BOARD MEETING MINUTES
February 11, 2013
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, February 11, 2013 at 10:00 a.m. Commissioners Bill Schulte, F.
Lee Grose, and Edna J. Fund were in attendance. Chairman Schulte determined a
quorum, called the meeting to order and proceeded with the flag salute. Commissioner
Fund moved to approve the minutes from the 10:00 a.m. meeting held on Monday,
February 4, 2013. Commissioner Grose seconded the motion.

NOTICE
Commissioner Grose moved to approve Notice Agenda items one through four.
Commissioner Fund seconded the motion.
1. Notice: Public auction of surplus county property will be held at 8:00 a.m. on
March 5, 2013 at Ritchie Brothers in Chehalis, WA. A complete list of items is
available from the Lewis County Department Public Works, Fleet Division.
Resolution No. 13-045
Tim Elsea, Director of Public Works, stated the list of vehicles and equipment
attached in Exhibit “A” were declared surplus by Resolution 13-030 on January 28,
2013. Lewis County cities and agencies will be offered the opportunity to purchase this
surplus equipment at wholesale prices. We propose that the remainder of this surplus
equipment be sold at auction on March 5, 2013. The advertising for surplus property
and sale will be completed by Lewis County in accordance with the surplus property
ordinance.
2. Notice of Hearing: Regarding the 6th 2012 Budget Amendment for current
expense and various funds. Hearing will be held on or after 10:00 am on
Monday, February 25, 2013. Resolution No. 13-046
Dawna Truman, Budget Director, stated this is a public notice that there will be a
hearing regarding the 6th 2012 budget amendment. This notice will be published in The
East County Journal on February 13th and 20th. The current proposed amendment is
$99,100.00 but this amount is subject to change.
3. Notice of Hearing: Approving the rental agreement with the Lewis County
Solid Waste Disposal District No. 1 for facilities and structures located at the
Central Transfer Station in Centralia. Hearing will be held on or after 10:00 am
on Monday, March 4, 2013. Resolution 13-047
Tim Elsea, Director of Public Works, stated Lewis County and Lewis County Disposal
District #1 entered into a rental agreement for the Central Transfer Station on April 1,

1994. Although the City of Centralia owns the property, at the Central Transfer Station,
Lewis County owns all of the structures. This agreement is a rental agreement for the
structures and all facilities located at the central transfer station in Centralia
Washington. A rental agreement for the property itself is handled through a separate
agreement with the City of Centralia. The Rental Agreement for the facilities and
structures expired December 31, 2012. This agreement will be retroactive to January 1,
2013 and will be a five-year agreement running through December 31, 2017. In
accordance with RCW 36.34.160, a notice of an intention to lease must be published at
least once a week for three weeks and be posted in a visible location in the courthouse,
also for a three-week period. A renewal agreement has been prepared in which all
terms and conditions remain the same as the 1994 agreement, except that the new
agreement calls for monthly rental payments of $51,000 payable to the County by the
District. The 1994 agreement had monthly rental payments set at $38,700, which was
renegotiated, as allowed in Section III of the Agreement, and the County and District
agreed to an increased payment amount of $51,000 per month, beginning January 1,
2010. The new agreement states that the monthly rental payment will remain at $51,000
and the first payment will be retroactively due January 1, 2013. The new agreement will
expire December 31, 2017. This resolution will provide notice of a public hearing to take
place at or after 10 AM on March 4, 2013, during which the public may appear and
comment on the renewal rental agreement for facilities and structures located at the
Central Transfer Station in Centralia.
4. Notice of Hearing: Approving the rental agreement with the Lewis County

WA. Hearing will be held on or after 10:00 am on Monday, March 4, 2013.
Resolution 13-048
Tim Elsea, Director of Public Works, stated Lewis County, as the owner of the
property, and the Lewis County Disposal District #1, a quasi-municipal corporation,
entered into a rental agreement for the East Lewis County transfer station in Morton on
August 1, 1996. This agreement expired December 31, 2012. In accordance with RCW
36.34.160, a notice of an intention to lease must be published at least once a week for
three weeks and be posted in a visible location in the courthouse, also for a three-week
period. A renewal agreement has been prepared in which all terms and conditions
remain the same as the 1996 agreement, including the monthly rental payment of
$1,859.00, which will be effective January 1, 2013 and will expire December 31, 2017.
This resolution will provide notice of a public hearing to take place at or after 10 AM on
March 4, 2013, during which the public may appear and comment on the renewal rental
agreement for the East Lewis County Transfer Station in Morton.

Commissioner Fund moved to approve Consent Agenda items five through nine.

5. Resolution No. 13-049 Approval of warrants and payroll for payment.
Commissioner Grose stated this Resolution approves 212 warrants in the amount of
$566,060.20. In addition there were 453 auto deposit warrants for payroll, 131 net pay
warrants, and 60 employee benefit deductions in the amount of $3,198,623.58 for a
total of warrants and payroll in the amount of $3,764,683.78.
6. Resolution No. 13-050 Re-appointment of Ron Averill as Director and
Commissioner F. Lee Grose as Alternate Director to the Timberland Regional
Support Network Governing Board.
Commissioner Fund stated Commissioners Ron Averill and F. Lee Grose were
previously appointed to the TRSN Governing Board as the Director and Alternate
Director respectively as per the requirements of the TRSN Governing Policies. The
appointments became vacant in December of 2012 and are being renewed for a one
year period that will end in December of 2013.
Ron Averill, Centralia, thanked the Board for allowing him the opportunity for
continuing to serve on this Board. The TRSN includes Lewis, Pacific, and Wahkiakum
Counties and its job is to provide for mental health services in the three counties. We
do that by funding providers in each county. The provider for Lewis County is Cascade
Mental Health. One reason he asked to continue with this particular committee is there
has been a large turnover and all of the other counties have replaced their
representatives on the governing board and this will help provide continuity as we bring
the other up to speed.
7. Resolution No. 13-051 Approving Title III contracts and an MOU between Lewis
County and various agencies ensuring proper use of Title III funds.
Dawna Truman, Budget Director stated On August 10, 2012, the BOCC solicited
projects and proposals from qualified applicants for Title III funds. All applications were
received in the Commissioner’s Office by August 31, 2012. After a staff review of the
projects, a decision was made by the BOCC to fund 2013 projects for Fire District No,
14 in the amount of $6,156.00, Fire District No, 18 in the amount of $14,844.00, and the
Lewis County Sheriff’s Office in the amount of $26,000.00. This Resolution will
authorize funding for the 2013 Title III projects for Lewis County Fire District 14 for the
purchase of radio repeaters, for Fire District 18 for the purchase of Personal Protective
Equipment and to the Lewis County Sheriff’s Office for the following potential equipment
options: equipment and supplies for the new multipurpose command/search vehicle;
track systems; utility trailer; rescue equipment; navigational equipment; communications
and computer equipment.
8. Resolution No. 13-052 Considering the intent to certify the Chehalis Basin
Wetland Mitigation Bank.

Lee Napier, Director of Community Development, stated under state rule, for a
wetland bank to receive state certification, both Ecology and the local jurisdiction where
the bank is located must approve and sign the Instrument (WAC 173-700-230). The
Bank is located within both Lewis County and Thurston County jurisdiction.
On January 17, 2013, Ecology transmitted a letter informing the Community
Development Director that both Ecology and the Corps of Engineers had reviewed the
Instrument and intends to approve by formally signing (i.e. certify) the Instrument. They
also requested a decision from Lewis County and Thurston County on whether or not
the respective Boards agreed with Ecology’s intent to certify the Bank.
Specifically the letter asked if the County:
• Agrees with our intent to certify the Bank, we’ll ask that your response
include the County’s intent to sign the MBI.
• Disagrees with our intent to certify the Bank, we’ll ask that your response
include the reasons for the decision.
9. Resolution No. 13-053 Bid award for the purchase of one new truck cab and
chassis.
Tim Elsea, Director of Public Works, stated a call to bid was issued by the BOCC on
January 7, 2013 by Resolution No. 13-001 for the purchase of one Truck Cab & Chassis
which is due for replacement. The proposal was advertised in the East County Journal,
Daily Journal of Commerce, and Lewis County Website. Public Works received on
responsive bid for this purchase on January 29, 2013. Kenworth NW provided two
options, which was the only responsive bide. Diagnostic software was quoted for both
engines, which would be $3,672.00 for the Paccar engine quote and no additional cost
for the Cummins engine. Factoring in the diagnostic software, the bid from Kenworth
NW with the Cummins engine is $153,145.26 which is lowest responsive. The
engineer’s estimate was $150,000.00. Valley Freightliner also submitted a bid;
however, their bid proposal engine type and horsepower did not meet specifications
listed in the call for bids. Therefore, their bid is considered non-responsive. Approval of
this Resolution will authorize an action to execute a contract between Kenworth NW and
Lewis County Public Works for the purchase of one Truck Cab &* Chassis and
authorize the Director of Public Works to sign the same.

There being no further business, the Commissioners’ public meeting adjourned at 10:24
am on February 11, 2013. The next public meeting will be held Monday, February 25,
2013, at 10:00 a.m.
