BOARD MEETING MINUTES
November 29, 2010
The Board of County Commissioners for Lewis County, Washington met in regular
session on Monday, November 29, 2010, at 10:00 a.m. COMMISSIONERS P.W.
SCHULTE, RON AVERILL and F. LEE GROSE were in attendance. Chairman
Schulte determined a quorum, called the meeting to order and proceeded with the
flag salute. Commissioner Averill moved to approve the minutes from the 10:00
a.m. meeting held on Monday, November 22, 2010. Commissioner Grose
seconded the motion.

NOTICE
Commissioner Grose made a motion to approve Notice Agenda items one and
two. Commissioner Averill seconded the motion. Candace Hallom read the items
into the record.
1. Notice of Hearings and Workshops: Regarding the 2010 amendments to
the LC Comprehensive Plan. Hearing will be held on or after 10:00 am,
on December 13, 2010.
Commissioner Averill stated this provides notice of a workshop and public hearing
to adopt ORD 1218, amending Chapter 16, Lewis County Code (LCC), and ORD
1219, amending Chapter 17 LCC. The amendments are in reference to the Lewis
County Comprehensive Plan (by Resolution) and implementing development
regulations (by Ordinance). The first hearing will address proposed text amendments
to the Comprehensive Plan to adopt an Economic Development Element; amend the
Land Use Element – Urban Sub-element and Rural Sub-element; and, amend the
Capital Facilities element. In addition, the Toledo Urban Growth Area is being
amended to include additional land to accommodate expected population growth.
The second hearing concerns proposed amendments to LCC Chapter 17 by
reformatting and including regulations for the Industrial Park at TransAlta. Also under
consideration are changes to Chapter 16 LCC considering commercial and industrial
binding site plan options, and several rezone applications. A public hearing will be
conducted on or after 10:00 am on December 13, 2010. The Public will have an
opportunity to ask questions and provide testimony prior to consideration for
adoption by the Board of County Commissioners.
Robert Johnson, Community Development, stated there will be a workshop today
November 29, 2010 at 2:00 p.m. and one on December 6, 2010 at 2:00 p.m. in the
Commissioner meeting room. The workshops are open to the public but there will
not be an opportunity for public input at these workshop, the workshops are merely

for the Board to review the proposed changes to the Comprehensive Plan. There
will be the opportunity for public input at the public hearing on December 13, 2010.
2. Notice of Hearing: Regarding adoption of 2009 editions of the
International Building Codes. Hearing will be held on or after 10:00 am,
on Monday December 20, 2010.
Robert Johnson, Community Development, stated this notice of hearing is
regarding adopting amendments to Lewis County Code Chapter 15.05, incorporating
the 2009 edition of the International Building Code (IBC). A public hearing will be
conducted on or after 10:00 am on December 20, 2010. This hearing is to adopt the
latest version of the Plumbing Code, Fire Code, Residential Code, Building Code,
and Mechanical Code. The public will have an opportunity to ask questions and
provide testimony prior to consideration for adoption by the Board of County
Commissioners.
Commissioner Grose stated he would like to see the changes being made as there
are rumors regarding putting green requirements into the IBC. He would like to
ensure that what we are adopting is in compliance but does not add other
restrictions and requirements.

CONSENT
Commissioner Averill made a motion to approve Consent Agenda items three
through five. Commissioner Grose seconded the motion. Candace Hallom read
the items into the record.
3. Resolution No. 10-301 Approval of warrants for payment.
Commissioner Averill stated this resolution approves 190 warrants issued by the
Auditor’s Office for a total of $660,863.57.
4. Resolution No. 10-302 Approval of an inter-local agreement between
Lewis, Grays Harbor, Mason, Pacific, and Thurston Counties for the
Workforce Investment Act Implementation.
Commissioner Averill stated this resolution approves an Inter-local Agreement
between Lewis, Grays Harbor, Mason, Pacific and Thurston Counties for
implementation of the Work Force Investment Act. Specifically, this agreement
creates the Pacific Mountain Workforce Consortium (the five signatory counties) for
the purpose of delivery of workforce development programs in the five-county region
funded primarily, but not exclusively, by the Workforce Investment Act or subsequent
federal employment and training legislation. This Consortium acts as the Chief
Elected Official and oversees the work of the Pacific Mountain Workforce
Development Council, a 501(c) (3) not for Profit Corporation of the State of

Washington. Each County shall appoint a County Commissioner as a member and
an alternate to the Consortium Board.
The Workforce Council has existed for many years and covers the same five county
regions. Previously, Thurston County acted as the lead agent for the Workforce and
the Workforce Council staff incorporating it into the staff of the Health and Social
Service Department of Thurston County. During the past year we have been
working with the staff and W orkforce Council to make this organization a 501(c) (3).
They will be moving their offices out of the Thurston County Health Building to
Satsop. Over the years, Thurston County ran the W orkforce Council with side
briefing to the other four counties; this new inter-local establishes a Board consisting
of one Commissioner from each of the five counties. This Board will be responsible
for overseeing the work of the Workforce Council staff.
5. Resolution No. 10-303 Appointment of a member to the Pacific
Mountain Workforce Consortium Board and an alternate member.
Commissioner Averill stated this resolution approves the appointment of
Commissioner Ron Averill as the primary member, and F. Lee Grose as the
alternate member, of the Pacific Mountain Workforce Consortium Board, required by
consent item 4, RES 10-302, supra.

BID OPENING
Bid Opening: Rosebrook Slide Repair
Rod Lakey, Public Works, stated this project involves 0.6 miles of Rosebrook Road
in Lewis County. The contract will provide for the improvement of 0.26 miles of
Rosebrook Road in Lewis County by constructing soldier pile walls, underdrain,
ditches, removing guardrail, road restoration, placing guardrail, and other work. The
Engineers estimate for this project is $676,430.00. There were no addendums to this
call for bids and a bid bond of 5% is required. Rod Lakey introduced Shawn Jendryka,
Public Works, who will be the project manager for the Rosebrook project and will assist
Rod with the bid openings today.

Rod Lakey state Public Works will evaluate all bids and come back with a
recommendation next week. The apparent low bidder is Pile Contractors at
$570,319.00.
HEARING
Hearing: Countywide Planning Policies
Chairman Schulte announced the hearing and asked for a staff report.
Robert Johnson, Community Development, stated the Countywide Planning
Policies (CWPP) are required under the Growth Management Act (GMA). Lewis
County first adopted them in 1995 and they have been subsequently amended from
time to time, the last being in 2008. Under the GMA all jurisdictions of the County
are required to review and come up with provisions for population allocations, rural
urban population, and designations to accommodate the population projections from
the Office of Financial Managements. The County has been doing this through a
process called the Planned Growth Committee (PGC) which is a committee made up
of Elected Officials from the incorporated Cities and Towns as well as a member
from the Board of County Commissioners. The amendments to the CWPP include;
some policy statements that set the stage for the designation of the major industrial
areas and provides some policy statement with respect to the development outside
of the City Urban Growth Areas.
Commissioner Averill stated these are not new policies we are amending the
existing policies. These are countywide policies not only for the County but for the
Towns and Cities within the County. The PGC did not hold hearings on these
policies but the Planning Commission did. The Planning Commission forwarded
their findings to us recommending approval.
Chairman Schulte asked if there were any more questions. There were none. He
closed the question and answer portion of the hearing and opened the formal
hearing.
Robert Johnson asked that his previous comments be adopted into the record.

Commissioner Averill stated he had the pleasure of working with the Cities and
Towns on these policies over the past two years. The cooperation between all the
jurisdictions in the county is an important aspect of development in the county.
Commissioner Schulte stated this process has been fully engaged with the
County, Cities, and Towns and we have worked through any disagreements. The
final produce is something we all can live with.
Chairman Schulte asked if there were any other statements for public testimony.
There were none. He closed the hearing and asked for a motion to approve
Resolution No. 10-304.
Commissioner Averill made a motion to approve Resolution 10-304.
Commissioner Grose seconded the motion. Candace Hallom, read the item into
the record.
Resolution No. 10-304 Adoption of Countywide Planning Policies for Lewis
County, replacing policies adopted by Resolution No. 08-349.
Motion carried 3-0
There being no further business, the Commissioners’ public meeting adjourned at
10:50 a.m. on November 29, 2010. The next public meeting will be held Monday,
December 6, 2010, at 10:00 a.m.
