BOARD MEETING MINUTES
April 2, 2012
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, April 2, 2012 at 10:00 a.m. Commissioners F. Lee Grose, Bill
Schulte, and Ron Averill were in attendance. Chairman Grose determined a quorum,
called the meeting to order and proceeded with the flag salute. Commissioner Schulte
moved to approve the minutes from the 10:00 a.m. meeting held on Monday, March 26,
2012. Commissioner Averill seconded the motion.

Public Comment
Rose Bowman, Treasurer, introduced Arny Davis as the new Chief Deputy Treasurer.
NOTICE
Commissioner Averill moved to approve Notice Agenda item one. Commissioner
Schulte seconded the motion. Commissioner Averill read the Proclamation into the
record
1. Proclamation: Proclaiming April as “Sexual Assault Awareness Month”.
Katie Gray, Human Response Network, spoke about the Human Response Network
and what they are doing to provide awareness and prevention for sexual violence.
Motion Carried 3-0
Commissioner Averill moved to approve Notice Agenda item two. Commissioner
Schulte seconded the motion. Candace Hallom read the item into the record.
2. Call for Bids: For the 2012 USFS Crushed Screenings and CSTC Proposal.
Bids are due by 11:00 am to the Clerk of the Board on April 17, 2012.
Resolution No. 12-103
Tim Elsea, Director of Public Works, stated on February 15, 2012, the US Forest
Service (USFS -- Cowlitz Valley Ranger District) received a construction grant award
from Western Federal Lands’ Washington Forest Highway Pavement Preservation
Program to repair Forest Highway Road 52 (Skate Creek Road). The USFS does not
have equipment or capability for hard surface road construction. Therefore, Lewis
County co-sponsored the original grant that proposed construction via Lewis County’s
low cost roadway rehabilitation – Countywide 3R Program. Road 52 (Skate Creek) is
maintained by the USFS but Lewis County can provide any level of rehabilitation
through our previously established inter-agency agreement (Schedule A roadway).

Lewis County will be reimbursed directly from Western Federal Lands for completed
road work. The proposed contract will allow Lewis County to purchase Crushed
Screenings & Crushed Surfacing Top Course (CSTC) for the 2012 3R Program US
Forest Service reimbursable work. The 3R Program is listed as number 1 on Lewis
County’s previously adopted 2012 Six Year Transportation Improvement Program. This
material purchase will allow Lewis County crews to complete approximately 1.5-miles of
Cement Treated Base (CTB) and approximately 1.5-miles (from M.P. 15.7 to M.P. 17.2)
of Chipseal/Bituminous Surface Treatment during the 2012 summer construction
season. Crushed Screenings and CSTC material will be purchased under Fund 506
(Pits & Quarries) and will be charged to the Reimbursable Work Number for the
construction/maintenance activity. Sealed bids for the 2012 USFS Crushed Screenings
& CSTC Proposal shall be submitted to the Clerk of the Board of Lewis County
Commissioners (351 N.W. North Street, Room 210, CMS-01, Chehalis, Washington
98532), by or before 11:00 A.M. on Tuesday, April 17, 2012 and will be opened on or
after 11:30 on April 17, 2012. Bids submitted after 11:00 AM will not be considered for
this project.

CONSENT
Commissioner Schulte moved to approve Consent Agenda items three through nine.
Commissioner Averill seconded the motion. Candace Hallom read the items into the
record.
3. Resolution No. 12-104 Approval for warrants for payment.
Commissioner Averill stated this Resolution approves 5 Special Purpose warrants
(Vader Water System) for $516.60 and 82 warrants issued by the Auditor’s Office for
$438,118.49, totaling $438,635.09.
4. Resolution No. 12-105 Bid award for the 2012-2013 County Legal Printing.
Commissioner Averill stated this Resolution approves and awards the best and lowest
qualified bid, per specifications, at $6.60 per column inch to DeVaul Publishing, Inc.
(East County Journal) to serve as the official county newspaper for legal publications.
This contract is for the period beginning July 1, 2012 and ending June 30, 2013.
5. Resolution No. 12-106 Authorizing the sale, issuance and deliver of the
County’s limited tax general obligation refunding bonds Series 2012.
Rose Bowman, Treasurer, stated in 2003 the County issued bonds to build the Lewis
County Jail. Those bonds can be called December 1, 2012. What we are looking at is
a really lucrative market for refunding. Under the advice of Susan Mussulmen and Roy
Koegen, of SDM Advisors, Inc. (Lewis County Treasurers Office Financial Consultants),
we feel that it is time for the County to proceed with the issuance and sale of refunding
bonds to refinance the limited tax general obligation bonds, series 2003, subject to
market conditions and call the bonds on December 1, 2012. The savings for the County

will depend on the pricing on the day that we go to sale on these bonds. The estimates
range from $500,000.00 to $1 million. We are not extending the life of the bonds we are
just refinancing them.
Roy Koegen, Koegen Edwards, stated interest rates right now are near the lowest
they have been since the mid 60’s. This resolution delegates the authority to determine
the time of sale, between April and December 2012.
6. Resolution No. 12-107 Approving an inter-agency agreement between Lewis
County, Lewis County Noxious Weed Control Board, and the State Department
of Ecology for the management of invasive Brazilian elodea.
Bill Wamsley, Weed Control Board, stated this is an inter-agency agreement with the
Department of Ecology. The funding would be used to manage Brazilian elodea at
Plummer Lake in Centralia. The goal is to eradicate elodea in Plummer Lake using
divers hand pull the weed barriers. The funding is in the amount of $29,000.00 and it is
anticipated that $9,715.00 will be spent in the current funding year.
7. Resolution No. 12-108 Appointments to the Lewis County Noxious Weed
Control Board.
Bill Wamsley, Weed Control Board, stated the Lewis County Noxious Weed Control
Board has two vacancies on its five member board. The vacancies occur in Weed
District Two and District Five. Two Board members have indicated they would be willing
to serve another term so the Resolution appoints Paul Figueroa to weed district two and
Victor Khvoroff to weed district #5. No other landowners expressed an interest in the
positions at this time.
8. Resolution No. 12-109 Approving the inclusion of the Town of Bucoda as a
member of the Chehalis River Basin Flood Control Authority, should the Town
formally request such membership.
Glenn Carter, Prosecutors Office, stated earlier this year the Town of Bucoda
indicated that they would withdrawal from the Flood Authority. They have now
reconsidered that withdrawal. What this resolution would do is permit the execution of
an amended inter-local agreement that would be signed by the Chairman of the Board
in the instance that the Town of Bucoda does express their interest in participating.
Commissioner Averill asked for clarification. He received an email forwarded by Lara
Fowler from Shelly Smith who is the Clerk/Treasurer for the Town of Bucoda. At the last
Flood Authority meeting there was a considerably long discussion. Although Bucoda
had withdrawn from the Flood Authority it was stipulated that it was effective within 30
days. In the March meeting they claimed the inter-local gave them 90 days and that
they were not out yet and have changed their minds about withdrawing. The Flood
Authority voted that they were indeed out and voted Cosmopolis and Napavine in.
However, the Flood Authority welcomed Bucoda back in if they requested. The email

received by the Commissioner does not request to come back in but says they are not
out.
Glenn Carter stated the letter was somewhat vague and he believes it indicates an
interest on the part of the Town of Bucoda participating in the Flood Authority. There is
no question at the last meeting of the Flood Control Authority that there was a great
deal of discussion with respect to the effective date of the withdrawal and whether it was
effectively rescinded.
9. Resolution No. 12-110 Authorizing legal defense and indemnity for two Lewis
County employees.
Paulette Young, Risk Manager, stated Lewis County Sheriff Steve Mansfield & Lewis
County Jail Administrator Kevin Hanson have been named in a legal action filed in the
United States District Court for the Western District of Washington, for allegations of
actions taken while in the course and performance of their duties for Lewis County.
Sheriff Steve Mansfield & Kevin Hanson have requested defense and indemnification,
pursuant to Resolution 03-042 and 04-164. Under this resolution the County will
indemnify and David Fine, Senior Deputy Prosecuting Attorney, will be providing legal
defense for Sheriff Mansfield and Jail Administrator Kevin Hanson.
Commissioner Averill stated regarding item 8 he is would like to stipulation that we
need clarification on whether we need to have a formal request.
Chairman Grose stated this resolution is conditional upon Bucoda reapplying to the
Flood Authority for admission to the Flood Authority.
Commissioner Schulte asked for clarity whether the email from Bucoda is not going to
be considered a formal request.
Chairman Grose stated he feels that is the way we view it, as not a formal request.

There being no further business, the Commissioners’ public meeting adjourned at 10:37
am on April 2, 2012. The next public meeting will be held Monday, April 9, 2012, at
10:00 a.m.
