2012-11-05 Board Meeting Minutes 1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES November 5, 2012 The Board of County Commissioners for Lewis County, Washington met in regular session on Monday, November 5, 2012 at 10:00 a.m. Commissioners F. Lee Grose, Bill Schulte, and Ron Averill were in attendance. Chairman Grose determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Averill moved to approve the minutes from the 10:00 a.m. meeting held on Monday, October 29, 2012. Commissioner Schulte seconded the motion. Motion Carried 3-0 PUBLIC COMMENT Chairman Grose asked for public comment and there was no comment. PROCLAMATION Commissioner Schulte moved to approve Proclamation Agenda item one. Commissioner Averill seconded the motion. Commissioner Averill read the Proclamation into the record. 1. Proclamation: Proclaiming November 16, 2012 as National Adoption Day. Commissioner Averill stated Lewis County recognizes the importance of giving children permanent, safe and loving families through adoption. More than 1,500 foster children in the Washington foster care system (and 107,000 nationwide) have legally lost their parents forever and are waiting to be adopted into permanent families. More than 28,000 children “age out” of the foster care system without ever finding a permanent home and family. Outreach to adoptive families has been identified as a critical step in moving children more quickly out of the foster system and into loving homes. To help these children find permanent, nurturing families, Lewis County Superior Court is joining courts nationwide in support of National Adoption Day to raise awareness in communities of the many children waiting to find homes and to give them a chance to join new families. The Lewis County Board of County Commissioners urges all citizens to join in the national effort to raise awareness of the importance of adoption. Judge Roewe stated presently we have between twelve to sixteen prospective adoptions scheduled for November 16, 2012. We look forward to the adoption. We have one private and one that is going to be out of State and all the rest will be done in the Courtroom. After the conclusion of the adoption we are going to have a reception with refreshments to celebrate the adoptions. Motion Carried 3-0 2 NOTICE Commissioner Averill moved to approve Notice Agenda items two through five. Commissioner Schulte seconded the motion. Candace Hallom read the items into the record. 2. Notice of Hearing: Accepting the established change in Chandler Road and Doty Dryad Road. Hearing will be held on or after 10:00 am on December 3, 2012. Resolution No. 12-337 Tim Elsea, Director of Public Works, stated a new Chandler bridge was needed to replace the bridge washed out in the 2007 flood. To meet current construction standards it was necessary to move the bridge from its past location. A resolution passed by the Board of County Commissioners on September 28, 2009, ordered the County Engineer to examine and if necessary, survey Chandler and Doty Dryad roads, acquire all necessary rights-of-way, and report his findings. Since that time, the necessary right of way has been acquired by deed and recorded, the roads have been reconstructed to present county road standards and the new bridge has been built, all as stipulated in the accompanying engineer’s report. Submitted herewith are the County Engineer’s report and a resolution which would set a hearing date for the establishment of the change in Chandler Road and Doty Dryad Road in accordance with the provisions of RCW 36.81.070. 3. Notice of Hearing: Regarding the adoption of the Six Year Transportation Improvement Program and the Annual Construction Program. Hearing will be held on or after 10:00 am, on November 19, 2012. Resolution No. 12-338 Tim Elsea, Director of Public Works, stated Pursuant to RCW 36.81.121, all counties are required to prepare, adopt and submit a six-year transportation improvement program. Copies of this program are to be furnished to WSDOT, CRAB, and the Transportation Improvement Board. The requirements for the Annual Construction Program are contained in WAC 136.16. This part of the WAC is intended to provide for an evaluation of compliance with the county forces construction limits outlined in RCW 36.77.065. The 2013 Annual Construction Program includes the following construction projects: • Countywide 3R - approximately 5 miles of Cement Treated Base with a Bituminous Surface Treatment by county forces • Countywide Paths & Trails • Countywide Misc. Safety & Guardrail • Countywide Bridge/Road Bank Protection • Skate Creek Rd S., MP 0.53, Bridge #12 Scour Mitigation • Federal Forest Road Improvements • Swofford Road Rehabilitation • County Road Safety Program (Guardrail) • King Road Rehabilitation 3 A hearing for the six-year program must be held prior to the adoption. The public hearing will be held November 19, 2012. The notice of hearing will be published in The Chronicle and East County Journal on November 7th and 14th and in the Chronicle on November 8th and 15th. Additionally, Lewis County staff presented the proposed 2013 - 2018 six- year TIP at the monthly Mayors meeting with the Board of County Commissioners on October 5th, the Planning Commission meeting on October 9th, the Lewis County Transportation Strategy Council meeting on October 15th, and the Centralia City Council meeting on October 23rd. 4. Notice of Hearing: Regarding an Ordinance adopting a new chapter to the Lewis County Code and establishing an Impact Fee Program for transportation and schools. Hearing will be held on or after 10:00 am, on November 26, 2012. Resolution No. 12-339 Tim Elsea, Director of Public Works, stated the State of Washington enacted the Growth Management Act and amended RCW 82.02 to authorize the collection of impact fees from new development under specified conditions. Lewis County has adopted a GMA Compliant Comprehensive Plan that includes a Capital Facilities Element and is in the process of amending that Capital Facilities Element to comply with the requirements of RCW 82.02 for the imposition of impact fees. The Lewis County Board of Commissioners (Board) finds that new growth and development in Lewis County will create additional demand and need for transportation facilities and school facilities. Pursuant to the authority of RCW 82.02, the Board chooses to deliberate whether new growth and development should pay a proportionate share of the costs of the new transportation facilities and school facilities that will serve that new growth and development. November 26, 2012 at or after the hour of 10:00 a.m., has been fixed by the Board as the time and place for the hearing to consider the adoption of Lewis County Code 18.20. Commissioner Averill stated we are not passing impact fees today this is merely a hearing that we will be holding on these impact fees. There has been a development in planning for a number of years which is called a fully contained community. The owner of the development has come to the Board and asked us to make a decision on whether to approve that development. As part of that approval process is the matter of impact fees because the law says if you have a fully contained community you must have impact fees. It is also a fact that about five or six of the local school district had plans put into the Capital Facilities element of our growth management plan to impose school impact fees. 5. Notice of Hearing: Regarding the adoption of the 2013 Final Budget. Hearing will be held on or after 10:00 am on December 3, 2012. Resolution No. 12-340 Dawna Truman, Budget Director, stated this is a Notice of Public Hearing for the final budget for 2013. The Notice of Hearing will be published in The East County Journal on November 14 and 21, 2012 and in The Chronicle on November 15 and 24, 2012. We have provided a PSA to all of the newspapers and local radio stations. The BOCC will 4 meet on Monday December 3, 2012 on or after 10:00 am in the Lewis County Courthouse for the purpose of taking public comment on and fixing the Lewis County final 2013 budget. There will be a public presentation that will be held on November 19, 2012 at 5:30 pm at the Lewis County Courthouse BOCC hearing room. Motion Carried 3-0 CONSENT Commissioner Schulte moved to approve Consent Agenda items six through ten. Commissioner Averill seconded the motion. Candace Hallom, Administrative Assistant, read the items into the record. 6. Resolution No. 12-341 Approval of warrants and payroll for payment. Commissioner Averill stated this Resolution approves 277 warrants issued by the Auditor’s Office totaling $667,866.85. Also approves 455 automatic deposits checks totaling $1,233,941.73; and, 146 payroll warrants for net pay, and 62 payroll warrants for benefits/deductions for a total of $3,147,235.34, including automatic deposits. 7. Resolution No. 12-342 Appointing Lee Napier as the Director of Community Development. Commissioner Averill stated this Resolution approves the appointment of Lee Napier as the Lewis County Director of Community Development effective November 5, 2012. There were over 40 applicants from whom twelve were identified as top candidates and four were selected to participate in an interview. Lee Napier was a unanimous decision among the finalists as the first candidate of choice. This resolution approves the contract agreement between Lewis County and Ms. Napier. Her salary is initially set at Grade 32, Step G ($90,132.00). 8. Resolution No. 12-343 Approving an inter-local agreement with Lewis County Fire District #1 (Onalaska) for computer and software maintenance services. Michael Strozyk, Director of Central Services, stated this is a renewal of an inter- local agreement with the Lewis County Fire District (LCFD) #1 for computer and software maintenance services. Lewis County Informational Technology (IT) provides services to the fire departments and police agencies within Lewis County to help maintain their Spillman software which is owned and operated by the 911 Center. This agreement will allow LCFD#1 to have laptops in their aid units, fire trucks, and at their station so they can access the Spillman records and also see the computerized dispatch screen in the live mode. This agreement is for two years and expires December 31, 2014. This is an as you need agreement were there is a $110.00 minimum fee per year which included the first two hours. Every hour after that is $55.00 per hour. 9. Resolution No. 12-344 Approving a master inter-local with Lewis County Flood Control District No. 1. 5 Tim Elsea, Director of Public Works, stated this Resolution will allow Lewis County Flood Control District No. 1 (Chehalis Industrial Commission) and Lewis County to enter into a Master Inter-local Agreement. This Agreement will govern reimbursable work performed by Public Works forces for which Lewis County Flood Control District No. 1 does not have the capability to do themselves. The term of the Agreement will be for a period of 5 years and will expire on December 31, 2017. This will allow us to help the Flood Control District with culvert replacement projects and hydrology reports. This is a single project maximum of $20,000.00 and a $50,000.00 aggregate per year. 10. Resolution No. 12-345 Approving an easement to NOANET Corporation for underground Fiber optic utilities. Tim Elsea, Director of Public Works, stated Northwest Open Access Network Corporation (NoaNet) has requested an easement for underground fiber optic utilities over a 30’ x 75’ portion of the Southwest Washington Fairgrounds property. They have, by permit, already installed an underground fiber optic vault on the easement. The installation of the underground vault has not and will not interfere with current or planned operations at the fairgrounds. The easement is granted for mutual benefit as it will benefit the fairgrounds and other nearby customers. Motion Carried 3-0 There being no further business, the Commissioners’ public meeting adjourned at 10:30 am on November 5, 2012.
