2010-10-04 Board Meeting Minutes 1 BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES October 4, 2010 The Board of County Commissioners for Lewis County, Washington met in regular session on Monday, September 27, 2010, at 10:00 a.m. COMMISSIONERS P.W. SCHULTE, RON AVERILL and F. LEE GROSE were in attendance. Chairman Schulte determined a quorum, called the meeting to order and proceeded with the flag salute. Commissioner Grose moved to approve the minutes from the 10:00 a.m. meeting held on Monday, September 27, 2010. Commissioner Averill seconded the motion. Motion carried 3-0 NOTICE Commissioner Averill made a motion to approve Notice Agenda item one. Commissioner Grose seconded the motion. 1. Proclamation: Proclaiming October as Domestic Violence Awareness Month in Lewis County. Commissioner Averill read the proclamation into the record. Emily Marecle, Human Response Network, stated last year they served over 500 clients in Lewis County and working with them and working in the Community, the most common question she gets is why do victims stay in violent relationships. The number one reason is lack of community support. Emily thanked the Commissioners for proclaiming October as Domestic Violence Awareness Month because it shows victims in Lewis County that the community does support them. Commissioner Grose stated he was unaware of the stress that a good friend with whom he graduated from high school was in. After having been left for dead by her husband she did go and get some help and is now doing very well. He stated this happened several years ago and he appreciates the work that is done with this program. Motion carried 3-0 Commissioner Averill made a motion to approve Notice Agenda item two. Commissioner Grose seconded the motion. Candace Hallom read the item into the record. 2 2. Notice of Hearing: Regarding a non-exclusive franchise to PUD No. 1 of Thurston County to construct, operate, and maintain water facilities on Lewis County rights of ways. Hearing will be held on November 1, 2010, on or after 10:00 am. Resolution No. 10-248 Larry Unzelman, Public Works, stated this is a non-exclusive franchise for Public Utility District No. 1 of Thurston County to construct, operate and maintain water system facilities on county road rights of way in Lewis County, WA. Public Utility District No. 1 of Thurston County has requested a franchise for the construction, operation and maintenance of water system facilities on various Lewis County roads. There is a list of the roads attached to the franchise document or the segment of road where the water line is located. The PUD currently has numerous small water systems within the County, some of which have lines installed on county road rights of way. This franchise would authorize these installations for a five year term. This resolution will set November 1, 2010 as the date for hearing on the franchise and call for required postings and publications by RCW 36.55.040. Commissioner Averill stated some people might wonder why Thurston County PUD is in Lewis County. The reason is many Public Utility Districts choose not to get too spread out with different types of utilities. Lewis County PUD has specifically turned down the opportunity to take water systems in the county on a couple of occasions and concentrates on electricity service. The Thurston County PUD does not have local electrical it is done by PSE, so they have concentrated on water and have extended their arms to five or six counties around. They currently are asking for rights of way on thirteen roads, they have well over 126 wells that are currently operating in the County and at one time they were interested in taking over the Vader System. Commissioner Grose noted this notice came out in the paper saying 35 years and that was changed. It is officially a five year non-exclusive franchise. Motion carried 3-0 CONSENT Commissioner Grose made a motion to approve Consent Agenda items three through five. Commissioner Averill seconded the motion. Candace Hallom read the items into the record. 3. Resolution No. 10-249 Approval of warrants for payment Commissioner Averill stated this resolution approves 222 warrants issued by the Auditor’s Office for a total of $1,226,307.28. 4. Resolution No. 10-250 Inter-local agreement with Lewis County Fire District #2 for use of the Small Works Roster. 3 Tim Elsea, Public Works stated RCW 39.04.155 (2)(b) establishes guidelines for inter-local agreements allowing other state agencies use of an established Small Works Roster. Lewis County Fire District #2 (Toledo) requests that we establish such an Inter-local Agreement. It appears to be in the best public interest to authorize the execution of said Inter-local Agreement in order to allow use of the Lewis County Small Works Roster in a manner that is consistent with that of the County. 5. Resolution No. 10-251 Re-appointment of a member to the Lewis County Water Conservancy Board. Robert Johnson, Community Development stated the Water Conservancy Board is a volunteer group that works under authorization from state statute on water right transfers and applications. At the local level it is a body made up of members appointed for six year terms. One of those members, Bob Thode’s, term expired at the end of September. Mr. Thode indicated that he is interested in being reappointed. The Water Conservancy Board at their last meeting discussed the issue and determined they were in favor of Mr. Thode’s reappointment. This resolution appoints Mr. Robert Thode to a six year term ending at the end of September 2016. Commissioner Averill stated Bob is one of the newer members on this W ater Conservation District, two of the other members Ron Mauel and John Moercke are looking for replacement. We have found replacements; however, this board requires extensive training and the training this year is over on the east side. We have an agreement from the two members to hold off a year for the new members to train next year when the training will be on this side of the Cascades. We will have a motion shortly to make the two understudies alternates so they can attend meetings and prepare to take over those positions. Commissioner Schulte stated he does have reservation with reappointing Bob Thode, however, with the desire of two of the member to become less involved and in lieu of needing some continuity he will agree with this appointment. Motion carried 3-0 There being no further business, the Commissioners’ public meeting adjourned at 10:16 a.m. on October 4, 2010.
