IN RE LEWIS COUNTY AND LEWIS COUNTY
CORRECTIONS GUILD AGREEMENT RELATING ) RESOLUTION 19- l\ Lo
TO HOLIDAY PAY OVERTIME CALCULATIONS )
WHEREAS, the Corrections Deputies work on County adopted Holidays, and
WHEREAS, the historical holiday pay calculation will not be compatible with the new
Munis financial system, and
WHEREAS, the Guild representing the Corrections Deputies and the County have come
to an agreement to establish a holiday and overtime pay calculation method that complies with
the Fair Labor Standards Act (FLSA) effective April 1 2019 and moving forward hereto within,
and
WHEREAS, the current Guild members will receive a one-time $400 00 payment for the
transition into the new FLSA compliant payroll process, and
NOW, THEREFORE, BE IT RESOLVED, that the BOCC approve the agreement with
the Corrections Guild effective April 1, 2019, as shown in the Top Sheet

CORRECTIONS GUILD MEMORANDUM OF UNDERSTANDING
SPANSKI RULE
Lewis County and Lewis County Corrections Guild have reached an agreement relating to
Holiday Pay being used in overtime calculations Effective April 1, 2019, and thereafter, Lewis
County will calculate the overtime (OT) rate in accordance with the Fair Labors Standards Act
(FLSA) Currently, the overtime rate being re-calculated, to include any Holiday Pay, gives an
above FLSA rate for overtime hours worked This process, labeled the "Spanski Rule", is not
compatible with the new Munis system that is being implemented with the county financial
system, since it is outside of the FLSA paying procedures For the loss of compensation, the
Correction Guild will be a given a onetime lump sum payment of $400 00 per member, to be
paid with the April payroll that will be paid on the May 5, 2019 payroll, issued on May 3, 2019
