BOARD MEETING MINUTES
June 11, 2012
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, June 11, 2012 at 10:00 a.m. Commissioners F. Lee Grose, Bill
Schulte and Ron Averill were in attendance. Chairman Grose determined a quorum,
called the meeting to order and proceeded with the flag salute. Commissioner Averill
moved to approve the minutes from the 10:00 a.m. meeting held on Monday, June 4,
2012. Commissioner Schulte seconded the motion.

NOTICE
Commissioner Schulte moved to approve Notice Agenda items one and two.
Commissioner Averill seconded the motion. Candace Hallom read the items into the
record.
1. Notice of Hearing: Regarding the 3rd 2012 budget amendment for Current
Expense and Various Funds. Hearing will be held on or after 10:00 am on
Monday, June 25, 2012. Resolution No. 12-185
Dawna Truman, Budget Director, stated a notice will be published in The East County
Journal on June 13 and 20, 2012. This notice is in the amount of $1,704,685.00, a
revenue offset of $418,944.00, and use of fund balance of $1,285,741.00. The noticed
amount is subject to change up to the time of the hearing.
Commissioner Averill stated when we talk about fund balance it is not of the general
fund, there are a number of fund balances involved in this.
Commissioner Schulte stated a large part of this amendment is for when we take over
the seniors program on July 1, 2012.
Dawna Truman stated there is a little over $200,000.00 being transferred from Current
Expense to Fund 199 to reinstate the Senior Enrichment Program.
2. Notice of Hearing: Regarding the 1st 2012 budget amendment for the Vader
Water System fund. Hearing will be held on or after 10:00 am on Monday, June
25, 2012. Resolution No. 12-186
Dawna Truman, Budget Director, stated this is increasing expenditures in the amount
of $5,000.00 and use of fund balance in the amount of $5,000.00. This notice will be
published in The East County Journal on June 13 and 20, 2012.

Commissioner Averill noted the hearing will be on June 25, 2012 and the total noticed
amounts are subject to change up to the time of the hearing.

CONSENT
Commissioner Averill moved to approve Consent Agenda items three through eight.
Commissioner Schulte seconded the motion. Candace Hallom read the items into the
record.
3. Resolution No. 12-187 Approval of warrants and payroll for payment.
Commissioner Averill stated this Resolution approves 1 Special Purpose warrant
(Vader Water System) for $134.92 and 223 warrants issued by the Auditor’s Office for
$829,890.18, totaling $830,025.10.
4. Resolution No. 12-188 Cancellation of warrants.
Commissioner Averill stated this Resolution approves cancellation of three (3)
warrants totaling $434.90, issued by the Lewis County Auditor, that were lost or
destroyed and authorizes reissue.
5. Resolution No. 12-189 Re-appointment of members to the Lewis County
Developmental Disabilities Advisory Board.
Tara Smith, Social Services, stated this Resolution is for the re-appointment of Patti
Nelson, Barbara Burnett, Nancy Keaton, Virginia Zamudio, and Kathie Taylor to the
Lewis County Developmental Disabilities (DD) Advisory Board. The DD Board has
approved the re-appointments and requests approval from the BOCC. The re-
appointments will maintain the number of board members at nine. The board currently
consists of nine members. The re-appointments are to maintain the number of current
board members since no successors have applied for their positions. Barbara, Nancy,
and Kathie are stakeholders in District 1 and Patti and Virginia are stakeholders in
District 2. They have been on the board for the past three years and have been valuable
members.
6. Resolution No. 12-190 Approving a professional service agreement with Daniel
Henderson as the Veteran’s Benefit Specialist.
Commissioner Averill stated this Resolution approves a Professional Services
Agreement between Lewis County and Daniel Henderson as the Veterans Benefit
Specialist (VBS). This is a two year renewal of a contract which is expiring and is for
the period June 7, 2012 through June 6, 2014. The agreement is for 1020 hours of

service per year at a compensation of $20,400.00 per year. The Veterans Benefit
Specialist provides services and information regarding resources available to local
indigent veterans and/or their dependents. Some veterans are unaware of many
resources available to them and the VBS’s role is to interview each veteran applying for
assistance and help them locate resources to help them through their time of need. The
VBS is responsible for knowing veteran benefits and how to apply for assistance.
Dan Henderson, Veterans Benefits Specials, thanked the BOCC for the renewal of
this contract. He stated the past two years have been a great learning experience and
has been very rewarding. There are not many people that get to do the work that he
gets to do and it is an honor to be able to provide this service to our area veterans.
7. Resolution No. 12-191 Acceptance of a Federal Highway Program Agreement
with Western Federal Lands Highway Division (FHWA) for the Skate Creek
Road Improvements Project.
Tim Elsea, Director of Public Works, stated the US Forest Service was awarded
$300,000 from the Federal Lands Highway Program through the Federal Highway
Administration – Western Federal Lands Highway Division for improvements on Skate
Creek Road. The improvements to Skate Creek Road consist of Cement Treated Base
(CTB) and Bituminous Surface Treatment (BST) between US Forest Service mileposts
15.70 and 17.20, for a length of 1.50 miles. Resolution 09-335 approved an agreement
between Lewis County and the US Forest Service for cooperative maintenance of US
Forest Service roads. Schedule A identifies Skate Creek Road as the responsibility of
the US Forest Service, but on which Lewis County may at its option participate in
improvements. This resolution is to approve acceptance of FHWA Agreement No.
DTFH70-12-E-00029 by the Board of County Commissioners and authorize the Director
of Public Works to sign the agreement for reimbursement of expenses for this funded
project. We are trying to improve 1.5 miles of Skate Creek Road through the CTB
process. We started the CTB reconstruction of the County Roads this morning. This is
a grant application that the County went into with the Forest Service to improve this
section of road. This agreement is between FHWA and the County so we can be repaid
directly.
8. Resolution No. 12-192 Transfer of a nonexclusive franchise from Rupert
Umphress to Fredrick Nicoll to install, operate, maintain, and repair a water
line on Tauscher Road right of way.
Tim Elsea, Director of Public Works, stated on September 18, 1989, Lewis County
issued a 45 year franchise to Rupert Umphress for the installation, operation,
maintenance and repair of a water line within the Tauscher Road right of way. The
water line serves the residence of Mr. Umphress at 625 Tauscher Road. Mr. Umphress
subsequently sold the property to Brian and Denice Vincent, who then sold the property
to Frederic and Laurie Nicoll. The franchise issued to Mr. Umphress has a provision for

transfer and Mr. Nicoll has applied for transfer of the franchise. This resolution would
approve transfer of the Tauscher Road franchise to Fred Nicoll.

HEARING
Hearing: Non–exclusive franchise Harmony Park Lot owners association.
Resolution No. 12-193
Chairman Grose announced the hearing and asked for a Staff Report.
Larry Unzelman, Real-estate Service Manager, stated the Harmony Park Lot Owners
Association has requested renewal of a non-exclusive franchise for the construction,
operation and maintenance of a water system on Lake Road, Steelhead Drive, and
Silver Lane rights-of-way in Lewis County. Their existing franchise expires on July 8,
2012. This non- exclusive franchise will authorize the use of these road rights-of-way for
their water system for an additional 5 years. Resolution 12-152 passed by the BOCC
on May 14, 2012, set June 11, 2012 as the date for hearing on the matter. This non-
exclusive franchise to construct, operate and maintain a water system within Lake
Road, Steelhead Drive, and Silver Lane rights-of-way is being granted pursuant to and
in conformance with RCW 36.55 and Lewis County Code 12.25 through 12.50. RCW
36.55 requires that no hearing be held on a proposed franchise grant until 5 days after
the last publication date, and 15 days after posting of the notice thereof in three public
places. Publication must be twice in the official newspaper for publication in the County.
Publication occurred on May 16 & 23, 2012 in The East County Journal and May 17 &
24, 2012 in The Chronicle, and the franchise was posted in three public places.
Chairman Grose asked if there were any more questions. There were none. He closed
the question and answer portion of the hearing and opened the formal hearing.
Larry Unzelman asked that his previous comments be adopted into the record.
Chairman Grose asked if there were any other statements for public testimony. There
were none. He closed the hearing and asked for a motion.
Commissioner Schulte moved to approve Resolution No. 12-193. Commissioner
Averill seconded the motion. Candace Hallom read the item into the record.
Resolution 12-193 In the Matter of a Renewal of nonexclusive Franchise to
Harmony Park Lot Owners Association to construct, operate and maintain a water
system in Lewis County Rights-of-Way; and setting forth conditions
accompanying a grant of a non-exclusive Franchise; and providing for County
Administration and regulation of the non-exclusive Franchise.
Motion Carried 3-0

There being no further business, the Commissioners’ public meeting adjourned at 10:22
am on June 11, 2012. The next public meeting will be held Monday, June 18, 2012, at
10:00 a.m.
