2019-04-02 PA UpdatePA Update April 2, 2019 2:00 p.m. Present: Commissioner Jackson, Commissioner Stamper, Commissioner Fund, County Manager Erik Martin, Becky Butler, Jonathan Meyer, Eric Eisenberg, Janelle Kambich, Cullen Gatten, David Fine, Amber Caulfield Guests: Dr. Lindsey Pollock, Alex Brown Recorder: Candace Hallom Amber reported that Water/Sewer District 1 has a commissioner who is not a valid commissioner. Jonathan said they will send a letter notifying the Water/Sewer District. The BOCC may have to appoint a new Water/Sewer District 1 commissioner. The PA’s office will look into it further. Jonathan spoke to a letter that was received from the City of Napavine regarding a position on the City Council. This is similar to the situation in Winlock. The City of Napavine is requesting the County confirm the appointment of Larry Stafford. Commissioner Stamper moved to reaffirm Larry Stafford to the Napavine City Council. Commissioner Fund seconded. Motion Carried 3-0. Eric Eisenberg discussed ITA staffing. Great Rivers Behavior Health Organization (GRBHO) made a counter offer of a $90 increase per hearing. Using the number provided, it would cover the cost of another prosecutor and would also provide for a full-time employee rather than a part-time employee. Eric spoke to the courts and they have some requests. Eric would like to speak to GRBHO again to speak to the court requests. Becky asked what will happen when there are not enough hearings to cover the cost of the staff and how will the County pay for the staff. Considering the population, it is highly doubtful. The PA’s office will put together a PAF. Becky noted the PA’s office will need a budget amendment. Eric provided an update on the Dangerous Animal Designation Board. Amber discussed Water/Sewer District 5. Judge Lawler will make a determination by April 8th. Cullen discussed the WSU extension update. The Board would like a meeting scheduled as soon as Cullen finds out any new information. The group discussed code enforcements power on civil infractions and the adequate ability to enforce. Cullen has been having conversations with Bill Teitzel regarding this issue. Cullen said Lewis County could amend the code to include a misdemeanor that would allow Bill a more authority. At 2:32 p.m., Commissioner Jackson announced that the Board was going into Executive Session under RCW 42.30.110(1)(i) for 20 minutes to discuss pending and potential litigation related to Cortland, Hupy and Green. Executive Session ended at 2:52 p.m. No decisions were made. Commissioner Stamper moved to authorize the Prosecuting Attorney’s Office to demand that the plaintiffs Brian Courtland and Brian Green file the threatened litigation within 14 days. Commissioner Fund seconded. Motion carried 3-0. Commissioner Stamper moved regarding the Thurston case 18-2-01897-34 to compensate Brian Courtland and Brian Green $3,983.33 each and Christopher Hupy $3,983.34 to satisfy the penalties ruling in that case. Commissioner Fund seconded. Motion carries 3-0 Commissioner Stamper moved regarding the Thurston case 18-2-01897-34 to offer payment of Attorney’s fees in the amount of $25,000 to Joseph Thomas. Commissioner Fund seconded. Motion Carried 3-0. Meeting adjourned at 3:10 p.m.
