BOARD MEETING MINUTES
January 24, 2011
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, January 24, 2011, at 10:00 a.m. COMMISSIONERS RON
AVERILL, P.W. SCHULTE, and F. LEE GROSE were in attendance. Chairman
Averill determined a quorum, called the meeting to order and proceeded with the
flag salute. Commissioner Grose moved to approve the minutes from the 10:00
a.m. meeting held on Monday, January 10, 2011. Commissioner Schulte seconded
the motion.
Motion carried 3-0
NOTICE
Commissioner Schulte made a motion to approve Notice Agenda items one
through three. Commissioner Grose seconded the motion. Candace Hallom read
the items into the record.
1. Notice of Hearing: Regarding applications for classifications of various
land parcels under RCW 84.34. Hearing will be held on February 7, 2011, on
or after 10:00 am.
Dianne Dorey, Assessor, stated the Legislature granted the Legislative Body of
each County (BOCC) the authority to classify certain land in Open Space Timber.
These are properties between five and twenty acres that grow and harvest
commercial timber. The program is meant to be long term to promote the
perpetuation of timber.
Chairman Averill stated under the Growth Management Act we have Forest Lands
of Long Term Commercial Significance the smallest parcel on one of those is 80
acres. We also have Forest Land of Local Significance which can be divided down
to 20 acres. In this case we are talking about much smaller plots on which timber is
being grown.
Dianne Dorey stated this is for tax purpose only and has nothing to do with the
zoning. The tax break received on the land value is around 90% less than the
market value.
Commissioner Grose asked if we physically inspect the properties to see if they
actually are growing timber or do we do aerial photos.

Dianne Dorey stated we do physical inspections and talk with the land owners so
they know what their tax consequences are. If they choose not to grow timber in
the future then they are removed from the program and have to pay back taxes.
Chairman Averill noted that this is a smaller group then we have had in the past.
There are only twenty two parcels that we are looking at.
Commissioner Schulte asked what the requirement is to be put in this program.
Diane Dorey stated they look at the DNR stocking requirements.
2. Notice of Hearing: Regarding the dissolution of all existing flood control
zone districts and the creation of three new flood control zone districts.
Hearing will be held on February 14, 2011, on or after 10:00 am. Resolution
No. 11-015
Robert Johnson, Director of Community Development, stated this is a notice of
public hearing and notice of intent to dissolve all existing flood control zone district
and subzone districts. Currently the County has a County Wide Flood Control Zone
District (FCZD) established first in 1973 and then subsequently again in 1997.
Chairman Averill stated the County Wide FCZD was created in 1973 and
subsequently became non-functional. A second County Wide FCZD was formed in
1997 with no apparent record of formal dissolution of the 1973 FCZD.
Robert Johnson stated we currently have subzone districts for the Chehalis,
Cowlitz, and Nisqually River. The plan is to establish one or more zone district for
each of the major basins. Initially, the BOCC intends to establish the Chehalis Basin
Flood Zone District and then at a future date at their discretion may adopt additional
zone district for the Cowlitz and Nisqually. Notice will be published in The Chronicle
and The East County Journal. Hearing will be held on February 14, 2011. Notice will
be provided to the Boundary Review Board who has jurisdiction over this matter.
Chairman Averill stated this is a housekeeping matter. Hugh Spitzer, who is the
attorney working with FCS Consultants on Formation of a Basin Wide Flood Control
District, was concerned we had not dissolved the 1973 FCZD and the 1997 FCZD
and the subzone districts crossed lines. Legislation requires there cannot be more
than one district in a geographic area. To create the Basin Wide FCZD we need to
form districts in each of the Counties and then put them together with an interlocal
agreement.
3. Notice: Publishing the Small Works Roster for Lewis County. Resolution
No. 11-016
Tim Elsea, Director of Public Works, stated the attached resolution will allow
opening the Small Works Roster to obtain applications from businesses interested in
having their business placed on one or more of the rosters. The Small Works Roster

allows the County and agencies holding interlocal agreements to use contractors on
the established list for projects between $35,000 and $300,000. Agencies currently
holding interlocal agreements are: Lewis County Conservation District, Lewis County
Fire District #2, Lewis County Fire District #8, Lewis County Fire District #11, Lewis
County Fire District #15, Lewis County Water District #1 and the Chehalis-Centralia
Airport. The Small Works Roster will remain open per RCW 39.04.155.
Chairman Averill stated this is not a Notice of Hearing but merely a Notice of
Publication.

CONSENT
Commissioner Grose made a motion to approve Consent Agenda items four
through eleven. Commissioner Schulte seconded the motion. Candace Hallom
read the items into the record.
4. Resolution No. 11-017 Approval of warrants and payroll for payment.
Chairman Averill stated this approves 382 warrants and 7 Special Purpose District
warrants issued by the Auditor’s Office for a total of $1,033,010.78. Also, approves
263 warrants for draws on County Net Pay for a total of $225,590.00.
5. Resolution No. 11-018 Ratifying the Fleet Coordinator’s signature on an
agreement with Papé Machinery.
Tim Elsea, Public Works Director, stated this is a housekeeping matter. We have
purchased a broom sweeper off of the State contract from Papé Machinery and are
asking the BOCC to ratify the signature.
6. Resolution No. 11-019 Declaration of surplus equipment.
Tim Elsea, Public Works Director, stated Lewis County Code 3.30 requires that
the Board of County Commissioner declare property surplus to allow for its disposal.
The attached lists of vehicles and equipment have reached their useful life. Items
listed will be sold at Ritchie Bros Auction, March 8, 2011.
7. Resolution No. 11-020 Approving an inter-local agreement with the City of
Seattle.
Tim Elsea, Public Works Director, stated Lewis County Public Works has
one (1) Oil Distributor up for replacement. Equipment #A-36, stationed at
Central Shop, is a 1981 International chassis with a Bearcat tank/distributor.
This Oil Distributor has been scheduled and budgeted for replacement in year
2011. Currently, there is no open contract with the State of Washington,
however, the City of Seattle has a bid award with Peterbilt dated July19,
2010.

8. Resolution No. 11-021 Approving an inter-local agreement with the City of
Chehalis for computer and software maintenance services.
9. Resolution No. 11-022 Approving an inter-local agreement with the
Riverside Fire Authority for computer and software maintenance services.
10. Resolution No. 11-023 Approving an inter-local agreement with Lewis
County Fire District #2 for computer and software maintenance services.
Michael Strozyk, Director Central Services, spoke on items 8, 9, and 10 stating
item 8, Resolution No. 11-021 approves an interlocal agreement with the City of
Chehalis for computer and software maintenance services. Currently, County IT
Services provides support to the City of Chehalis Police and Fire Department for
their public safety software; the data terminals in their vehicles. The core of that
software is owned by Lewis County 911 and in order for us to work on the car
programs we need an interlocal agreement with the City. The City of Chehalis has
minimal terminals so the contract in this case is for $110.00 minimum and billed at
$55.00 per hour for labor on those units. This is a two year agreement running
through December 31, 2012. Overtime or emergency callouts, when authorized by
the agency, are billed at $80.00 per hour. Items 9 and 10 are similar to item 8. Item
9, Resolution No. 11-022 approves an inter-local agreement with Riverside Fire
Authority. This contract is a little different due to the fact they have over ten units.
There is a $45.00 per month per laptop charge if the ten units are exceeded. Item
10, Resolution No. 11-023 approves an interlocal with Lewis County Fire District #2
which is the same as the inter-local with City of Chehalis.
11. Resolution No. 11-024 Cancellation of taxes.
Rose Bowman, Treasurer, stated as we work through our tax collection process we
have found a need to write off certain taxes. These are intangible personal property
type activities, if it is real property we take it to sale. Generally, these are mobile
homes but there is some business equipment as well. There are also mineral rights,
which have a low value, that we haven’t been able to collect. It would cost the
County more to try to collect them than to write them off.
Chairman Averill stated a vast majority of the non-collectibles are mineral rights,
each parcel about $6.00. There are 260 accounts being written off for a total
$4,031.84. When you look at the size of the list it is not a significant amount of
money. The bothersome issue was one company has a huge number of these.
Rose Bowman stated though the total is significant but when you have to go piece
by piece the cost to us would be more significant.

There being no further business, the Commissioners’ public meeting adjourned at
10:32 am. on January 24, 2011. The next public meeting will be held Monday,
January 31, 2011, at 10:00 a.m.
