2016-04-25 Business Meeting Minutes BOARD OF COUNTY COMMISSIONERS LEWIS COUNTY, WASHINGTON BOARD MEETING MINUTES April 25, 2016 The Board of County Commissioners (BOCC) for Lewis County, Washington, met in regular session on Monday, April 25, 2016, at 10:00 a.m. P.W. "Bill" Schulte Commissioners, Gary Stamper, and Edna J. Fund were in attendance. Chair Schulte, called the meeting to order, determined a quorum, and proceeded with the flag salute. Commissioner Fund moved to approve the minutes of the 10:00 a.m., Monday, April 18, 2016 Business Meeting. Commissioner Stamper seconded the motion. Motion carried 3-0. Notice Commissioner Stamper moved to approve Notice Agenda items one and two. Commissioner Fund seconded the motion. 1. Notice: Notice regarding a public auction of surplus county property for items declared surplus, will be held at 8:00 am, May 17, 2016 at Ritchie Brothers Auction, 104 Avery Road W., Chehalis, WA. Items may be previewed Monday thru Friday beginning May 7, 2016 from 8:00 am -5:00 pm Resolution No. 16-127 Tim Elsea, Director of Public Works, stated the items listed on Exhibit "A" are no longer useful to Lewis County. The attached list of vehicles have reached their useful life and have been replaced or scheduled for replacement. We recommend this surplus equipment be sold at auction on May 17, 2016. The advertising for surplus property and sale will be completed by Lewis County in accordance with the surplus property ordinance. Items listed on Exhibit "A" will be sold at Ritchie Bros Auction, May 17, 2016. 2. Notice of Public Hearing: For a traffic ordinance fixing the maximum speed at which vehicles may be operated over certain roads in Lewis County, defining offenses, and providing penalties for violations. Hearing will be held on or after 10:00 am on May 9, 2016. Resolution No. 16-128 Tim Elsea, Director of Public Works stated "Adoption of Traffic Ordinance #219 will adjust the maximum speed limit on the following county roads, or portions of county roads:" 35 MPH - HWY 603 from milepost 13.100 to 13.420 35 MPH - Buckley Road from milepost 0.562 to 1.006 40 MPH - Salzer Valley Road from milepost 1.313 to 2.000 40 MPH - Yates Road from milepost 0.000 to 1.979 A Public Hearing must be held prior to adoption of Traffic Ordinance#219 providing an opportunity for any person to appear and be heard, either for or against the adoption of 1 the proposed ordinance. The public hearing will be held May 9, 2016, at the Commissioners Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis, Washington. The notice of public hearing will be published in the East County Journal on April 27, 2016 and The Chronicle on April 28, 2016. Motion carried 3-0. Consent Commissioner Fund moved to approve Consent Agenda items three and four. Commissioner Stamper seconded the motion. 3. Resolution No. 16-129 Approval of warrants for payroll and payment. Amanda Migliaccio, Auditors Office stated this Resolution approves 182 regular warrants for a total payment against the County in the amount of$269,974.59. This Resolution also approves 235 payroll warrants dated April 20, 2016 is approved for a total payment against the County in the amount of$268,012.00 4. Resolution No. 16-130 Rejecting all bids for the Highway 603 Stabilization Project. Tim Elsea, Director of Public Works, stated Lewis County issued a call for bids for the Highway 603 Stabilization Project by Resolution 16-087 on March 14, 2016. Two (2) bids were received and opened on April 12, 2016. Public Works follows the WSDOT 2014 Standard Specifications for our projects. Chapter 1-02 covers bid procedures and conditions. One of the bids received was not properly executed and is required by Chapter 1-02.13(f) to be declared irregular and rejected. The other bid was above the engineer's estimate by 20.4%. RCW 43.19.1911(1) allows for the rejection of all bids if a compelling reason exists. Public Works recommends the Board of County Commissioners reject all bids for the Highway 603 Stabilization Project. Motion carried 3-0. Hearing Traffic Ordinance 218-adjusting temporary maximum speed at which vehicles operated during maintenance, construction, or natural disasters in Lewis County Tim Elsea, Director of Public Works, stated Pursuant to RCW 46.61.415, local authorities are authorized to determine the maximum speeds permitted on roadways based on an engineering and traffic investigation. RCW 46.61.527, Chapter 468-95 WAC, and the Manual on Uniform Traffic Control Devices (MUTCD) all presuppose that maintenance or construction, as well as natural disasters, are conditions that may affect the maximum safe speed on an affected portion of roadway. Adoption of Traffic Ordinance #218 authorizes the County Engineer to temporarily adjust the maximum speed limit where maintenance or construction activities by county forces or contractor is underway, or a natural disaster has occurred, provided such temporary maximum 2 speed limits are based on an engineering and traffic investigation, and the roads or portions of roads are properly posted with signs in accordance with the MUTCD. A public hearing was held providing an opportunity for any person to appear and be heard, either for or against the adoption of Traffic Ordinance #218. Ron Averill, Centralia, asked if this allows Public Work to make these temporary changes without having to come to the BOCC for approval. Tim Elsea stated that is correct. Chair Schulte stated this helps with both construction and natural disasters. If any kind of mud flow or debris has crossed the road you can adjust the speed limit until you can evaluate it and clean it up. Chair Schulte, asked if there were any questions. There were none. He closed the question and answer portion of the hearing and opened the formal hearing. Tim Elsea asked that his previous comments be adopted into the record. Chair Schulte, asked if there was anyone who would like to speak for or against the Resolution. There was no one. He closed the hearing and asked for a motion. Commissioner Stamper moved to approve Traffic Ordinance 218. Commissioner Fund seconded the motion. Traffic Ordinance 218- An Ordinance adjusting the temporary maximum speed at which vehicles may be operated during maintenance construction, or natural disasters in Lewis County, Washington: defining offenses and providing penalties for the violations thereof.
