BOARD MEETING MINUTES
July 26, 2010
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, July 26, 2010, at 10:00 a.m. COMMISSIONERS P.W.
SCHULTE, RON AVERILL and F. LEE GROSE were in attendance. Chairman
Schulte determined a quorum, called the meeting to order and proceeded with the
flag salute. Commissioner Grose moved to approve the minutes from the
10:00 a.m. meeting held on Monday, July 19, 2010. Commissioner Averill
seconded the motion.
Motion carried 3-0
PUBLIC COMMENT
Jan Iddings, Vader, WA stated she volunteered to be on a committee to get
information on how Vader can dis-incorporate. She is asking the County what they
can do for the City of Vader.
Chairman Schulte stated she should talk to the Public Works Director, and the
Fiscal Director.
Commissioner Averill stated she should also talk to the Community Development
Director because of the South County Regional Plan and Development Laws. He
also noted that if a city dis-incorporates they would lose services such as fire and
law services.
CONSENT
Commissioner Averill made a motion to separate the Consent Agenda and
approve Consent Item one alone. Commissioner Grose seconded the motion.

1. Resolution No. 10-186 Adoption of the Multi-Jurisdictional Hazard Mitigation
Plan.
Commissioner Averill stated this resolution comes under FEMA rules and they
state you must have an open public meeting to pass this plan.
Chairman Schulte stated this plan was funded by Lewis County Public Works and
the City of Centralia put it together. There were multiple jurisdictions that worked on
this together and this is the last step in the process.
Mr. Johnson noted that participation is very important in this plan. The plan is for all
potential hazards that may occur, so if one happens there is a process. All of the
other jurisdictions have adopted this plan. FEMA requires jurisdictions that apply for

emergency funding to have an emergency mitigation plan in place. This plan is good
for five years.
Chairman Schulte stated he felt this was a good use of County funds. The City of
Centralia and the County took the lead in this project and the plan will help the whole
county.
Commissioner Averill noted that the County does have a Flood Hazard Plan, but
this plan is for an “All Hazard Plan”. We are one of the few counties in the State that
did this with other jurisdictions. Many of the jurisdictions participated, but not all.
He thanked Emil Pearson for his work on this plan and the various groups that
helped with it also.
Motion carried 3-0
Commissioner Averill made a motion to approve Consent Agenda items 2 through
four. Commissioner Grose seconded the motion. Karri Muir, Clerk of the Board
read the item into the record.
2. Resolution No. 10-187 Approving a Consent and Release Agreement to
allow Broadstripe , LLC to sell a portion of their cable system operating in
Lewis County to New Day Broadband, LLC.
Bob Johnson, Community Development stated this agreement deals with legal
and technical issues with Broadstripe, LLC. Broadstripe, LLC is undergoing
bankruptcy and a part of that is selling a portion of their cable operating system to
New Day Broadband, LLC. This will allow New Day Broadband, LLC to assume a
part of their franchise that is in Lewis County.
Commissioner Averill stated that this bankruptcy is part of a re-organization of
Broadstripe, LLC. They are keeping four out of five systems in Lewis County. This
resolution will allow New Day Broadband, LLC to be under the existing franchise that
is already in place.
3. Resolution No. 10-188 Imposing a burn ban on all lands regulated by
Lewis County, as of July 27, 2010, 12:01 am.
Bob Johnson, Community Development, stated the Department of Natural
Resources (DNR) imposed a burn ban on July 15, 2010. Lewis County is imposing
one now, based on the recommendation of the County Fire Marshal.
Commissioner Averill stated that the DNR burn ban was from July through
September. We cannot predict the weather in September, so Lewis County does not
lift the burn ban until we have received sufficient moisture to do so.
Commissioner Grose pointed out that there are two different kinds of burn bans
that are imposed in Lewis County. The one we are doing today is for outdoor
burning. The other one is imposed by South West Washington Clean Air Authority
(SWWCAA), and that has to do with air pollution. The Board does not agree with the
burn bans imposed by the SWWCAA.
Mr. Johnson pointed out that fires are allowed in approved campfire spots.

4. Resolution No. 10-189 Approving a master inter-local agreement with
WA State Parks.
Rod Lakey, Public Works, stated this resolution would allow Washington State
Parks and Lewis County to enter into a master inter local agreement. This
Agreement will govern reimbursable work performed by Public Works forces for
which the municipality does not have the capability to do themselves. The term of
the Agreement will be for a period of 5 years and will expire on December 31, 2015.
It is in the best public interest to authorize the execution of said master inter local
agreement in order to streamline the administrative process and allow use of
reimbursable works orders for routine work done by County crews for Washington
State Parks.

HEARING
Hearing Ordinance 1215-Utility Division
Chairman Schulte announced the hearing and asked for a staff report.
Tim Elsea, Public Works Director stated it is in the best interest of the citizens of
Lewis County to establish a county utility division within which to serve local areas
with water, sewer, and stormwater management. This public utility will support
growth and development consistent with the Lewis County Comprehensive Plan.
There is an immediate need to provide water service in the City of Vader in order to
correct health and safety deficiencies.
RCW 36.94, authorizes a county utility division and outlines the requirements for the
establishment of the utility and other necessary provisions for the management and
operations of the utility system. This utility division will be created within the
Department of Public Works consistent with the authority of RCW 36.97.120.
The Ordinance establishes a utility division within the Department of Public Works
and creates an administrator for management and operation of the utility division. It
will adopt utility regulations under Title 13 of the LCC. He read Ordinance 1215 into
the record.
Chairman Schulte asked if there were any questions. There were none. He closed
the question and answer portion of the hearing and opened the formal hearing.
Commissioner Averill clarified that we are establishing a utility division following
the RCW. He also noted that this is more important for long term planning in the
County. We are immediately dealing with the City of Vader on their water issues, but
other projects may fall under this division.

Commissioner Grose stated having this division created would allow us to receive
State funding.
Mr. Elsea asked that his previous comments be adopted into the record.
Chairman Schulte closed the hearing and asked for a motion to approve Ordinance
1215.
Commissioner Grose made a motion to approve Ordinance 1215. Commissioner
Averill seconded the motion. Karri Muir, Clerk of the Board, read the item into the
record.
Motion carried 3-0
There being no further business, the Commissioners’ public meeting adjourned at
10:35 a.m. on July 26, 2010. The next public meeting will be held Monday, August 2,
2010, at 10:00 a.m.
