BOARD MEETING MINUTES
March 8, 2010
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, March 8, 2010, at 10:00 a.m. COMMISSIONERS P.W. SCHULTE,
RON AVERILL and F. LEE GROSE were in attendance. Chairman Schulte
determined a quorum, called the meeting to order and proceeded with the flag salute.
Commissioner Grose moved to approve the minutes from the 10:00 a.m. meeting held
on Monday, March 1, 2010. Commissioner Schulte seconded the motion.

Notice
Commissioner Averill made a motion to approve Notice Items one through three.
Commissioner Grose seconded the motion. Karri Muir, Clerk of the Board read the
items into the record.
1. Notice of Hearing: Regarding the 7th Budget Amendment for 2009. Hearing will be
held on or after 10:00 am on Monday, March 22, 2010. Resolution No. 10-058
Dawna Truman Fiscal, stated this budget hearing is for funds that need to be cleaned
up for 2009. The approximate amount of the amendment is $80,000.00.
Commissioner Averill noted that amount is subject to change if other vouchers come
in that are not accounted for.
2. Notice of Hearing: Regarding Ordinance 1212 related to display of firearms
within Lewis County Parks. Hearing will be held on or after 10:00 am on Monday,
March 22, 2010.
Bob Johnson, Community Development spoke on items two and three. He noted that
the first hearing will address the use and discharge of firearms in County parks and the
second will amend the No Shooting Ordinance in LCC 9.05 to designate those parks as
a No Shooting Zones. . There will be one hearing for each ordinance.
Commissioner Averill stated that this issue was brought to light when a citizen
challenged the City of Seattle’s firearms law. State Law reserves the right on firearms to
the State itself. It specifically tells both counties and cities and other municipal type
corporations, that they cannot make laws which change the intent of the State Law. A
County can normally make a law more restrictive or less restrictive based upon the
issue of the state law, but in this case we cannot. We will adopt the State Law by
reference. By making the parks a ‘No Shooting Zone’ it should be obvious that this is
not a place to bring a weapon in. We hope that most people will not. These two actions
together, we hope, will clear up the issue and we will not have an issue in our code
which is not in compliance with the State Law.
Mr. Johnson stated the intent is to adopt in whole RCW 9.41, which deals with firearms
in general.

3. Notice of Hearing: Regarding Ordinance 1213 related to the establishing of Lewis
County Parks as No Shooting Zones. Hearing will be held on or after 10:00 am on
Monday, March 22, 2010.
Motion carried 3-0
Consent
Commissioner Grose made a motion to approve Consent Items four through nine.
Commissioner Averill seconded the motion. Karri Muir, Clerk of the Board read the
items into the record.
4. Resolution No. 10-059 Appointing a member to the Lewis County
ATOD/CMASA Advisory Board.
Glenn Carter stated that Deputy Cailen Wevodau will replace Deputy Prosecuting
Attorney Jonathan Richardson on this board. She is familiar with most of the agency’s
who work with drug addiction in the County. He noted that Ms. Wevodau will do a good
job on this board.
Commissioner Averill noted that this board meets once a month. This board looks at
programs that are in the County that deal with substance abuse prevention.
5. Resolution No. 10-060 Proposed acquisition of additional right of way for
Dodge Road.
Larry Unzleman stated that a project to replace the culvert on Dodge Rd has been
completed. Regular channel cleaning on both sides of the culvert will be needed to
maintain the culvert and drainage. Additional right of way for the culvert and channel
cleaning will need to be acquired from one property owner.
Commissioner Grose noted that this project was from the 2006 flooding.
6. Resolution No. 10-061 Proposed acquisition of additional right of way for
Wirsdorfer Road.
Larry Unzleman stated that this road has a small turnaround at the end of it, which is
making it difficult for school buses to turnaround. The County plans to improve the
turnaround to a standard size turnaround. The project will require right of way
acquisition from one property owner, Weyerhaeuser Co., who is in agreement.
7. Resolution No. 10-062 Bid award to Quality Fence Builders for Bunker Creek
Pit Fence Project.
Rod Lakey, Public Works stated that bids went out to all of the fencing contractors on
the Small Works Roster. Public Works received four bids back and Quality Fence
Builders, Inc. were the lowest bidder in the amount of $60,766.00. A contract was
executed with Quality Fence Builders, Inc. and this resolution will ratify that contract.
This fence is for the protection from an escarpment at of the pit to prevent falling.
Commissioner Averill noted that this area of the Bunker Pit has already had an
accident there. This is an area which is dangerous. He questioned the price of the

fencing contract, but the terrain around this area means the fencing has to be much
longer and it is a more difficult project than a normal fencing project.
8. Resolution No 10-063 Cancellation of warrants.
Commissioner Averill stated this resolution cancels two warrants totaling $3,280.00,
issued by the Lewis County Auditor, which were lost or destroyed or paid to an incorrect
vendor. Corrected warrants will be reissued.
9. Resolution No. 10-064 Support of water retention as a primary flood prevention
measure.
Commissioner Averill noted in support of, and in agreement with, other government
jurisdictions in the upper Chehalis River Basin, the Lewis County Board of County
Commissioners declare their support for:
• Funding and completion of Phase II B, and such other phases that may be
required, of the Lewis County Public Utility District # 1 Water Retention Study;
• Completion of the Governor’s Office proposed Coordinated Study to show how
water retention and levees may complement each other;
• Reauthorization of a significantly different US Army Corps of Engineers Twin
Cities Project, with retention as the primary element that includes levees as
secondary; and
• Formation of a Basin Wide Flood Control or Flood Control Zone District for the
Chehalis River Basin.
Motion carried 3-0
There being no further business, the Commissioners’ public meeting adjourned at
10:27 am on March 8, 2010. The next public meeting will be held Monday, March 15,
2010, at 10:00 a.m.
