2013-04-29 Board Meeting Minutes 1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES April 29, 2013 The Board of County Commissioners for Lewis County, Washington met in regular session on Monday, April 29, 2013 at 10:00 a.m. Commissioners Bill Schulte, F. Lee Grose, and Edna J. Fund were in attendance. Chairman Schulte determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Grose moved to approve the minutes from the 10:00 a.m. meeting held on Monday, April 22, 2013. Commissioner Fund seconded the motion. Motion Carried 3-0 PUBLIC COMMENTS Leo Frare, Lewis County Tea Party, presented the National Defense Authorization Act, although necessary for the defense of the United States, contains provisions that are of concern to millions of Americans from every band in the political spectrum. Under those provisions, Americans detained as “belligerents” under the terms of the NDAA will not be tried in Article III courts, but will be subject to military tribunals and subject to indefinite detention. This is adherent to many provisions of both the Constitution of the United States and the Constitution of Washington State both of which you have taken an oath to defend. In order to help you in fulfilling that duty I have prepared a suggested “Resolution Condemning Section 1021 of the 2013 National Defense Authorization Act” and ordinances furthering that intent for your adoption. I have included a partial list of States, Counties and Cities and their position on this issue. I say partial because I have been made aware of additions that are not on that list. I have also included a letter from 40 retired admirals and generals expressing concern and support for this issue. On behalf of myself and the members of the Lewis County Tea Party, I respectfully urge you to pass this Resolution and Ordinance. Mr. Dan Townsend, Centralia, stated he is here in supported of Mr. Frare’s proposal from the Lewis County Tea Party. This is a good start that a lot of States, Counties, and Cities are going down. Colonel Ron Averill, Centralia, stated has a concern about a notice item on Airport Road. He stated there is a lot of discussion within the community about why we can’t get on the Airport Road. We are almost at phase 2 of the Mellon Street project. There is confusion that the Road is going to be opened on July 22 but we are just changing direction for access to the meat shop. He stated before this comes up for public hearing you might want to look at how this is being presented. 2 NOTICE Commissioner Fund moved to approve Notice Agenda items one and two. Commissioner Grose seconded the motion. 1. Call for Bids: For furnishing four (4) new 2013 or 2014 truck cab and chassis. Bids are due to the Clerk of the Board on May 17, 2013 by 11:00 am. Resolution No. 13-237 Tim Elsea, Public Works Director, stated the Road Maintenance Services division of the Lewis County Public Works Department has determined that four dump truck chassis (see below) in the fleet are in need of replacement as a result of the March 22, 2013 fire at the Area-7 County Road Shop in Randle, Washington. A Call-for-Bids has been prepared and bids are due by 11:00 am on May 14, 2013, to the Clerk of the Board of County Commissioners. Bids will be publicly opened at 11:30 am on May 14, 2013 at the Commissioners Meeting Room, 351 NW North St. Room 223, CMS-01 Chehalis, Washington 98532. • 7-12 2002 Sterling 229,224 miles • 7-22 2002 Sterling 242,214 miles • 7-18 2004 Kenworth 179,494 miles • 2009 Kenworth 93,175 mile 2. Notice: Regarding the temporary closure of Airport Road to all through traffic until 5:00 pm, July 22, 2013. Resolution No. 13-238 Tim Elsea, Public Works Directors, stated Resolution 13-022 approved the temporary closure of Airport Road to facilitate the reconstruction of Airport Road as part of the Louisiana Avenue to Airport Road Connection project between Mile Posts 0.64 and 1.76. The continuing project will necessitate that Airport Road between the Centralia City limits and the Chehalis City limits remain closed until 5:00 P.M., July 22, 2013 to through traffic to accommodate remaining road construction work. This end will be opened but will be closing the next end and we will have a different Road closure as of July 22, 2013. Motion carried 3-0 CONSENT Commissioner Grose made a motion to approve the Consent Agenda items three through ten. Commissioner Fund seconded the motion. 3. Resolution No. 13-239 Approval of warrants for payment. Commissioner Grose stated this Resolution approves 259 regular warrants in the amount of $681,620.59 and 1 Special Purpose District warrant in the amount of $41.86 for a total payment against the County in the amount of $681,662.45. 3 4. Resolution No. 13-240 Appointing a member to the Lewis-Mason-Thurston Area Agency on Aging Advisory Council. Danette York, Director of Public Health and Social Services, stated the Lewis- Mason-Thurston Area Agency on Aging is a governmental agency sponsored by the three counties to manage, monitor, plan, fund, coordinate and advocate for services and programs that serve the elderly and younger disabled persons. The Agency, also known as the LMTAAA, has an 18 member Advisory Council that provides input and advice to the Agency staff and makes funding and legislative recommendations to the Agency and the Agency’s Board. Six people from each county are appointed to a two-year term and can be re-appointed up to three terms. The purpose of this Resolution is to appoint Donald Owens, from Centralia, who has expressed interest in serving on the Council. Shar Nelson resigned her position which leaves an open position. 5. Resolution No. 13-241 Approving an inter-local with the Town of Pe Ell for computer and software maintenance services. Michael Strozyk, Director of Central Services, stated this agreement is for software support with our IT department as part of the public safety program. This agreement is for 2013 and 2014. The rate for 2013 is the standard $110.00 rate which includes the first 2 hours. After that it is $55 per hour during regular business hours. 6. Resolution No. 13-242 Approving a master inter-local with Lewis County Cemetery District No. 1 (Winlock). Tim Elsea, Director of Public Works, stated this Resolution will allow Lewis County Cemetery District #1 (Winlock) and Lewis County to enter into a Master Inter-local Agreement. This Agreement will govern reimbursable work performed by Public Works forces for which the municipality does not have the capability to do itself. The term of the Agreement will be for a period of 5 years and will expire on December 31, 2018. It appears to be in the best public interest to authorize the execution of the Master Inter- local Agreement in order to streamline the administrative process and allow use of reimbursable work orders for routine work done by County crews for Lewis County Cemetery District #1 (Winlock). 7. Resolution No. 13-243 Approving the purchase of used equipment at auction. Tim Elsea, Director of Public Works, stated the Road Maintenance Services division of the Lewis County Public Works Department has determined that the equipment listed in Exhibit “A” (see attached) is in need of replacement as a result of a fire on March 22, 2013 at the Area-7 County Road Shop in Randle. Ritchie Bros. Auctioneers, located in Lewis County near Napavine, may have late model equipment, in good working condition available for purchase similar to what was lost in the fire. There are several auctions in 2013, the next one scheduled for May 16, 2013. RCW 39.30.045 authorizes governmental agencies to make purchases from both government-held and private party auctions. Equipment values will be researched in advance based on year, make, 4 model, and miles/hours to assist Lewis County in determining the value of items to be purchased. Equipment at this auction will be purchased with ER&R funds 8. Resolution No. 13-244 Proposed vacation of a portion of the Boistfort-Winlock Road No. 118. Tim Elsea, Director of Public Works, stated a property owner adjoining a portion of Boistfort-Winlock Road No. 118 (King Road) has requested that the County vacate a portion of unused road right of way adjacent to a proposed mitigation area that was recently purchased from this property owner by the County for the King Road Rehabilitation Project. The property owner understands that there is a $700.00 application fee for the road vacation and has agreed to submit payment. Since this vacation is part of a county road project, one-half of the $200.00 publication cost has been waived, thereby reducing the total cost of the vacation to the property owner to $800.00. This is the amount being paid by the County to the property owner for the mitigation area. 9. Resolution No. 13-245 Approving the purchase of one (1) new pick-up truck. Tim Elsea, Director of Public Works, stated the Road Maintenance Services division of the Lewis County Public Works Department has determined that one pick-up (5-06 ) in the fleet is in need of replacement as a result of the March 22,2013 fire at the Area-7 County Shop in Randle, Washington. Bud Clary Auto in Longview, Washington offers a Dodge 4-wheel pick-up on Washington state contract (06812) with which Lewis County has an inter-local agreement (resolution 12-407). The Dodge 4-wheel drive pick-up will be purchased with ER&R funds. • 5-06 (2004 Chevrolet 4x2 pick-up, 113,000 mile 10. Resolution No. 13-246 Approving the purchase of four (4) new dump trucks and two (2) snowplows. Tim Elsea, Director of Public Works, stated the Road Maintenance Services division of the Lewis County Public Works Department has determined that four dump truck bodies and two snowplows (see below) in the fleet are in need of replacement as a result of the March 22, 2013 fire at the Area-7 County Shop in Randle, Washington. Northend Truck Equipment Inc. offers bodies and snowplows on state contract (12304C), with which Lewis County has an inter-local agreement (resolution 12-407).
