2012-10-01 Board Meeting Minutes 1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES October 1, 2012 The Board of County Commissioners for Lewis County, Washington met in regular session on Monday, October 1, 2012 at 10:00 a.m. Commissioners F. Lee Grose, Bill Schulte, and Ron Averill were in attendance. Chairman Grose determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Schulte moved to approve the minutes from the 10:00 a.m. meeting held on Monday, September 24, 2012. Commissioner Averill seconded the motion. Motion Carried 3-0 Commissioner Averill moved to make corrections to the agenda. Consent Item 4 needs to be tabled until further notice. There is also a hearing that did not get included onto the agenda regarding a non-exclusive Franchise to Gunderson W ater Works. This hearing was noticed on September 10, 2012, and needs to be heard today. Commissioner Schulte seconded the motion. Motion Carried 3-0 PUBLIC COMMENT Chairman Grose asked for public comment and there was no comment. CONSENT Commissioner Schulte moved to approve Consent Agenda items one through three. Commissioner Averill seconded the motion. Candace Hallom, Administrative Assistant, read the items into the record. 1. Resolution No. 12-303 Approval of warrants for payment. Commissioner Averill stated this Resolution approves 284 warrants issued by the Auditor’s Office totaling $655,449.43. 2. Resolution No. 12-304 Accepting a deed of additional right of way for Goodrich Road, Centralia, WA. Larry Unzelman, Real-Estate Service Manager, stated The City of Centralia has approved a short plat for property owners Gary and Roberta Sjoblom on their property within the City’s Urban Growth area. The property has frontage on Goodrich Road, being a county road. As a condition of the short plat, the City of Centralia has required the property owners to deed 15 feet of additional right of way approx. 229.98 feet in length for Goodrich Road to the County for future upgrading to the road. 2 3. Resolution No. 12-305 Approving a proposed vacation of portions of various roads in Lewis County. Larry Unzelman, Real Estate Services Manager, stated a property owner adjoining a portion of Boyd Road has requested that the County vacate a portion of the J.A. Boyd Road and the J.W. Isbell Road and the Winston Creek Road or O.W. Wallace Road. There are four other property owners adjoining these adjoining roads and they have also signed the vacation request. Any and all interests other than the requesting parties will be evaluated as part of the Engineer’s Report. They have deposited a check to cover administrative and publication costs of the vacation, non-refundable once this resolution is signed, regardless of the findings and recommendations of the Engineer. Passing this resolution would instruct the Engineer to examine the road, evaluate the request, and file an Engineer’s Report, as required by RCW 36.87.010 and LCC 12.15. I have attached a copy of the request from the property owners. Commissioner Averill stated this Resolution is for the County Engineer to review the request for vacation. This does not vacate the property. Motion Carried 3-0 HEARING • Hearing:2013 Preliminary Budget-Resolution No. 12-307 Chairman Grose announced the hearing and asked for a Staff Report. Dawna Truman, Budget Director, stated copies of the Preliminary Budget and brief are available at the front of the room. RCW Chapter 36.40 provides requirements for the adoption of the preliminary and final budget for counties. This Preliminary Budget was submitted to the BOCC and Auditor on September 4, 2012. Budget meetings are under way which allow Elected Officials and Department Directors an opportunity to discuss their individual budgets with the BOCC. A notice of hearing was published on September 19th and 26th in the East County Journal and the 20th and 27th in the Chronicle. Copies of the Preliminary Budget were placed in Centralia College locations in Morton and Centralia as well as Timberland Libraries in Salkum, Packwood, and Chehalis on September the 26th. This is the first of two hearings to take public comment. There will be an evening public presentation of the Preliminary Budget on October 19, 2012 at the Lewis County Courthouse. The Preliminary Budget sets the current expense revenue at $31,648,846.00 and expenditures at $34,136,514.00. This Preliminary Budget sets current expense expenditures $158,148.00 higher than the 2012 budget and revenue has been set lower by $1,064,804.00. This is only a preliminary estimate which will be reviewed this month after third quarter revenues have been received. Total preliminary revenue is $91,818,335.00 and expenditures at $99,854,107.00. This is the appropriated amount that does not include fund balances as you see in the resolution. 3 Chairman Grose asked if there were any more questions. There were none. Resolution 12-307 Adopting the Preliminary Budget of Lewis County for the Calendar Year of 2013. Motion Carried 3-0 • Hearing: Non-exclusive Franchise to Gunderson Water Works Resolution No. 12-308 Chairman Grose announced the hearing and asked for a Staff Report. Larry Unzelman, Real Estate Services Manager, stated Gunderson Water Works has requested a non-exclusive franchise for the construction, operation and maintenance of water facilities on Jackson Highway and Panorama Drive rights of way in Lewis County. Their existing franchise expires on October 14, 2012. This non-exclusive franchise will authorize the use of these road rights of way for their water facilities for an additional 5 years. Resolution 12-283 passed by the BOCC on September 10, 2012, set October 1, 2012 as the date for hearing on the matter. This non-exclusive franchise to construct, operate and maintain water facilities within Jackson Highway and Panorama Drive rights of way is being granted pursuant to and in conformance with RCW 36.55 and Lewis County Code 12.25 through 12.50. RCW 36.55 requires that no hearing be held on a proposed franchise grant until 5 days after the last publication date, and 15 days after posting of the notice thereof in three public places. Publication must be twice in the official newspaper for publication in the County. Publication occurred on September 12 & 19, 2012 in The East County Journal and September 13 & 20, 2012 in The Chronicle, and the notice of franchise was posted in three public places. Resolution 12-308 In the Matter of a nonexclusive Franchise to Gunderson Water Works to construct, operate, and maintain Water System Facilities in Lewis County Rights-of-Way: and setting forth conditions accompanying a grant of nonexclusive Franchise; and providing for County administration and regulation of the nonexclusive Franchise. Motion Carried 3-0 There being no further business, the Commissioners’ public meeting adjourned at 10:26 am on October 1, 2012.
