2019-02-19 Prosecutor UpdateUpdate with PA’s Office February 19, 2019 2:02 p.m. Present: Commissioner Jackson, Commissioner Stamper, Commissioner Fund, County Manager Erik Martin, Eric Eisenberg, Cullen Gatten, Becky Butler, Amber Caulfield Guests: Jimmy Hilliard, Dr. Lindsey Pollock, Alex Brown, Linda Williams, Aime Smith (2:23 p.m.) Recorder: Rieva Lester Eric Eisenberg said changes have been made to the LLC agreement regarding GRBHO’s work with the treatment company, which would be a wholly-owned subsidiary with its own “mini” governing board. He said the other change would require that treatment center’s arm would have to have approval from the commissioners prior to expanding services. Eric said he can draft a resolution for the Feb. 25 BOCC meeting. Cullen Gatten said Cemetery District 9 has two vacancies and would like the commissioners to appoint a commissioner to Cemetery District 9. The commissioners asked Rieva Lester to work on a press release and application for the cemetery district. Eric said RES Americas’ environmental documents have been published. He noted that the process was delayed due to corrections needed in the documents RES Americas submitted. Eric said he is working on changes to the Weed assessment. He said the text indicated it was for unincorporated areas when it should apply to all areas of Lewis County. He noted it was merely a drafting error. Amber Caulfield said former Commissioner Eros has filed a recall effort in Water District 5 to recall Deborah Hilliard. She said the court will determine if there are enough facts to go through the special election process. She said it was filed Feb. 5 and that she is sending it to Superior Court later in the day. She said the proposed date for the hearing is 1 p.m. March 4. Eric said the PA’s Office is tasked with summarizing the petition and then filing that with Superior Court. Eric said that the resignation of April Toups from District 5 and the recall effort make it unlikely the proposed mediation will take place. Aime Smith joined at 2:23 p.m. Eric said the county should concentrate on potential takeover of water treatment plants across the county. At 2:25 p.m., Commissioner Jackson announced that the Board was going into Executive Session under RCW 42.30.110(1)(i) for 20 minutes to discuss pending and potential litigation. Executive Session ended at 2:45 p.m. Commissioner Fund made a motion to ask Erik Martin to work on settlements in the Heldreth and Van Donsel settlements. Commissioner Stamper seconded. Motion passed 3-0. Meeting ended at 2:48 p.m.
