BOARD MEETING MINUTES
December 1, 2014
The Board of County Commissioners (BOCC) for Lewis County, Washington, met
in regular session on Monday, December 1, 2014, at 10:00 a.m. Commissioners
F. Lee Grose, P. W. “Bill” Schulte, and Edna J. Fund were in attendance.
Chairman Grose determined a quorum, called the meeting to order and
proceeded with the flag salute. Commissioner Fund moved to approve the
minutes from the 10:00 a.m. meeting held on Monday, November 24, 2014.
Commissioner Schulte seconded the motion.
Motion Carried 3-0
PUBLIC COMMENT
Hal Washburn, Cinebar, address the Board regarding his concerns with the new
gun law.
Bob Bozarth, Napavine, presented a letter to the BOCC regarding I-594
Robin Roy, Cinebar, discussed her concern with I-594.
NOTICE
Commissioner Schulte made a motion to approve the Notice Agenda items one
and two. Commissioner Fund seconded the motion.
1. Notice of Hearing: Regarding the 4th 2014 Budget Amendment for current
expense and other funds. Hearing will be held on or after 10:00 a.m., Monday
December 15, 2014. Resolution No. 14-312
Steve Walton, Budget Administrator, state this is a Notice of Hearing for the 4th 2014
budget amendment for Current Expense and Other Funds. Notice of public hearing will
be published in The Chronicle on December 2nd and 9th. This Hearing will be held on
December 15, 2014. The total budget amendment for all funds will be notice as a
revenue increase of $366,136.00, expenditure increase in the amount of $1,147,582.00,
for a decrease in fund balance of $781,446.00. The change in fund balance uses
previously received revenue that was not appropriated in the original 2014 budget. The
current expense portion of this amendment equates to a revenue increase of $5,000.00,
expenditure increase of $342,808.00, for a use of fund balance in the amount of
$337,808.00.

2. Notice of Hearing: Regarding the proposed revisions to Lewis County Code
6.05-Animals. Hearing will be held on or after 10:00 a.m., Monday, December
15, 2014. Resolution No. 14-313
Danette York, Director of Public Health and Social Services, stated this Resolution
proposed changes to Lewis County Code Chapter (LCC) 6.05 - Animals in order to
bring county code into compliance with the recent decision in Downy v. Pierce County
and to more efficiently handle matters related to animals within our county.
Some of the changes will:
• have a more expansive definitional section which more closely aligns with related
State laws
• more clearly delineate which prohibited activities carry criminal and civil penalties
• expand the notice requirements and procedural safeguards in place with respect to the
declaration of dangerous animals
• provide for clear guidelines related to disposition of impounded animals
• allow for Lewis County to reclaim costs associated with enforcement.
The Notice of Public hearing will be published in The Chronicle on December 2, 2014
and The East County Journal on December 3, 2014.
Motion Carried 3-0
CONSENT
Commissioner Fund made a motion to approve the Consent Agenda items three
through seven. Commissioner Schulte seconded the motion.
3. Resolution No. 14-314 Approval of warrants and payroll for payment.
Chairman Grose stated this Resolution approves 124 regular warrants for a total
payment against the County in the amount of $1,762,929.56. This also approves 235
payroll warrants dated November 20, 2014 for a total payment against the County in the
amount of $218,143.00.
4. Resolution No. 14-315 Cancellation of warrants.
Chairman Grose stated this Resolution is for the cancellation of warrants. There are
three warrants being voided:
• Chehalis Children’s Clinic for the amount of $840.00, voided and will be reissued
• Deluxe Business Checks in the amount of $608.14 voided
• Sunbirds in the amount of $14.52 voided
5. Resolution No. 14-316 Cancellation of delinquent accounts receivable invoices
from the Roads Fund 117.

Chairman Grose stated this is a cancellation of delinquent accounts receivable
invoices from the Roads Fund 117 that are deemed uncollectible. Road Fund 117
attempts to collect for the costs to repair public infrastructure damaged due to traffic
accidents. We are voiding two warrants totaling an amount of $2,725.70 which have
been sent to debt collection. All attempts to collect have been unsuccessful. It is
recommended that the Board of County Commissioners approve the write off and
cancellation of these account receivables as these invoices have been deemed
uncollectible.
6. Resolution No. 14-317 Transfer of accumulated annual and sick leave for an
employee from Public Health and Social Services Fund 104 to the County
Clerk Fund 107.
Danette York, Director of Public Health and Social Services, stated Lisa Conzatti,
Community Outreach Worker, Senior, employed by Lewis County Public Health &
Social Services Department in the Social Services Division, has received full-time
employment with the Clerk’s Office effective November 1, 2014. Lisa’s accumulated
annual leave and sick leave (half) in the amount of $271.76 will be transferred from
Social Services Fund 104 to Clerk’s Fund 107.
7. Resolution No. 14-318 Approving Tim Elsea, Public Works Director/County
Engineer as Applicant Agent and Robin Saline, Administrative Assistant,
Grants Administrator as the Alternate Applicant Agent for open, federally
declared disasters and any possible future declarations that may occur
December 31, 2014 – December 31, 2015
Robin Saline stated this Resolution is for the approval of Tim Elsea, Public Works
Director/County Engineer as Applicant Agent and Robin Saline, Administrative
Assistant/Grants Administrator as the Alternate Applicant Agent/Contact for open,
federally declared disasters and any possible future declarations that may occur
December 31, 2014- December 31, 2015. The Emergency Management Division of the
State of Washington requires Lewis County to designate an Applicant Agent and
Alternate Applicant Agent. There is a need to designate an Applicant Agent/Contact for
Lewis County in all open, federally declared disasters, and for any disasters that may
occur between December 31, 2013 and December 31, 2014.

Hearing: Ordinance 1256 renewing a moratorium upon establishment or other
development of facilities or other uses involved in the production, processing
and retail sale of marijuana and related products
Chairman Grose announced the hearing and asked for a staff report.

Lee Napier, Director of Community Development, stated the Board of County
Commissioners set a hearing date (December 1, 2014) to consider renewing the
moratorium upon establishments involved in the production, processing and retail sale
of marijuana and related products. The moratoria is adopted pursuant to the authority of
RCW 36.70A.390. This is the method by which local governments may preserve the
status quo, so that new plans and regulations will not be rendered moot by intervening
development. The County will need an additional six-month period to conduct an
appropriate land use analysis and to develop appropriate recommendations for the
Lewis County Planning Commission to consider regarding the issues.
Commissioner Grose asked if there were any questions. There were none. He closed
the question and answer portion of the hearing and opened the formal hearing.

Commissioner Schulte moved to approve Ordinance No. 1256. Commissioner Fund
seconded the motion.
ORDINANCE 1256: Moratorium in Production, Processing, and Retail Sale of
Marijuana and Related Products.

Hearing: Adoption of the 2015 Budget-Resolution 14-31 Resolution No. 14-320 –
Establishing the Property Tax Budget Levy for both current expense and road
fund
Chairman Grose announced the hearing and asked for a staff report.
Steve Walton, Budget Administrator, stated RCW Chapter 36.40 provides
requirements for the adoption of the final budgets for counties. The preliminary budget
was submitted to the BOCC and the Auditor on September 2, 2014 as required. The
BOCC has conducted various public hearings, meetings, and work sessions to consider
the 2015 annual budget for Lewis County. A notice of public hearing was published on
November 12th and 19th in The East County Journal and November 11th and 18th in The
Chronicle. Copies of the preliminary budget were placed at the Centralia College
locations in Morton and Centralia, at the Timberland Libraries in Chehalis, Centralia,
Winlock, Salkum, Randle and Packwood on September 25th. This is the second of two
hearings to take public comment and questions on next year’s budget. The final budget
sets current expense revenue at $32,152,878.00 and expenditures at $35,296,390.00.
The total revenue for all funds is budgeted at $96,360,606.00 and expenditures at
$103,108,267.00.

Ron Averill, Centralia, asked does this budget have a shift from the Roads fund to the
Sheriff’s Department for DUI.
Steve Walton stated that is not permitted this year due to the limitation on taxes and
levee amounts allowable.
Commissioner Grose asked if there were any questions. There were none. He closed

Ron Averill stated he has not specific comments on the budget. As he has stated in
the past his concerns are about the future more than the present.

Commissioner Fund moved to approve Resolution No. 14-319. Commissioner
Schulte seconded the motion.
Resolution No. 14-319 Adopting the Annual Budget of Lewis County for the
Calendar Year of 2015.
Motion Carried 3-0
Steve Walton stated approving the budget for both the General and Road levies and
approves a regular County levy increase of $116,368.78 or 1.0% over the previous
year’s levy amount of $11,636,878.19 and approves a road levy increase of
$110,911.19 or 1.0% over the previous year’s levy amount of $11,091,119.46.

Commissioner Schulte moved to approve Resolution No. 14-320. Commissioner
Fund seconded the motion.
Resolution No. 14-320 Property Tax Budget and Levy for both the Current Expense
and Road Funds.

There being no further business, the Commissioners’ public meeting adjourned
at 10:41 a.m. on December 1, 2014. The next public meeting will be held Monday,
December 8, 2014.
