies. 3 Tim Elsea, Director of Public Works, stated this resolution will allow Lewis County to enter into master interlocal agreements with the City of Centralia, City of Tumwater, and Washington State Parks and Recreation Commission, which will govern reimbursable work performed by Public Works forces for which the other governmental agencies do not have the capability to perform. These master interlocal agreements will replace existing agreements that will expire December 31, 2015. The term of the new agreements will be for a period of five years and expire on December 31, 2020. It appears to be in the best public interest to authorize the execution of the master interlocal agreements in order to streamline the administrative process and allow use of reimbursable work orders for routine work done by County crews for other governmental agencies. 7. Resolution No. 15-377 Approving a project agreement for office administrered programs with the State of Washington Recreation and Conservation Office for the Scammon Creek Barrier Removal Project. Tim Elsea, Director of Public Works, stated this project was awarded funds through the RCO from the Washington Coast Restoration Initiative in the amount of $184,240.00. The Scammon Creek Barrier Removal Project is funded for a restoration project to replace two existing side by side case in place box culverts, 41-1/2 feet in length, 10 feet in width and 9 feet in height located at milepost (MP) 1.010 and 1.011 on Graf Road in Lewis County, WA. The culverts are estimated to be 33% passable and were ranked 4th for replacement within the Middle Chehalis Basin Watershed Culvert Assessment, and 1st for replacement by Lewis County. When completed the project goal will restore salmon access to an additional 10.98 linear miles of potential habitat, 0.19 acres of spawning habitat, and 4.66 acres of rearing habitat for coho salmon, searun cuthroat and resident cutthroat trout. 8. Resolution No. 15-378 Approving Consolidated Homeless Grant Agreement with the Washington State Department of Commerce. April Kelley, Public Health and Social Services, stated this contract provides funds for emergency shelter, rapid re-housing, and services to families and individuals at-risk of or experiencing homelessness in Lewis County. Lewis County Social Services is the lead agency for the CHG and contracts with local service providers to provide shelter and services. 9. Resolution No. 15-379 Approving Contract Amendment No.1 with the Department of Social and Health Services, Division of Behavioral Health and Recovery. April Kelley, Public Health and Social Services, stated DSHS contracts with county governments to coordinate, subcontract, and monitor treatment and prevention programs at the local level. These funds are then contracted with local treatment agencies to provide chemical dependency treatment. The purpose of amendment No. 1 is to make changes to the contract language. These changes do not affect the program 4 in Lewis County. The period of this contract is from July 1, 2015 through March 31, 2016. This amendment start date is October 1, 2015. 10. Resolution No. 15-380 Accepting an agreement between Lewis County and WA State Military Department for FEMA Emergency Management Performance Grant. Steve Mansfield, Emergency Management, stated Lewis County Emergency Management applies annually for the EMPG grant and will receive $47,204. The contract period will run from June 1, 2015 to August 31, 2016. In the past, the grant's scope of use allowed the County to enhance the Emergency Operations Center (EOC) equipment, purchase equipment and conduct training for our county's first responders, and create community preparedness programs. Motion carried 3-0. Hearing Hearing: 2015 5th Budget Amendment Chair Fund, called for staff report and went over the hearing process. Steve Walton, Budget Administrator, stated this hearing was noticed in the East County Journal on December 9th and 16th. This amendment increases expenditures in the amount of $4,419,615 and increases revenue in the amount of $3,851,086 resulting in a use of reserves in the amount of $568,529. Chair Fund, asked if there was anyone who would like to speak for or against the franchise. There was no one. She closed the hearing and asked for a motion. Steve Walton asked that his previous comments be adopted into the record. Commissioner Schulte moved to approve Resolution No. 15-381. Commissioner Stamper seconded the motion. Resolution No. 15-381 Lewis County 2015 Budget, Emergency and Supplemental Appropriations to and Transfers within Current Expense and Other Funds. Motion carried 3-0.
